I have my contract which mentions start date of 25th october 2010 but my H1B petition is still pending and that is the reason once my petition is approved and if I go for visa interview after 25th october would that affect my ability to get visa. My employer is ok with me starting 1-2 weeks late. My petition is H1B cap exempt.

I have received my FP notice one month back and have my appointment scheduled for next tuesday. I haven't received my wife and daughter's FP notice yet. (my daughter is 7 years old)
I called USCIS 2 to 3 times and finally 10 days back they told me that my wife and daughter’s appointment also set for same date as mine and he was not sure why they have not sent me notice yet. USCIS Rep told me that he is going to send me a copy. I haven't received copy yet as of today. I called USCIS again yesterday but they couldn’t see if notice has been sent or not.

I am planning to go to ASC with my family and will see if they could take FP for them along with me. USCIS also suggested same but they can't guarantee if ASC will take it or not.
Has anyone experienced this before? Please let me know if you have any suggestions. Thank you!

I think u did not submitted your 485 application. You can only apply for EAD once u submit your 485 application. There are three stages of GC...Labor, 140 and 485...Once u have approved labor.. you need apply for 140 when your priority date is not current...When your priority date is current then you can apply for 140 and 485 together. Once you apply for 485 you can get EAD.
Only exception when you are on L2 Visa.

Guys,
I found some new information and it seems that few people who are still waiting may get some clue if not complete idea. Basically I found that when your PD is current the the IO will initiate the FP, Namecheck, IBIS check again when your AOS is in "Final Approval, Visa Available" state. Some IOs would just refresh the FP they have on file and some request another . But namecheck is something that you have to go through again. So if you get stuck in namecheck again, then that could be the reason for the delay since NC takes forever.

I presently have a Nikon D100 which wife is beginning to use more and more....so I am thinking of purchasing another digital Nikon..........was thinking of getting the D70. USCIS would keep family pack submitted at same time together. In your case it seems like your applications got separated. Taking an INFOPASS appointment may reveal this to IO and you may ask that they confirm that your son's application is together with the family pack.

:confused: I have another question concerning EAD. I have a valid h1 visa stamped on my passport till June 2007. I have EAD and AP as well. On my return from India last month the inspector at the POE did not let me enter on my h1 and instead asked me to use my AP. He stamped my I 94 as entering on AP but he did not cancel my h1. Now what status I am on? H1 or AP? My EAD is expiring on 23rd Jan 2007 so if I am no longer on h1 then would I have to come out of job till I get another EAD? Won't this make me go out of status? Please advise.

Hello guys,
I am sending my family based I-485 on May 1. currently i am on h1b . My h1b approval (I-797A) is valid till April 15, 2009. my h1b extension is already pending with USCIS. My Question is :::----
Is there gonna be any problem with USCIS since my h1b approval already expired?? what will be my status after i filled my I-485?? Can i legally stay in US after filing family based I-485 even my h1b extension get denied.???

If you are already in US, you don't need DS-230, you need to file I-485 instead.
I-130 is an alien relative petition filed by your spouse on your behalf. I-130 has a question if you want to "adjust status while in the U.S." or go through "consular processing at an American post abroad".
If you plan to "adjust your status while in the U.S." you use form I-485. I-130/I-485 can be filed and adjudicated concurrently.
If you want to enter the U.S. as an immigrant ("consular processing" you file form DS-230 Part I with the National Visa Center and later DS-230 Part II with a consular officer at a consulate/embassy outside of the U.S.
