It is not good disparaging the countries needing TV by calling them idiotic and asking for boycott etc. Please know that you are living in a country (USA) which is far worse than those "idiotic" countries in this respect since 2003. US needs C1 visa for transiting through its airports even when you have a valid VISA stamp in your passport to a destination country and you need to fill eqaully gruelling application (DS 156). Also you need to carry documents for travel purposes and financial support.

We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.
Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.
I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.
I am seeing some positives in the bill. Wages will increase for the H1bs also. Only genuine companies can do the business. Best and bright people will not be impacted by this. Also it can open opportunity to increase H1b Cap and Green card Cap. So there is a good possiblity to reduce or eliminate retrogession.
Basically there are two options for IV and other pro immigrants if the bill is considered serously. One is just oppose the bill and try to block completely. Or other option is to negotiate to include our agenda to recapture/increase GC and also to modify the portions of bill. Instead of failing with option 1 getting success in option 2 is better.
I think this bill will not be passed if it is against WTO trade regulations.
So you never know all these violation when you were in H1. What were you doing then. Why didnt you oppose then. If you know the violation did you call the USCIS and DOL and complain...No. Because you would end up in trouble. Now you got your GC and no matter if other guys are end up in trouble, in fact it would be helpful for you... Are you ready to review your status thorught all your H1, all your PREM processing to prove there is no violation...? Eveyone know how things are working. So if you got your GC just keep quite and move on. When you can not be helpful to others...why you are just creating pain.
If you are worrying about the wages..let them free the employees from employer. Thats the best way to clean up the system. If you are really pro-immigrant your thoughts should align in that direction. But most of us see you as Ron Diamond in the making. Its very unfortunate. One study shows that only immigrants opposing immigration more than natvie people.

Let it be 5000 min/pm. Still, 5000 min/month give about 2.7 hours per day. Talking 2.7 hours to India per 24 hours is unusual for many. I don't even get 30 minutes to talk. Even if we want to talk 2.7 hours you will be distrbing people in India, as they may be watching cricket or Tv serials.:)
Any way, this pan is simply superb compare to the situation before 10 years. Compare to many phone providers/cable compaines, vonage customer service is simply great, at least in my experience.
Ok...the way I see this is 5000min/month at $25 (not adding taxes) is 5 cents a minutes...that is more than what I pay for my calling cards....bottom line....if your monthly calling bill is less than $ 25 there is no reason why you should get Vonage.

Can POJ be only be used for cases that were seperated? Last time, I used the POJ method, the IO told me to talk to the CSR and he refused to give me the status of my case.

VLDRAO does a good job of predicting but...I dont think EB2 I will be current in a year, try to understand, the visas might be there but the USCIS simply does not have the capacity to adjudicate so many cases. There will be a flurry of approvals in September when they reassign people from other departments to consume as much as they can of the existing quota, but the fact of the matter is that visas will still be wasted.
It is naive to assume that EB2 will be current and all problems will be solved. think practically.
As for EB3 if all the spillover is going to EB2 then ROW EB3 as a whole is getting increasingly backlocked which implies that there is less available for spillover for EB3 I/C. Watch out for more EB3 countries getting retrogressed in early 2009.

So, I guess it all boils down to what is the legal status of somebody who has 485 pending, EAD, and AP? At that point you are no longer on H-1B. Is this status covered in the definition of a "U.S. worker"? ... Anybody?
As per Ron Gotcher, "Anyone with I-140 portability and an EAD is a "US worker" as that term is defined by the Department of Labor.".

anyway, I understand the lawyers need to be paid! I just want them to stop changing the rules in the middle of the game. Its been a long frigging wait and now this.
My hope is that there was some misunderstanding and that they will just quietly remake the offer and give me the job back.
At will employment does not mean you can discriminate. Its akin to firing someone if they get pregnant or me leaving because I did not like the skin color of my boss. Both are discriminatory if they can be proven. In this case it can be.

This is the Chuck Hagel Bill that was put forth 10/25. No further action has been taken since.

There are several Comprehensive Immigration Reform bills pending in the Senate. The Senate is expected to return to the Hill next month and the specific agenda for the debate of these conflicting bills have yet to be announced by Sen. Bill Frist. These bills are expected to bring a reform in the employment-based immigration increasing the employment-based immigrant visa numbers substantially. I have a question regarding the I-693 Medical exam. it was mentioned that you will need to take a vaccine for MMR, Varicella, Tetanus and Hapatitis B. it was also mentioned that they will do a tb test and a blood test for HIV and syphilis. are these all the vaccinations and blood tests required or are there aother blood test required in addition to these??

All you said is correct, except for you don't need Hepatitis B if you are over 16. No, there are no more tests involved, unless your tb is positive. If you tb is positive you need to do chestX-ray. I know that because I was just doing the tests for myself. Varicella must be taken twice 30 days apart. Same applies to MMR.
I hope this helps. If you go to a good doctor, he will give you a complete list of things that you need to do before coming on the medical exam.

Let me add my 2cents here.
This came up when I was discussing this topic with my lawyer friend -
Person can still file for GC when he/she is at school in eb3 and after finishing school, he/she can file another one for EB2 and can port the date to earlier PD, just like eb3 person who started work instead of going to school. Remember, GC is for the future job and person can not claim that he/she needs to be employed in order for GC to be filed.
Law does provide equal opportunity to both for PD recapture (aka PD porting).
Disclaimer: I am green card holder for 6 years and personally this issue does not affect me.

One idea is to give GC to AOS applicants regardless of namecheck result, if all
other security checks are OK and let the namecheck run in background . If the namecheck turns out critical , cancel the GC & deport the applicant.
But USCIS and lawyers will loose big time , because of reduced demand for APs,EADs etc.
This is exactly as Congress intended it to be. There is no mandatory requirement to complete NC before GC can be issued in the INA. There is a provision to cancel GC in the INA.

Aug 16, 9:30 am - Called the customer service for primary's status - got the standard response that they sent a mail (which i didn't get) asking me to wait for 60 days.
Aug 16, 10:15 am - Wife called me to inform the good news, the online status change.
Aug 16, 10:18 am - got the text message (which just said "check your status online").
Aug 16: Got the CPO mail (time stamped 10:18am)
Guys (and Gals), Hang in there and you will have your independence soon.

Delays in Visa Issuance Resulting from the Department of State�s New Directive on Nonimmigrant Visa Issuance
The U.S. Department of State (DOS) instructed consular posts that approvals of H, L, O, P and Q visa petitions must be verified through the Petition Information Management Service (PIMS) before a nonimmigrant visa can be issued. PIMS is an electronic report generated by DOS�s Kentucky Consular Center that collects nonimmigrant visa petition approval information from USCIS. PIMS contains data on initial petition approvals and on L blanket petitions that were approved in 2004 or later. PIMS does not contain information on approvals of extension of stay or changes of status petitions.
Consular officers adjudicating visa applications must consult PIMS to verify the approval of the underlying nonimmigrant visa petition. If the petition approval cannot be verified through PIMS, the officer must contact the Kentucky Consular Center, which in turn attempts to verify the approval through USCIS�s Computer Linked Applications Information Management System (CLAIMS).
DOS officials state that PIMS verification typically takes no more than 24 hours and that verification through CLAIMS typically takes two business days.
