You should be able to file I-140 after your LC got cleared.
EB-3's visa dates are at '08-MAY-01', so you can not file I-485 until visa dates move to SEP 01[You don't need to wait for the Visa dates to current].
May be your lawyer is busy & thinking about some other case. Remind him about your priority date !

Hi,
One of my friend is working in L1 on Informatica tool for one of the financial client.
Does it mean that his company is violationg rules?
His company is harrassing much for some personal reason and asking him to come back home country
what action he can take against his company if his company viaolating L1 rules.
Please anyone come across this situation then give us your suggestion.

He can not take any action. If they ask him to go back he has to go back. If informatica is embedded in another s/w which is company copyright then there is no technical violation of L1. Also if the project is administered by his company there is no violation of L1. If it is staff augmentation case, which does not seem to be the case here, then it could be violation of l1.

Where did I say that american's gave better advice than desis. I was just trying to compare mentality of two diff community for a same situation.

When you ask for advice, you need humility. Not call others stupid, when it looks like you made the same mistake. You bought a home which you were in no safe position to afford. There are people who didn't buy because they saw what was coming. Can these guys call you stupid because you didn't see what was coming? I have two approved I-140 (NIW/TSC 06/2006 and EB1A/NSC 07/2009) and a
pending I-485/TSC from 2007. I went infopass two weeks ago, and was told

Me and my wife had done finger printing on 09/10. On 09/15my wife got the clearnace from FBI and it is loaded into the system. I went to local immigration office and they did some searched and they told me that FBI loaded my finger printing detail using my social security number and not by the A number. Local IO can see the finger printing but when I called the Texas office they said they can't see the FP detail, and i tried again after some time got hold of another IO and she was able to search by my first and last name and saw in the system.
I opened an SR got a response that my FP is not received from FBI. So confusion is some IO officer who is trying other option to do search are able to see but not all the IO and that is delaying my approval process.
Any help or suggestion will be appreciated

We did further research and found out that, Vonage considers more than 5,000 minutes per line per month for unlimited residential calling and more than 10,000 minutes per line per month for unlimited small business calling is not to be considered normal use. Yes, I mean EB5. Another not, DOS/CIS waited till now as it takes some months to get a trend, as it seems CIS is cracking down on EB1C since later last year, and it took some time to see EB1 usage fall off and is plateauing now.

I am no Gandhi and don't want to be one. I am just a common man trying to make my ends meet. Only thing I know is that if you come before me in the line I am affected. It is not a DMV line where every one will get their License, it is a ration line where the items are limited.

Yup, you got it buddy......my point is more from a general perspective than any individual scenarios........and sledge_hammer.....I am well aware of the risk associated with every investment - I do own a house and am paying monthly mortgage installments even when knowing that my investment is at least 100k under water :)......so I perfectly understand the risk that comes with any investment AND i am not blaming my lender for giving me money - as I said before, I could afford it then and I can afford it now!
I am against this 'nobody saw it coming' and 'too big to fail' business - banks very well knew what was coming and what would it's effect be; they still went ahead and irresponsibly gave out money to people who can't even afford an eat out at Mcdonalds!!!! Nobody should give any bail out to these guys - let them suffer for what they have done; if I am acting responsibly for my deeds (paying monthly installment because I signed up for it) the same should apply to these banks - they should be allowed to fail simply on the fact that they didn't make good business decisions!

Hang in there. We filed on July 2 as well. Checks got cashed yesterday. Receipt notices have been mailed from NSC. You guys should expect to hear something anytime now.

This is an excellent point. DOS publications claim that PIMS has all the information since 2004. Please mention your approval dates too. There could be a delay pattern pertaining to the approval date.
Anyone with H1B after 2004 has seen any delay???
