Congratulations to all those who are finally getting their GCs after a month long wait (a much longer wait, I know). :)
I am beginning to find out that having your priority date current does not automatically mean GC. It is just another waiting area where it is another lottery game. When you are not current, you know there are a lot of people going thru the same thing, and you hope that one day dates would be current and that things would be fine. Unfortunately I dont feel that way now. And strangely, it feels kinda lonely here in CurrentLand!

My PD is 12Jan2005, EB2-I , NSC. I have already talked to two IOs using POJ method. The first one (was very nice) told me that my case was in transit to an IO officer (she said that it was an intra-office transit) and that I should give it 4 days. I called back one week later (on 10/8/2009) and this time did not get as nice a lady - she said that may case was waiting to be assigned to an officer and that I should wait 90 days. I dont know which one to believe or if I can believe both.:confused:
A few questions:
1) Should we contact senators or congressmen, or both? What is the recommended method to contact them - through phone or through snail mail?
2) I understand that there are still many people before my PD that are waiting for their GC and I wish them the best. Should I give myself more time (say till the last week of the month for others before me to get approved) before I try the various approaches that Kewlchap and others have suggested? Or do you recommend trying all the approaches one by one right away?
3) For form 7001, do you think it should be treated as the last resort, or will I be able to save some time by starting with this? Is there any advantage if the attorney submits this for me?

Got the email about being registered as a new permanent resident on Oct 8th. Thanks to SoP, caliguy, fatjoe and all others on the forum who helped / gave me support. I essentially learned that USCIS will not move quickly on their own, they need to be pursued just like any other govt. office in India. I give my time line below for an idea of what I did. If anyone is waiting still, I sincerely think that you should do all of POJ/SR/Infopass/Senator/Ombudsman.
Timeline:
Sept 1st - became current
Sept 5th - contacted NSC several times through POJ. Finally, a very nice lady told me that my case was not even assigned to an officer. Said that she will send in a request to the contractor to pull my case out and get it assigned to an officer.
Sept 11th - Case pulled out of storage area and moved to a smaller waiting room [got this info later, but this is what had happened]
Sept 13th: Opened SR.
Sept 18th - Infopass: Told me that my case was assigned to an officer on Sept 11th (which was wrong really) and that I should wait 30 days. Also told me that my FP were renewed on March 9th and all my checks were clear.
Sept 20th: Contacted Senator's office. Said they will send in inquiry.
Sept 25: Response to SR. Case under review. Wait 30 days.
Sept 27th: Letter from Senator saying my case was under review and I need to wait 30 days.
Oct 2nd: Contacted NSC again through POJ method. A nice lady, Terry, told me that my case was assigned to officer on Sept 30th. She said, "your case was pulled out of storage and put in a rather large holding area where it was till Sept 30th." Also confirmed that my FP was renewed and other checks were clear. Said, just wait, it will happen soon.
Oct 6th: Sent 7001 form to USCIS Ombudsman.
Oct 8th: Got decision email.
Learnings: Pursue your case as much as you can. Call NSC, but be polite. They are usually in good mood on Thu/Friday evenings and if you make some small talk, they will help you. I kept records of which NSC IO is rude and if they picked up the next time, I would just keep the phone down. In fact, the lady who helped me remembered me 'coz I managed to reach her 3 times. Dont just ask for status, say that you have called in the past and so far you know xxxx about your case. Some IOs are nice, some are rude. Nice ones actually tried to explain the entire storage area, holding area, supervisor supply chain to me. I think I kind of understand the process that happens at NSC just through these conversations now. Approach Ombudsman asap with form 7001. Call your Senator office and ask to speak to the immigration person. They are very understanding and will help you.

After 5 years of waiting, my Labor got finally aproved thru Dallas BEC(EB3, RIR, PD: Oct'02). But my wife is in India on vacation and as per original plan will return middle of August.
1. What are my options so I can take advantage of the PD being current for me?
2. can I apply for I-140 and I-485 and then apply her I-485 when she returns?

As per my knowledge, ask your wife to come back from India and file I-485 along with your petition by before Jun 30, 2007.
If you want to wait till she comes back from India you can, but at that time (in Aug ) Cutt-off dates should be current to your PD date, If not you CANNOT file I-485 to your wife.

What they did on Wall Street was short selling of stocks. This is nothing to do with real estate. Short selling of real estate is a way for Lenders to get the marlet value of the property instead of foreclosing it for no value at all. This is something which is approved by the lenders based on the market. Nothing illegal in it.

I'm wondering if these figures actually provide ammo for people who claim that H1b is driving down salary. A $50k median starting and a $60k median is not that great.
It's not too far off the mark. The median for initial employment is likely skewed by all the college hires and new arrivals. The $50k median is not too far off the mark from the $53,000 median reported by UIUC for 2005. The median for continuing employment is quite respectable at $68,000.

Yes this has the potential to affect everyone - look at today's main news - 240k more jobs are lost and prediction that economy can get much more worse. The last thing we want in these times is another GC/visa related issue at back of our minds. This is the time to act before its too late.

Yes, it is that simple. If you just walk away from your home, bank can only touch your home and credit history. They can not go after your automobile\gold\savings\other property....anything. You are not missing anything. That is why we are seeing so many people around us just walking away from their homes. Thank God I rent but if my property's value go down 200 k in 2 years, heck I would walk away with a smile on my face. No strings attached.
Walking away would have been difficuly had you put 20% down, i.e. involving your hard earned money in the deal. In that case you would have waited to see the market and hoped that it would revive. If put 0% down and bank has given you 100% loan, then it is the bank who has taken all the risk. You have practially no risk in that deal. Just like cloth....return it to the bank. Hey....you don't have to even clean it up...like you do in the case of apartment move. ;-)

I know that is ACT. But USCIS can interpret the provisions and make adjustments like what we are requesting. Similarly it can , IF THEY WANT TO, include a provision saying the job not only need to be in similar field, but it shall be in the same labor market because that is where you got your labor. I am not saying this is going to happen just because IVs effort.
If the intent of the similar job requirement is not to hurt the local talent because that is that job that is advertised for, the restriction of the same labor market will serve the same purpose.
That is a legitimate doubt and concern for some.
Chandu, I have great respect for your enthusiasm , but why do you have to be so hostile to a person that does not seem to think the way you are thinking. Different people react differently for the same news. I am not sure your rant has any back ground with any other post by the people you are pissed off about ;)
And the above answers concerns some may have and shuts them up. Shouting at them definitely will not help any body's cause. What has getting a GC to do with how you raise your children ?
Since when this immigration is a BIG issue in USA...... remember the BIG Rally ?? Some of the efforts with positive intentions may have a negative consequences in the short term or a long term.
The reason I post those strong words is because negative posters seem to influence people's decisions a lot. An example is , right during the rally time, I had negative people calling my wife and frightening her about the rally. She was always confused, and did not understand if she wants to support me for my efforts on mobilization or listen to them. It took a while for us to overcome her confusion. Negative posts and negative influence impact and hinder our efforts a lot. We do not need anti immigrants to cause damage, these negative posters do more damage than anti immigrants. One negaitve post can influence many people, as such it is very difficult to draw people for a good cause these days, people just do not want to cooperate or just are not motivated, negative posters demotivate the fence sitters.
If people are positive and cooperative they influence positively, they set an example for others to follow and that is what all the positive folks do, no matter what the negative influencers say or do, positive people always remain positive and try to guide people through examples.
"needhelp" is a good example of positive motivation - she does everything she can to set an example - if people learn from her - that is what we want

Do they specifically mention only these VFS ? I have my interview in Mumbai but then will proceed to North East on vacation. If it is any VFS, Calcutta is much convenient (and economic) for me. Also do they have an option to submit the passport to consulate directly?

Based on just released information, it appears that India EB2 cutoff dates will advance, perhaps substantially, in May. China EB2 cutoff dates will also advance. The American Immigration Lawyers Association (AILA) reports that they were told the following by Charlie Oppenheim, Chief, Immigrant Visa Control and Reporting Division, U.S. Department of State:
“[US]CIS says they have seen a decline in filings, and does not expect a change in the number use pattern. Therefore, this decline in EB-1 number use will allow me to begin having those ‘otherwise unused’ numbers drop down and be available for use in the EB-2 category. Based on current indications, that would mean that at least 12,000 additional numbers will be available to the EB-2 category. This situation will allow me to advance the India EB-2 cut-off date for May. The reason being that all ‘otherwise unused’ numbers are provided strictly in priority date order, and the India demand has the largest concentration of early dates.”
There have been two reasons for China and India EB2 cutoff dates not moving forward as rapidly as had been the case in the past. The first is the unusually high demand for EB1 numbers and the second has been the increased demand for EB2 numbers represented by EB3 to EB2 upgrades.
The significance of this announcement is that it appears that the recent surge in demand for EB1 visa numbers has abated. The CIS reports that this demand slowed down in October, 2010 and has not resumed. Presumably, this means that substantially most the EB2 applicants who felt that they could upgrade to EB1 have now filed the petitions and had them adjudicated. If this is the case, then the number of unused EB1 numbers will increase back to previous levels and become available for use by EB2 applicants.

I see that you guys didnt join IV until 2008. So, you know very less about this org. The people who only can think for their own wont come to join you at any stage, it was proven many times. They will just keep writing messages here and use valuable information on the forum.
I am EB2/Masters/PD Nov 2004. I do not not support your idea. I loose patience at times, but not to the extent of effecting other peoples chances. I know quite a few of my freinds who had masters, their corporate employers applied in EB3, none of them are trying to do conversion. But, i feel their pain.

Another answer from Rajiv Khanna: on multiple 485s
I recommend both husband wife file for yourselves and for each other. So between the two , there will be four 485 applications. One: Wife as primary, husband as derivative. Second, husband as primary and wife as derivative. We do this all the time and this is the safest thing to do. You will keep whichever 485 set gets approved, first, the other will be rejected by CIS.
and you need to fillup the same A# which are assigned with first set if you are filing second set 485's at later date
