A Republican senator is coming to New York to rally support for an immigration reform plan that is winning many fans in immigrant circles. He'll likely arrive before New York's Democratic senators even take a public stance on the divisive issue.
Senator McCain, a Republican of Arizona who will likely run for president in 2008, will headline a town hall meeting and rally for immigration reform expected to attract 1,000 people to Lower Manhattan on February 27. The evening will be an opportunity for him to push the bipartisan bill he is sponsoring with Senator Kennedy, a Democrat of Massachusetts.

The town we are in only has a community college only, my spouse is an engineer and they have nothing to offer... Small town restricts her chances to be hired on H1 too.

my wife has filed for her I-485 (AOS) with me.
She has an H1 whch expires in 2012.
she used her AP while entering US this year at port of entry. Office gave I-94 for one year(it expires in Jan 2011).
Now my question is does she has to do anything to renew her I-94?
If she doesnt renew her H-1 now will she be still in-status on H1?
does she have to renew her AP in order to stay in status?
This area of the law is very confusing and it would be great if some attorney or expert give their valuable suggestions on this.

you can enter the country even a day before your visa expires, but the main thing here is the i-94 stamp where the immigration officer puts the duration of your stay...it will be till your visa expiry date. so it is better for you to have an approval for the extension so that you can get to stay till the expiry of your visa. do premium processing or something, you still have time...

There are easily 100000 of us here in the line. If we are all given GC's would it work in the national interest?
Specifically, there are three tests for national interest. Refer to this link for a more comprehensive explanation:

1: Work of "Substantive Intrinsic merit": Basically any work is bound to have some merit, and can probably be quantified to prove that it is potentially worth billions
2: National in scope: Any work done that can be replicated all over the country and benefit a lot of people, or applied everywhere
3: Applicant should be more productive than his colleagues
Collectively, do we meet these criteria? Point by point:
1. Gather details of each and every one's project, past and present, and state the intrinsic merits
2. Include explanations on how the projects and technologies, if or when applied globally, would make a difference
3. Maybe, if you have an approved labor, this can be taken care of
And if we include all of our applications as one, and mention the economic benefits of our migrating, and submit a single application, or several as a whole, do we stand a chance of getting approved for a GC based on National Interest Waiver?

I'm sorry to hear about your mom's situation.
Obtaining the green card doesn't mean your mom has to come here immediately. She can attend the interview and choose to come at a later point. I'm not too familiar with the appointment process/wait times etc but it seems like a lot of hassle to have to reapply.
Is postponement of the interview a choice?
I dont know how long ago you obtained your green card or citizenship but these days it's a loooooooooooooooooooooong wait for the elusive GC. So grab your chance when it comes.
That was my two cents.

Since you are in H1B the employer would book your ticket to US and secondly, if in any case if you have to go back the employer would give you a return ticket back. That's what most of the employers do.
After reaching US, be active in IV forums as well as join the state chapter.

Seeing the enthusiasm of all the people on this message board, I would like to request IV Core to co-ordinate rallies in various cities by doing the following:
1. Facilitate a common date for all rallies through consensus
2. Facilitate the development of a common theme through consensus
3. Facilitate an official statement on our position on "employers that abuse the immigration system"
I propose that the San Jose rally organizers should act as advisors to other local chapters since they did a wonderful job organizing the rally.

I just came across the News about Donations by Indian Legal Immigrant to the US hospital. Link is given below

I am sure there are several other legal immigrants donations to the US hospitals, Colleges and Universities etc.
I am sure that if we can link those all in one thread and later on can be compiled by IV to make strong point that Legal immigrant apart from generating lots of jobs and economical growth for US also contribute generously to various progressive causes, by the wealth that they make because of their creative mind and skills.
On other hand there is a debate about undocumented workers relying on the US tax payers resources.

Hello Attorney,
Is my perm valid if I am out the US without H1 B status? OR
Can I get H1B extension if my perm & I 140 get approved when I am out of the US without H1B status?
Here is my situation:
-My I140/I485 got denied -- in Aug 2009
-I got 9th H1B extension which is valid till Apr 2010
(As I know after Apr 2010 that I am not eligible to get extensions)
-My present company started filing PERM in Dec 2009 (No chances of getting PERM & I 140 approvals before Apr 2010)
-My company planning to send me out of the US (probably India/Japan) in Apr 2010 to work from there because of my H1B expiration. They want to continue my PERM and I 140 process.
My question to the attorneys:
If my PERM get approved after 6 or 8 months I am eligible for H1B extension even though I am out of the country without H1 B status?
Or
Do I need to wait 1 year to get the new H1B for 3+3 years?
I really appreciate your suggestions.

Hello,
I am going to Chennai for my visa stamping and the consulate website says that I need to present the " complete I-129 petition submitted by your prospective employer including the Labor Condition Application " during the interview. Can any one tell me if the photocopy of those documents will do or do I really need to carry the originals (which I don't have)?

Just carry copies; they rarely if ever ask for those any way.

Yes but I was thinking, spouse and children are counted in family based visas and how exempting them will benefit EB visas. Correct me if I'm wrong. :confused:

My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.
