All the calculations are based on the following assumptions
a)Number of EB2(ROW) Labor approval from PERM would be in the range of thousands, say maximum 5000.

1) Increased Audit and backlog built by PERM system
2) Bad Economy.
b) Spillover to EB2 would benefit india more than China.
But even if 50% of pending PERM are cleared this year then the # of EB2 would be more.
So every EB2 should pray that the PERM system should work in the same pace for next 1 year.
But, woudn't the 75% of 140K quota for next two years be consumed by ROW applicants who are about to apply. Becoz they are current wouldn't the VISA number go to them..

Employer is tsill at liberty not to interview EAD holder. If you are not interviewed, hiring would not come into picture and hence this text of law in I-9 form is worthless for you for that position. This I-9 text will only cover the situation for the period after hiring not before hiring.

It is not too late to write the letter, it is never too late to write the letter!!
Since the letters are only requesting fixing of the interpretation of the law, and not the law itself, there really is no fixed deadlines involved. Of course, sooner it is done, the better our chances are for moving forward.

Listing down things I did after my date was current-
1: I opened an SR on July 5th (immediately after long weekend) as my date was current in July. Got back a response in a week that no visa numbers available. Either their system was not updated or they didnt check to see if dates were current.
2: Had to wait a month before I could open another SR. In first week of August I contacted local congresswoman/opened another SR. Congresswoman reply was that the case is being actively worked on.
3: Also, contacted the Ombudsman (mailed all the required docs) in 1st week of August. Got a response in early September that Ombudsman can help to improve procedural inefficiencies in USCIS or some extreme cases.
4: Sent an email to SCOPSSCATA@dhs.gov on August 4th with pretty much the same details- case pending/PD etc. On same day they forwarded email to NCSCfollowup, TSC for resolution.
5: On Aug 9th got reply from NCSCfollowup, TSC that file has been requested. To allow 60 days.
6: After this I did not followup in any way. Then I got an email from NCSCfollowup, TSC on 17th September that my case review was complete, prints/security was over and my file would be forwarded to officers for completing.
7: Got approval email today (September 21st).
In my opinion the email to SCOPSSCATA@dhs.gov helped the most.
If anyone needs any details on email/letter format please let me know. (Green.Tech, Saileshdude...)

First of all, they cannot ask you for you work authorization during the interview process. Second, even during hiring time, they can only ask you if you need sponsorship for H1 or not. If at this point you say no, then they have no business asking you for what kind of work authorization you have (unless the job specifically asks for US citizen or security clearence).
That's true actually. They have no business asking you about details of what your work authorization status is. All they need to know is that you are legally allowed to work. Doesn't matter EAD, GC or US citizenship. Sponsoring for H1B might come up during the hiring stage but that doesn't apply here.
Hypothetically in an interview, if directly asked, and if I am planning on using EAD, I would simply tell them that I have authorization from the DHS to work for any employer, and leave it at that. If they persist, I will tell them that I have the required documents for I-9. No need for more details unless some kind of security clearance is required.

Is there any provision in any of the upcomming immigration bills that allows for "Ability to file for I485 even with visa number unavailability.". I know that
some of the provisions in Hagel (S. 1916, 1917, 1918, & 1919) Specter (unnumbered draft) bills have provisions for removal of numerical limits on adjust of status for people who have an advanced degree from US.
But is there any provision in any of the immigration bills which allows for "Ability to file for I485 even with visa number unavailability." like the one that was in s 1932. This would be easy to pass as Green card numbers would stay the SAME and no major modification is done to the existing law

Got Greened on the first day of September. It was a pleasant surprise to see an SMS from USCIS on my mobile.
Applied in 2006. So a wait of 4.5 yrs relatively looks short (but was a long one)

I have attended the Interview for H1 B renewal at the US consulate in Toronto (Although i see a lot of posts concerning US consulates in India....thought this might be helpful for someone who would attend an interviewat US consulate in Toronto)
I attended the Interview on Jan 16th at toronto for H1 B renewal and i got my passport back on Jan 23rd (4 business days as the officer told me as jan 21st is a holiday...martin Luther king day)
I have been speaking to some people at the consulate and for them it is taking 5-8 business days and for some they got it in 4 business days.....the worst i have seen is for a lady who was coming to the consulate from past 3 weeks everyday and there is no ETA on her status..(i hope she gets her passport soon:) )...
Unfortunately most of the people who attended there did not know of these delays and are struck cancelling and re-booking their flight tickets and extending their hotel stay

Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.

I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
Will this affect my GC process. I have no plans of buying a house in coming years.
What might be an outcome of foreclosure, keeping in mind that i am wiating for my GC process.
