    Thanks guyz !!

    I did spoke with Sheila Murthy Lawyers on chances of maintaining GC processing and Consular processing.

    My firm is OK with my long Leave of Absence...Only thing that threw spanner in the wheel was comment from Sheila Murthy firm's advise.

    Per them, to renew AP and EAD, I need to be phsically back in states and also stay in States for the duration of approval i.e. if it takes 3 months for renewal of AP and EAD, then I need to be in States for that duration.

    I asked them what if I can apply 5months in advance, from Outside US and someone can fedex it to me. Max I can come back for few days.
    .. Per them this will not work...

    What do you guyz say ?

    There is not a word that I disagree. Your are preaching to the choir:)

    I wasn't even talking about the 55K, just the X-55k. X being the all EB immigrants-in-waiting. They will join after the advocacy day if they change their opinion, if not there's no change whatsoever.

    Hypothetically speaking, let's assume all the 55,000 members in IV are active but are not organized under one umbrella (IV). Each of them have the same problem (stuck in the backlogs) and each of them approach lawmakers. Each discusses their own personal case and each of them discuss about a solution that fits them - (human nature). Some of them may be the very same provisions as IV. But will these 55,000 people mention all the provisions? chances are - No.
    So, there will be no coherent messaging, even though there are 55,000 people participating simultaneously.

    Second, without being an organized unit, we loose the collective strength. Say a lawmaker is interested in fixing our problems - his task will be tremendous - he probably has only 10 people who have approached his office to fix the problem - so not only does he have to find out if there is a wide range of people affected by this problem, he also has to contact each of the 10 people individually. Guess what? he too will suggest for the 10 people to join forces and be under one umbrella.

    What I am trying to say is that IV has already brought us together. It has built good relations with key people in DC. It has done the ground work. Why not build on the sound foundation?

    In life we are ready to be grouped as Indians, Indian-Americans, Asians, Male, Female, Married, Unmarried, Hindu, Christian, Muslim, political organizations (we believe in one or the other - independents, democrats, republicans, congress, bjp), Unions, Employees of Cisco, IBM, Desi Consulting - what is wrong in identifying oneself in a group if you believe in it? By nature we are a collective group, but we think that it is wrong/unnecessary to belong to a group! We think we are smarter for being independent. But the truth is that even the most independent of the guys lives in a society. He may not accept it, but that does not change the facts.

    Bottom line is, what each one of us believe in. If we believe in a cause, we will find a way to work on it. Quantity matters only when there is quality. If we have to depend on only one, my preference would be on quality. I want the loudest person, but at the same time, I want that loud person to be shouting the message that I want - or else it defeats the purpose.

    Leo, this is just my opinion, not IV's - though I would think IV will agree with me. I believe in collective strength and individual's logic to think matters through.

    Hi there,

    What a rationale you are using. So then "kids should not suffer" and then the answer is yes, go ahead and reward those who broke laws with an amnesty. That would make their 19 old kids very soon able to apply for I-485 to bring in their parents as well. The USCIS does not have enough cases left from the 245(i) amnesty to be processed ahead of the legal folks, right? Pump up few more MILLION Dream Act amnesty cases there and let us know how you do. What a slap on the face of those who played by the rules? Moreover, are you going to apply your kindness to the 1 billion of people who want to come here? I agree children should not suffer. How about a feasible solution? Here it is :So why don't you write to the Congress of respective countries these kids came from and make them repatriate their folks and provide government employment and a reintegration program back home for those kids? Yes, that is technically doable. That would solve the situation of their children and more importantly, it would be a clear message that parents should not expose their children to this situation.

    Think about the absurdity of this Dream Act and your line of thought;it just encourages more parents to come here illegally and bring their children here "to suffer", making us, the legal folks and citizens of this country pay for it unfairly. No, thank you! I came here on H1B and my children is not eligible for in-state tuition. If we start playing this game that people who jumped the fence and now can take advantage of it because they were "smart, so it would be time to rename this country name from USA to Mexico. Believe me, I don't think that is going to happen without a good fight though. Trust me.

    Bill Gates did a good job today in his speech. What is fair is fair. Now trying to come up with this Dream Act thing and again we the legal folks would be pushed to the back of the line. You guys don't get it. Every time something goes around, it comes to hurt whoever plays by the rules. Coming from India and other *#&#$ places and being educated and after observing what that freaking 245(i) and other amnesties have done to us, I am surprised you still do not get it. Yes, count on me to write to the US Congress. I will write to denounce this absurd Dream Act and ask them to adopt a fair immigration system to the legal employment base greencard applicants. For the children, I will urge them to adopt the proposed and feasible solution of charging the government of the respective countries to reintegrate and support their own children. Win-Win situation for everyone.

    If you have a perception that I am pissed off, you are a winner.

    Let us get opinion of others on this. Should we write to law-makers to address this issue. Atleast these kids should not suffer. If they have got their most of the education here in US, they should be be given permnent residence before they go to college.

    Truth always hurts. It is not too much talking when I say that people can't afford to contribute 20 bucks to IV. Out of roughly 9000 members, only 200 contributed in the last contribution drive and now you should be able to do the math yourself. That is the fact and it's very troubling that 98% of the members chose to contribute nothing.

    If you expect 200 people to find relief for 1 million so called high skilled immigrants present in United States, may be you need to wake up and do some reality check. Just checking IV 50 times a day for an update will not bring any relief, if that's what you are counting on. No wonder we are yet to see any relief whatsoever.

    First off - I have contributed, but here is an explanation of my initial reluctance to do so and possibly why I haven't contributed more than I have, since you asked.

    I have often been offended by the tone and bias on this board, when it is plainly evident that the majority of power posters think their own situation as being the only thing that should be resolved, alienating others as a result.

    Don't tell me to donate by spending less money on stuff that culturally I never do, or refer to people that I know little about - all for cultural reasons. It was this thread that spurred me to contribute, and ironically, this thread that also offended me first. I still haven't forgotten that.

    Wonder how else you alienate people? Try posting in a language that isn't English.

    Regarding the recent pledge drive in particular, it gives me a nasty taste in my mouth since it stings of hypocrisy that I can't get over. A similar one was attempted by a member here (which I signed up for), using the ""I will donate $10 monthly to Immigration Voice for one year but only if 1,000 other people will do the same."

    That effort, although endorsed by the core group, got 88 people to vote, and was criticized in these very forums as being a waste of time, or not the proper way to do it. Of course, fast forward a few months and now look...

    I also find it distasteful to have to read through threads that could be of some importance or value, but find that good chunks are just "Hey, look at me, look at how much I contributed"

    So, since I'm all bitter and alienated , why did I actually contribute?
    Every time I get annoyed or offended by someone's insensitive or cultural narrow mindedness, I try to ignore it and remind myself that that single person does not represent the values of the core group and this organization as a whole. It gets challenging.

    Some states have the provision that instate tuition rates will only apply to permanent residents while others allow H1-B's to avail of instate tuition. I know for sure that Pennsylvania is in the permanent resident camp while Colorado allows instate to H1-B's. As mentioned previously it is the state legislature along with the commision on higher education which create the rules.

    It would be interesting to compile a list of all 50 states to see where each state stands. To do that though it would help if folks residing in different states chime in. Otherwise it would be too difficult to sift through the higher education commission websites for each individual state.

    As far as I know, starting a PERM application in itself does not amount to an intent to immigrate - it is simply a labor market test for a future position.Remember, the employer can port the LC to a different employee at a later date. I-140, however is an application to immigrate permanently to the US; hence a violation of the F1 visa. You may have a difficult time getting your I-485 approved or have to go in for consular processing. It is best you consult a lawyer on this one; don't count on random opinions on the forum for such a serious issue.

    The potential for misuse is too much. So I only support GC for someone with a PhD, even though I have a Masters.

    Even with that potential for misuse will be very high...you will see people doing "PhD" in bottom of the barrel university ranking places. In fact professors who give easy PhD in easy university will be in hot demand. Nowdays people try to do good PhD in good university as it helps in getting a good faculty position eventually...this will bringa whole new dimension to why people will do a PhD in US. 3 year PhD like in UK will get prevalant in US.

    If you sign the agreement, yes, it will be legally binding or as you put it "stand in court of law". Is the agreement written to only suit the purposes for the employer? Yes. Would I sign it? No.

    You need to speak to an attorney. The language which ties to this employer until a project is completed might go against the "employment at will" law - not sure what the status is in NJ.

    Once you complete a timesheet, an employer should pay you considering the timesheet is appropriate and not fraudulent. If the employer does not get paid by the client, that liability should not shift to you in terms of asking you pay back your paycheck.

    I am not a lawyer (only a liaison to the legal eagles), please seek legal advise.

    Yes, I honestly think that quantity matters in meeting politicians. What is so clear to us may not be clear to them. Not because they are lesser mortals than us, they have a different perspective. Why and How is entirely not up to me to worry about. Someone has a different view and I can only respect that view. I cannot, and do not, think that I must invest my time in brainwashing anyone. I wouldn't call it a crab mentality either without knowing them personally.

    With that said, let me be a devils-advocate, if you will, and ask these questions:

    Given ours is a issue-based, goal-based struggle, with Goal & Issue being same for ALL EB immigrants:
    --- Why should I expect all immigrants to wear any organization's badge, be dedicated to any particular/one organization, whether that Org is IV/Democrats/Republicans/Congress/BJP
    --- Shouldn't I be just worried about who can SHOUT louder about my issue and less worried about the Organization that's making them SHOUT?

    I agree, we are an organization and at this point we haven't even asked people to compulsorily donate for Advocacy. I would say, not registering on IV is being extremely narrow-minded and being a crab (benefiting IV?).
    Thousands of IV members have created an account on that site, so what is the problem?

    Thats nice pattern for EB2. It jumps almost 2 years ahead from July VB to Aug VB. Lets hope this pattern continues for 2010. Lot of EB2 folks will be happy with this pattern.

    My PD is Feb 2004, so I've been current for almost 2 months now. Though, my ND is 9/12/2007 and NSC is processing 7/14/2007, so that's not current yet...

    Receipt date and not notice date is the factor.
    Also, NSC has been processing even people with October notice dates and appoved people with current PDs.

    I do appreciate the full intentions of our admin in asking us to send faxes,

    While these discussions are going on, if we send faxes - would it draw attention to a few hundred of them ? . Certainly worth the try, without loosing anything.

    (2) - I also feel that Sending it to Cornyn, Spectre, in addition may help via faxes to remind them of our problems.

    (3) - I do understand that the admins have a plan to get some relief via backdoor as the admin posted in case legal immigratns donot get a significant relief in the present form as posted just now, do you really think this is feasible ? would not we bypass the senate ?

    Hi rc0878,

    Yes, I do have EAD and AP in hand. I got my AP papers in mail around 1 week back. I am not sure about processing times at this very moment.

    Also, received original 485 receipt notices from my Attoreny and it does say RD is July 2, 2007, which is good.

    My case has successfully reached at NSC and have not seen any LUD after that. Still waiting for FP notices so that I can consider that everything is good with my case at NSC..
