I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

The H-3 trainee visa is a non-immigrant visa option for foreign nationals seeking training in any field of endeavor, including, but not limited to, commerce, communications, finance, government, transportation, agriculture, or the professions (except physicians).
Specifically, the H-3 is utilized by a foreign national seeking to pursue a career outside the United States, and training in the U.S. is necessary because the foreign national's home country does not have the type of training program available. In G-325, there is one column for "Applicant's residence last five years".
For me, I have not submitted my current address by filing AR-11 form. This G-325 is asking my present address plus last addresses. So what should I do? Do I need to send them AR-11 form too?
You are thinking too much. Just give them past addresses. Do not make it complicate. They are just asking for record purposes. They may verify with credit bureaus if they want to investigate further.

I was wondering if anyone has any info on the job
market for international students in NY. I will be graduating
in Dec and will be on the job market soon.
Some of my friends say that there are jobs to be had but
not many are keen on sponsoring H1, even non-tarp firms.
Can anyone confirm/refute this?
I heard the same from students in MIT, Harvard as well. I graduated in the 2002 tech downturn, so I know it first hand. Companies pretty much have a ban on hiring H1B.
From the American companies' standpoint H1B has so much headache, most H1B talent is not worth the hassle unless its a critical human resource.

Yesterday my h1b was approved ( cap h1b)
I got an offer from another company , ready to file my h1b ( non -cap) asap.
My question-If i apply for h1b transfer to non-cap without working for cap company in 7-10 days and later If I want to join a cap company,will I have to go through the lottery again -basically will i be subject to cap.
2.what is the proper process for transfer to occur.
3. I do not want to inform cap company.I have the receipt number.Is it sufficient to apply for transfer.

I have some issues with my 140.. I have doubt it might get denied... so if my my husband (H4) starts working now on EAD, he will loose his h4 status... and later if 140 is denied , he will be out of status , he has to go back to india and get h4 stamped... I don't want to go through all this hassel..so just matter of couple of months.. will wait for 140 decision...and if it gets approved he will use EAD to work.

Can spouse leave to home country after filing concurrent i140 and 485 application?
Her and mine application (concurrent 140 and 485) was filed on July 2nd, 2007but I have not received RECEIPT # yet. Can my spouse leave USA or we have to have get Receipt # first ?

Need some help, I was in US working for a consulting company and a good client for 4 years then due to some family issues I had to return back to India in the beginning of last year �08. I and my wife has visa stamped in passport valid till the end of this year. Now I want to come back to US and I am not sure if I can enter US again with the same visa as I do not have paystub from my employer for last 1.5 years.
During this 1.5 years I started my own business and tried various options but didn�t work out well so want to return back to US and during this time we had a son who doesn�t have a visa. Does any body know how I can return back to US, are they really strict at port of entry and would not let me in without a project. I don�t have a project right now and will look for it once I am in US. Any input would be very helpful.

For stamping you should not need pay stubs to prove your staus. Uninterrupted pay stubs are very important for change of status when you are applying while in US. When you leave US you dont have a status, the visa officer should not base his decision on the continuity of pay stubs. I went through a very similar situation, my change of satus was denied even though I was on genuine unpaid leave. However I ended up leaving the country and getting H1B stamped in India with no problems.

i got my i140 approved ,i-485 applied >180 days with my old employer.i have my h1b till 2010.Now i got an offer from a new company who is willing to do my h1b transfer and they said no need for doing labour,i140 again.
i am confused. is that safe if i do h1b transfer and keeping old employer's i140.(they won't revoke).Are its better to use ead to avoid confusion in GC process.pls show me the light.

The old I-140 is all valid. The only thing that you are taking is the date. When your new I-140 is approved and you interfile with I-485 then you request USCIS to take the new I-140 instead of the old one. Also if your new I-140 has problem at that stage (even after approval, some time it happens), still the old I-140 is valid.

Yep. Fill flash would have helped . It would have brought more color in the beak and taken care of the shadowey front as well as bringing out more of the texture.
