Of course all prospective legal immigrants pay taxes which are more than $75.
Plus 100% of legal immigrants have paid, are paying and will continue to pay taxes as compared to estimates that some illegals pay and some do not.
This is a very valid and strong point and needs to be brought up ASAP.

Application vs. Use of EAD or Advance Parole:
Applying for and obtaining approval of EAD or Advance Parole does not affect the 485 applicant's "nonimmigrant status" including H and L. However, once the alien starts work using an EAD or travels on Advance Parole, the alien is considered no longer in a nonimmigrant status including H and L.
I didn't know if we use AP we loose H1, any comments Seniors?

I am on H1B with I-485 Pending and i have layoff coming. I have Approved EAD but i haven't used it. How much time I have to find another job without loosing H1B Status?

I know this topic has been discussed in other threads as well and those threads got buried over the Period of time but this is getting beyond limit now - let me know if anyone has any good idea or if we can do anything together......
My PD is EB3 Mar 2005 and my 140 is applied in EB3 May 2007. at NSC (Nebraska) Its been 13 months and no signs of movement and no one is helping . Here what I did on a personal level and here is what i heard.
a) Contacted USCIS - they said contact employer/lawyer because they are the beneficiary.
b) Contacted Lawyer - they said 'Pls wait for some more time' & then ask employer.
c) Contacted Employer - they said that we can't push lawyers unless your case is passed 2 months from Processing Date update.
d) Contacted Local Congressman - Told them that the Processing Date update is a farce and USCIS (NSC) moves them back n forth just to save their Face. This is really unfair for a certain category of peoples. They took my case no. and inquired and then said that since you have a parallel H1B and a job - we would wait. If your existence in US comes on the Line then we will Jump in and help you. We are sorry but we can't really expedite unless a emergency comes.
Now tell me folks what other options we all have - NSC is just messing with EB3 140. Whatever is the workload this can not happen. Do we still have some options to work on (apart from sitting idle and pray) ?

I had my I140 approved too and had mentioned it in my application. They dont bother you. They however gave me 221g to verify student status and delayed my visa for two weeks. Interview was less than 2 mins and the vo said she had to verify student status thats it.
Please explain what is student status and 221g. You mean , if you are student of any intitute in US, while your I-140 is approved?

consult a good immigration attorney.....they know how to navigate the legal mumbo jumbo and what kind of response that needs to be sent.....
Thanks, My attorney is responding in a day as we have all approvals to mail out. I am trying to make sure that there is nothing left to chance. Also if there are others who faced this as for J1/J2 visa

I don't know how much truth it has - but this is what a friend told me:
1. The GC holder goes back to home country for > 1 year and loses GC.
2. Get married over there
3. After some time come back on H1-H4 and use the same I-140 that you had used for your 485 earlier; and apply for new 485 based on old I-140 (this time for both husband and wife)..also apply for AP and EAD so that even if one loses job, s/he can work on EAD. The person mentioned that I-140 approval and priority date are for whole life (as per current law).
I have hard time digesting this myself, however it woudn't hurt to consult USCIS or a lawyer to know if this is right.

If you have nothing nice to say, maybe saying nothing may be the nicest thing. Sometimes links like this are actually very useful - especially to people coming here for the first time (or first few times)
You can do hero worship of your lawyer whoever it is. I will not.
Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.
Ask him if he contribute to IV instead?
Ask him to give you priority instead of your employer who gives him business every year.
Ask him why AILA is not giving you regular updates through him. As clients of lawyers we should get regular updates and prompt responses. What are they doing about country caps removal, end of retrogression, recapture etc. I mean they are so powerful, so why can't they do it for us so that we no longer need lawyers and save a lot of money? Arn't we all spending thousands of $s on immigration attorneys ? and only few of us pay only $25 and many are free members and get such a good service from IV website. We all hate to pay a single dollar to IV and accuse IV core of asking contributions every time there is a drive but IV still helps us. They need to learn from us.
Why none of us has the courage to do it, but we have the courage to trash talk IV and blame its core for not working hard enough for our $25.

Why in the first place you guys are applying if they say in a news that they are going to reject. It is all because of the lawyer. Whatever goes wrong let the people who applied suffer. Whatever goes right let the people who applied be happy.

The prospective H1 new-comers from India, China etc should be properly informed about the obstacles they would face in the US when applying for permanent residence.
If central Indian newspapers, for example, publish articles describing the current situation of hundreds of thousands of GC applicants, these guys would think twice before coming here and my choose to immigrate elsewhere. As a result the "brain" flow to this country will decrease. And then you will see how quickly will be resolved issues like "backlog", "retrogression" etc.
This would be one of the "negative feedbacks" which, every engineer knows that, keep the system running smoothly.
Another helpful "negative feedback" is the trend of GC applicants stuck in the system moving out of the US. Understandably, most immigrant are reluctant to take this tough step but the trend is here and it grows like a snowball.
So, let's help the Americans to keep their immigration system running smoothly by applying the proper feedbacks :-)

Sometimes I think that rather than writing to these politicians ,we should write to USCIS.This retrogression is caused by them.They didn't wait for any bill to be passed for this retrogression.There is no use of talking to politicians,they don't care.
I know that USCIS will not care either but USCIS did it out of nowhere ,till sep2005,everything was fine for them and suddenly in oct 2005,they put us in backward direction.Now after a year and a half ,we are at the same spot,waiting for the visa bulletin and staying depressed for a day or two after seeing it.
I don't know .I am so mad at everybody.

Btw,i have already sent emails to USCIS and chicago tribune regarding this .

Buddy, I am in the same situation with an American company for which I am working since 2002. I applied in EB-3 (at that time per the job requirements). Company is ready to promote me but I am not accepting due to my EB-3. They decided to file labor for the future job which comes under EB-2. They filed it and waiting for approval.Once I get labor and 140, yes I will use EB-2 and take the promotion. How is this become an abuse, can you expalin? In my view if you get an offer for the future job in EB-2 category and not use that opportunity then that is called abusing yourself not the law.

Congrats on getting your green card. Your post and attitude is the exact reason why DOL has made it almost impossible to get EB2 certification especially in the software field and why people despice consultants like you and your desi employer.

It is because of blatant abuse like this that DOL is cracking down on eb2 filings. People have realized even eb2 india is never going to move beyond 2003 so "consultants" like you and desi companies have moved on to abusing eb1. Seems like you are proud of your achievement just like the L1 folks from desi companies who brag about getting green card in less than an year by abusing L1.
To all the people who think they can pull a trick like mr salawrene by filing in eb2 again hard luck there are 120000 485 applications with USCIS with eb3 and eb2 having about 60000 each, because of abuse in Eb1 no more spillover of visa numbers to eb2 india wil occur so eb2 india will not move forward, on top of it dol is cracking down on eb2 filings. eb2 might start moving backward to 2003 or 2002 and will remain stagnant like eb3 because no visa spillover is happenning.

My AP online status says mailed on Sep 11 th. I have not received them yet.
My wife AP online status said Sep 11 th. We received them on Sep 21 st.
Even mine was approved on 18th september...Neither me nor my attorney has received it...It's frustrating..I have to travel to India next week..
I received my EAD card in 4 days...I don't know why this is taking so much time.

A 700billion$ bailout is not helping much. You think we can help the economy? We are at the mercy of the employers whose earning results are going down because of recession. :( It is hard for me to believe that we can help the economy by buying houses and how are the law makers going to get convinced? Show me the proof.

That equates to $30 billion.. Not a bad #. But I am sure all want to buy houses eventually. Thats $150 billion. Not a small #.
Lets say (again tell them).
1/100 th of 500,000 start companies, of 5 employees each=25,000 jobs.. Not bad again.
This idea is inline with our IV campaign that was discussed sometime back. We can tell in different forms to the media. Somebody may publish.
