I am planning to take up a EB3 labor substitution case, and I have a few questions.
With the I140 premium processing being eliminated from today, and the current I140 processing time taking 9 months my question to you all is:
a. Suppose I apply for my I140, I485, AP today (say May 18th 2007), will I be eligible to get an EAD in the next 90 days, though my I140 could still be pending.
b. Will the time for AC21 portability start from the day I applied for I485 or from the day the I140 will get approved.
c. Suppose me and spouse get the EAD (despite I140 pending), and spouse converts from H4 to EAD while I stay on H1-B, what happens to the spouse status in case the I140 gets denied.
d. What is the possibility of the EB2 VISA dates moving further.
Appreciate your help in understanding the system correctly.

I am only seeing only 100% illegal discrimination in these scenarios. Pretty soon, they will stop hiring US citizes of Indian (or Chines or Japanese or Italians ..) origin.
This is plain stupidity. These employers should first take a good look at an EAD and a GC. As for as work authorization is concerned, both these cards provide us with the same rights. The EAD says �The person identified is authorized to work in the US for the validity of this card� where as the GC says �The person identified by the card is authorized to work and remain in the US�.
So why does the legal department come into picture here? Is it because of the expiry date associated with EAD�s? If that�s the case even a GC has got an expiration date (a later date maybe). Does that mean that an additional budget is required to hire GC holders?

The Durbin-Grassley bill would, among other things:
� Prohibit the blatantly discriminatory practice of "H-1B only" ads and prohibit employers from hiring additional H-1B and L-1 guest-workers if more than 50 percent of their employees are H-1B and L-1 visa holders.

Today I called USCIS and finally got my wife's and mine I-485 receipt numbers. My attorney has not received anything. I am looking forward to seeing some action for others pretty soon. Guys, I wish you very best luck!!

Guys, i have been trying to find some information on this but i can't seem to find any thing relevant.
I have been in the US since 2001. I came in on a F1 and then moved to a H1 and then my employer filed for my greencard and i now have an EAD and AP that is employment based. My last entry into the US was based on my AP.
I recently got married and my wife is a US citizen. I was wondering if it makes sense to apply for a family based AOS concurrently since the employment based AOS takes a long time to be processed. If this possible? and if so how do i go about doing this?
My apologies if this topic has already been covered, i tried searching the forums but could not find any similar topics.
Appreciate the help.

I got fired last April. I had my I-140 approved. Employer HR told me will not withdraw I-140 but cannot give me employer letter. How should I proceed with filing I-485? Please help.

I tend to agree with both.
You need strong arguments and they need to have legal basis. Laws cannot be changed by an agency that only follows laws.
If you are eligible for EB2 and cannot file in Eb2 and your employer filed in Eb3, it is not a strong argument. Likewise you cannot change the spillover rule without strong legal justification. You need change of law.
Visa recapture is the best option.

I agree 100%. Visa Recapture from earlier years can provide relief to many applicants (across categories). This year, being an election year, does not look very promising for any new law for Visa Recapture. Hopefully, in 2009, this has much better chance.

Where is your case at? Is it TSC or NSC? If it's TSC, please send me a private message and I will give you the name of the IO. You really need to talk to this IO, and I think you will get the exact info you need.
As one of the posters mentioned earlier, your case with the IO could mean:
1) It's either in the holding area
2) Or with the officer on their desk
You want to somehow get your case to 2 - on the officers desk. If its sitting in the holding area, you can ask the IO (if they are willing to help) to send a polite reminder to the IO who your file has been assigned to letting them know that your case is current and needs to be looked at.
Another thing the IO mentioed to me was that the case could sit in the holding area for long if the IO that the case has been assigned to is on vacation (or out sick). I'm hoping that's not the case with your application

b) Eb2 Non Row
c) Eb3 Non Row
d) None of the above
Now second part of the question is :
If that category already has enough people in line, will the spillover to the next category will take place:
a) Yes
b) No
