A lot of times.. companies use this bugaboo of job desc etc.. Those that want to promote you badly enough will find a way.. First of all.. What your job title is v/s what labor is filed under is not directly related.. Secondly you can have matrix responsibilities that span across 2 bands etc.. So lot of times it's an excuse to not have to let you down hard way.. always easier to blame on that "damn immigration queue"

I think gas price is a non-issue. Gas in India is more expensive than in the US and considering the income there, the effective cost is even more higher. And yet, people continue to buy more and more without regard for increasing gas prices.
The same logic applies here. Back in 2001, once gas prices starting going up and in places where gas cost $1.30, it hit $1.50 which people found "shocking". And yet, there wasn't the slightest reduction in the number of cars bought. Even now, with all the dismay at soaring prices, nothing much has changed. Freeways are just as jammed as ever.
The fact is, the American is well equipped to deal with $6 prices. The reaction we see is is just due to the unpleasant thought of having to pay more. It is not a showstopper by any stretch of anyone's imagination. At the worst, it just means they will have to cut back on annual vacations which is not a big deal for us, but obviously a catastrophe to the average American.
just for comparison sakes...do remember that the distance from churchgate to virar (in bombay) is 35 km. http://en.wikipedia.org/wiki/Mumbai_Suburban_Railway.
That is equivalent of approx 22 miles. I doubt there is anybody is bombay that drives 35 km one way on a daily basis. But in the US living 10-20 miles from work is not bad. People in my office drive about 40 miles one way without blinking an eyelid. Some drive even more. Plus the cars that they have in india have smaller engines, smaller capacity thereby better gas mileage.

I vaguely remember a discussion several months ago on the forum about people that have gone back to their home countries after having waited for their green cards.
We have a media interview opportunity and need to find such examples. I remember an instance about a person going back to Bombay after he had immigration issues. He had set up his company there. Such people who could have helped US economy and growth will make a compelling story.

Hi Guys,
I need your help on this. My cousin is running this small IT company in india and he mentioned that when US client sends their money to India via Pay Pal or some secure money transfer , they are charging them 4 % of transfer amount.
He ask me that what could be the best way to avoid this fees , some of the option that we thought about,
1) If they (cousin's company) open an bank account in USA and utilize this to transfer the money to indian bank account - Would they still need to pay US tax as money is being deposited into the US account?
2) If I utlize my bank account - I think in this scenarion I have to pay the US tax for whatever money the client is depositing into my account in order to make this legal transfer
3)If US client utilize remit2india, ICICI to transfer money which I highly doubt

Ask him to double check if his clients are using credit cards to do the transfers. Using a bank account has 0 transfer fee for domestic transfers. Not sure if the same applies to international transfers but good to double check.

IV is the only group that is trying something for EB gc's!!! If you don't agree with IV mission statement - least you can do is SHUT UP! If you have other selfish agenda's take them some place else... don't use IV as a platform to segregate a group.

One can work on current H-1B (irrespective on basis it was approved), until the H-1B petition is revoked or canceled or expired. However, beneficiary is not eligible for new/extension of H-1B after I-485 denial.
We can quote memos and statutes all day and it would go nowhere. This is simply a matter of interpretation by USCIS and how it applies to the situtation.
Best advice? Talk to more than 1 immigration lawyer.

Stay united and fight. We already have few groups like the "Surya" guy, cannot remember his correct id, who fought so that EB3 cannot ever move to EB2. Fortunately I have not seen such issue from EB3 group. There have been occasional venting out out of frustration, but nothing organized to create problems for other groups. Rules are rules and nothing is wrong if the rules are rightly followed.
If the originator of this thread is from Bangladesh, he need not worry. ROW should move faster comparatively, even in EB3.

Probably the RFE might be related to photos not being sent. A friend of mine received a RFE for not sending the photos eventhough they are not required to be sent but he did not get any Biometrics notice.
After the photos were sent, the application was approved.

Can you pelase add more details about your friends case like days he received details about RFE and time it took for approval after submitting photos?

OK so I was the original poster that spoke about my friend. Now I will give you some insight into my own case. I have been now in the US since 1991(though my PD is August 2001). Here are some details
Jan 1991 : Arrived in US as 19 yr old after completing Diploma in Engineering from India (10 plus 3).
1991- 1996: Took 5 yrs to complete 4 yrs degree as I was paying my own way. Working full time and studying full time on F1 visa.
1996 -1998 : Completed MBA. This time situation was better because I had financial aid and in state tuition.
1998-1999: Completed internship at an Investment Bank. Had to find another job because I Bank didnt want to do H1. Have been at current job since 1999.
2001: CVompany policy was to wait 2 yrs before applying for GC. So finally filed labor in 2001.
2005 : Labor finally approved from BEC. I 140 filed and approved.
June 2007 : 485 filed (as a 36 yr old)
You are here since a very long time.
If rules can be proposed in CIR for undocumented allowing them to get a greencard if they can prove they are here for minimum X number of years, similar rules can be created for legal documented immigrants (like yourself) too. Its just that the legal immigrant community is not united and does not have enough power yet to raise the voice.
