Dear Reader,
Thank you for your interest in FSB. We admit that there was a
mischaracterization of the Capitol Hill rally in the story and it was
corrected as soon we realized the error.
We have changed the story to correctly identify the mission as a protest of
the long delays in securing green cards for highly-skilled workers already
in the U.S.
We will work to avoid errors like this in the future.
Best regards,
FSB

Eilene,
Thank you for addressing skilled workers shortage in your article "Wanted :
Foreign Workers". However the rally held in Washington DC is by Legal Skilled Immigrant Workers ( not mostly legal) to address the delay in securing a Permanent Residency through employment. Majority of the workers are waiting for atleast 6-8 years in the same job on temporary visas, not availing the job progression which their education, skills and experience would otherwise offer on the permanent visa.
Appreciate your effort in drawing the attention to one of major issues a vast
majority of the American business is now facing.
Kind Regards
Gigi Mathews

I feel frustrated at some peoples' unwillingness to admit that EB3 needs IV's help now more than ever. They are saying that nothing much can be done for EB3, as INS merely corrected its wrong interpretation in visa allocation
But, if we are all willing to put our hearts and minds to it we can surely come up with new ideas that will help our cause. Surely, laws are written so that justice can happen. So if justice is not happening, the law would have some answer, somewhere.
Let me put forward my idea.
The INA language says that until EB2 is not current, there will be no spillover to EB3. Agreed. But I would contend that this statement is on a year to year basis. That is, if in the year 2002 (for example) all EB2 has been satisfied, then the spillovers should go to year 2002 EB3.
Is this something IV can point out and fight for? Can EB3 members put their money and efforts in this direction? Let me know if this sounds worthwhile
GK,
I think you do have a point. Let me do some research and contact some attorneys as well on this. Will also check with the IV leadership on their thoughts on this point.
Cheers,
Rayoflight
Did anything come of this plan? Is this doable?

I have 2 European co-workers. They both told me, "The only way we will go back to Europe is when we die".
Which European countries are they from? Their opinion can be relevant in this context if they are from a rich EU country, but less convincing if they are from Albania, for example.

I get this question every day, what are the hopes for EB3-I, or rather are there any hopes for EB3-I? Are we fighting a lost battle?
What do people here really think?
1. There are X % chance that there would be some immigration bill that would help us and we will have GC in next couple of years?
2. Keep going on with life as is, till the time we can renew EAD every 2 years, and AP every year.
3. Wait for another X years, and then go back.
4. Hopefully my son/daughter will be 21 by 2020, and will sponsor my GC.
--- Hoping family based GC would still be allowed by then
5. Don't know, confused?
6. Look for entrepreneurial options & file in EB5. You get freedom from daily-job-rat-race and visa/GC hassles.

If the Africans had just continued to abide by slavery, they would never have gotten their freedom, just because, "it's the American policy."
I hate to break my own promise to shut up on this, and I hate to be your history teacher: African slaves in US didn't become free because they fought with their owners. They became free since President Lincoln decided that slavery had gone on a bit too long.
When european immigrants walked into this continent and started hacking natives, they had firearm, they had the aggression and they had the numbers on their side. Which one of these do you (or we) have?
Let's stop debating this, since this issue isn't going to be resolved here; You either get the next president/congress to abolish this part of immigration law, or ask the courts to force the government to do what you like.

The Visa re-capture issue could be taken immediately after the FOIA issue.
But I guess it would be all up to the IV team to decide the agenda of this organization.
It would be nice to focus all our efforts and time on ONE issue only.
When we start adding other proposals (which only gives us only temporary relief), the main message gets lost invariably.
I think we could set-up a poll as below: (it would give us an idea about the support in this forums to achieve this target:)
Poll:
To ONLY Re-Capture Un-used visa numbers:
I truthfully would pledge:
i) $100 in 15 days
ii) $200 in 15 days
iii) $500 or more in 15 days.
Any one donation NOT to be less than $100 PLEASE.
I believe that the goal of Visa Re-capture is worth more than that even if you are making multiple donations.

This is what I have come up with so far. Please everyone, feel free to modify this:
Have you been following at the snails pace movement of the priority dates? If not, here are some reminders
EB3 moved 2 weeks in 10 months!
EB2 hardly moved in 10 months!
If this is the rate at which things move, you will get your Green Card in anywhere from 5 to 15 years based on your priority dates.
Do you know how this affects you?
Frustration of sticking to the same employer and no career growth.
Children not being able to get state benefits.
 Spouses unable to work.
 The feeling of unsettlement.
Above all, tons of mental stress.
Do you want be in this mess for ever. I am sure you dont. We deserve better.
We all have to fight together to fix this broken immigration system and achieve IVs goals to
 Remove retrogression
 Remove backlogs in labor certification
Remove backlogs in I-140 and I-485 processing
Revise the way visa quotas for highly skilled workers are determined

Excellent job Varsha. I would like to modify one line.
Children not being able to get scholarships, cannot work or get state tuition benefits instead of 'Children not being able to get state benefits.'

I am sure the IV core would have thought about this option of contacting USCIS and let them know the problems because of retrogression.
But I like the idea of collecting 10$ for the fax and creating awareness. Lets move.
so let find out who is dead of department of homeland Security and get addresses , phone number and fax. USCIS is branch of DHS. That`s where we need to contact them and ask them what we THEY can do for us and what are our legal options
please someone work with core team to get that fax letter ready. I can do that if core team allow me
thx.

JSB, I agree partially with your analogy on US & Japans Quality of life but that is a generalized statement. The meaning of Quality of Life is lost the day people started looking at their house as an investment.
I also agree the quality of Life comes with a price. But not everything should be looked or compared monetarily. Back when I was kid, my Dad had a choice to send me to Govt School or Private school. Private school was expensive & he did pay price by sending me to private school, cutting most of his expenses because he wanted to give good quality of life for his kids. So for everything there is a Price to pay & what price means to you is again subjective. There is a lot of difference between Quality of Life & Enjoyment. If a person can only afford Honda Civic & he wishes to buy BMW X5 then he is doing that for his own enjoyment & NOT quality of life. I call it Stupidity. Buying a house (Affordable) with calculated risks is totally different matter & I will explain why on my next topic.
Your Comment where a GC seeker gets up at 5am in a nicely furnished home, and gets to work, is entirely his choosing for happiness with material things. He knowingly chooses to sacrifice his peace of mind for more material wealth is purely your imagination except that I getup at 5:00 & go to work. I am almost done writing new topic Why Non GC Holders buy houses? & will be posting shortly. Watch out for that & may be you will find some answers.
No Joke, I agree with you on considering the risks associated with quality of life.
Saggi13, Its sad to hear your side of story. However I did have a backup plan & reserves & I will be explaining my side of story in the above new topic. Dont loose hope & you will be back in no time.

Everybody stands in one single queue......one line not five lines......one line my friend, irrespective of your nationality. so if you wait 2 years, or 2 hours..I wait the same. Unlike NOW, where some people wait 5-8 years and others 1-2 years.
I was talking about ONE line. How can you say ROW folks have an equal chance when majority are Indians, Chinese, Filipinos, and Mexicans? ROW will NOT be able to compete with MAJORITY (Indians/Chinese/Filipinos/Mexicans) put together. Keep in mind ONLY 140,000 can clear the checkout per year.
This is the exact reason why USCIS has a country quota system ensuring ROW folks do not have to compete with OVERSUBSCRIBED countries.
Your statement - "Unlike NOW, where some people wait 5-8 years and others 1-2 years" is very simple to explain. People wait longer because they usually belong to OVERSUBSCRIBED countries.
Few ways to alleviate this situation is -
1. Increase the overall quota beyond 140,000
2. Increase the quota of oversubscribed countries slightly based on demand
3. Recapture unused numbers from previous years
What WILL NOT happen? - Removal of per country quota for EB Visas!!

That is a good question. And here is a reply to that.
Why does IEEE oppose H1? Because its members do not like competition from people whose profile match IV members i.e. people on H1B. If IEEE would be in love with green card and people waiting on green card, they would not support John Miano and his testimony. IEEE-USA's memberships consist of middle aged racist engineers who cannot keep up with the competition from mostly Asian younger workers. In the 80s and 90s, they were talking about globalization and its benefits as they got a jump start to get most of the global work. Now, other people in other nations have caught up and same globalization is causing them to pee in their pants. They understand that globalization is good for the country and the society. But what is good for the nation is not always good for each and every individual. So to save their lazy ass, they now want protection from their government, without realizing that if they get the protection they are seeking, they will not be able to enjoy that protection for very long as the companies will be compelled to look for more efficient and cost effective ways to do work.
Anyways, answer to your question is in your question i.e. How could someone be against H1b and for green card?
are you aware of the fact that IEEE actually lobbied to get a special quota of H1B for US-educated folks? these folks who fill this 20K quota are foreigners and by your logic will definitely be competing against these "racist" ppl. Because of the principled stand IEEE has taken, it continues to have clout.

Total H1B from India is around 52k in 2008. But china is less than 10k in 2008. This was the trend for past 5 years. Soon china EB2 and EB3 will be within acceptable waiting time will be less than 4 years and India waiting time will be 9 to 10 years.
China EB3 moved from Oct 02 to Mar 03. In the Jan bulletin, China EB3 was at Jun 02!
India EB3 moved from Oct 01 to Nov 01. In the Jan bulletin, India EB3 was still at Oct 01!
China EB3 is certainly making some progress. Wonder why India EB3 is lagging so far behind and virtually crawling at a snail's pace.

I work at one of these companies & they applied for my GC.
1. This company only applies only after you get certain level of ranking in your year-end appraisal - disclosed during hiring process
2. You must complete x years of service.
3. Right now, economy is down & they won't apply if they feel that Labor application is going to get rejected; as it hurts their reputation & process.
I know one person in my company - whom company denied GC 'cos of Labor market but now they are starting the process of the person..(once law firm gave the green light)
So just saying - these companies don't apply - is not right.
Also, once everything is ok - you need to realize that sponsoring GC is approved by your manager as all the associated costs are allocated to his/her cost center; so company as such doesn't have issue with the cost.
Dont trust these kind of companies. if you don't get good rating in appraisal , you will be laid off .

I had a situation last year when I was flying Thai airlines to Bangkok from Phoenix. Thai airlines allows 70 LB per luggage and 2 luggage per person. However, since there is no Thai flight from Phoenix to Bangkok, I had to fly United from Phoenix to Los Angeles. Here is the problem. Since I was flying international, I thought United would allow me to take 70 LB because that's what is allowed on Thai but they didn't let me do that. They said that it was a domestic flight from Phoenix to LA and would only allow 50 LB. They asked for another 1000 dollars to check in my luggage to my final destination, Bangkok. I, of course, didn't want to pay that kind of money so they checked my bag only up to LA and I had to pay about 150 bucks for the extra 20 LB weight. I then had to claim my luggage in LA and then re-check in with Thai and I didn't have to pay any extra money aside from all the hassle of check-out and check-in again.
Is this normal procedure when you are flying international? What's the use of Thai allowing 70 LB when you can't do that with your connecting flight or is it just United trying to squeeze some of my hard earned money? What's the best way to avoid this kind of situation again aside from only taking 50 LB? Is there any clear guideline on connecting flights?
