Looks like the long awaited spending bill is finally in the making and should make its way to the congress soon. For those of you who haven't contributed to IV, this should come as a warning that if you don't contribute now, it may just be too late for us to seek any relief in these bills.
Once this opportunity has passed, we'll be stuck with CIR which everyone knows is a tough pill to swallow for either party in the congress and could drag on for months and may never see the light of the day. So here are the choices:
1. Contribute now and try to get some relief from these spending bills.
2. Contribute later and try to get something done with CIR/SKIL.
3. Never contribute and just watch core members pull their hair trying to figure out why people are not contributing and just hope that GC will fall from sky.
Whatever you chose to do, please think twice before you make up your mind.

Hi ,
I have applied 485 in July 2, 2007. Note that my PD Jan 2001 - EB3 (priority dated ported) And I140 is already approved. I have done FP in Oct 2007. Received EAD and AP way back.But I saw LUD on my 485 application on Dec 14, 2007.
Does this mean any thing. Message content is not changed though.

In 2004, a friend moved within the same Multinational company (A) from one business (A1) to another (A2). The HR department did not apply for an H1 transfer assuming that one was not needed, and the friend worked for a few months before the business A2 was sold off, and the new company realized the mistake, and filed for her H1 transfer, which was approved. The new company then filed for her labor and got her I-140 approved.
Can the friend now file for AOS? Was the period that she worked for A2 'unauthorized'? Does that preclude her from adjusting her status now?
I am guessing that a lot of employers/people might have made similar mistakes through no faults of their own. Whats the solution here?

I thought it was E-verify and our bill with some sunset bills. Now he excluded those things and added last item which Republicans never supports. So he is making this as suicide bill . This is all about politics. See how they turned back in last minutes. Now they created a image of Immi friendly but eventually they didn't fight for us. Bob was Anti in beginning and he introduce recapture so get our support now after becoming popular among us and our friends , relatives he is officially not stopping bill but killing it.

graduated with a MS in Computer science in may2007.
i applied to another university and got my sevis transferred to do my MBA there.
i have done 11 months 20 days of full time CPT at the previous university(where i did my MS).
am i eligible for another full time CPT at my new university where i have started my MBA (from jan 21st 2008)?
the international students service at my previous university is saying "i am eligible for 12months of full time CPT for every educational level, and i cannot get another 12 months if i do MBA because it is a masters degree too".
please suggest.

I just read somewhere...that if I do not file by I140 by July 31 the i lose chance to file I485 by august 17..which i could file anyway together if I have to file it by July31..Is this true..
the reason being that I am waiting for the hard copy of Labor Approval and the only thing I have is Cover letter copy..I do not want to miss chance

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

Is this for H4 renewal or first time H4. If its for renewal she can go to any US consulate in India. However, if it is first time she has to go the consulate that falls in her zone i.e her place of residence. Confirm it with VFS.

If she is currently on F-1 and if she wants to maintain F-1 when she comes back she will need to go to the embassy and get her F-1 visa. If she enters U.S on old unexpired H4-Visa her F-1 visa becomes invalidated and she won't qualify for OPT/CPT etc.

We know we have our largest membership in CA. Well over a hundred members. Yet there are only about 10 active members. And yes, these 10 are extraordinarily dynamic, but we need more. In particular we need more members in SoCal.
Those of you who have already signed up as volunteers -- please attend the weekly call this Thursday at 9pm PST. Once you are on the call, please speak up, take the initiative and work on something.
Respond to the weekly emails.
- Convince at least one more person to become a member
- Convince at least one more person to contribute
- Post our flyers in your neighborhood or workplace
- Come up with other ways to get the word out
- Join a lawmaker team
- Start a lawmaker team and make an appointment
IV cannot run without your help and fervour.

Hi All..
I am on H1 since Oct 07. I haven't left USA so far and so I haven't gone for stamping. However, I heard that I need to go to stamping before completion of 1yr after getting H1. Is this true? and to what cases does this rule apply?
Please help. I am confused.

You can stay as long as you have the 797 with you, but if you leave teh country u can come back only with stamping....
