    What does it mean????
    Did they pre-approve and assigned visa number to certain application as on July 1 and going to send approval notice later???? If they haven't approved cases and assign visa number before July 2, how come they process and approve pending application after July 2?????

    This is terrible mess!!!!

    The government's surprise offer, then abrupt reversal, of an opportunity for thousands of skilled foreign workers to obtain permanent residency in the U.S. highlights the problems of the overtaxed immigration system and the frenzy that results from a chance to apply for a green card.

    The scramble has put tens of thousands of workers and their families in limbo after many of them and their employers spent thousands of dollars in hopes of securing permanent residency. It may result in a class-action lawsuit against the government by frustrated applicants.

    The problem began on June 12 when the government seemed to open the door for thousands of foreign workers and their families to end the long wait to apply for a green card. That is when the State Department published a Visa Bulletin, which is a monthly notice closely watched by immigration attorneys and their clients because it determines who is eligible to file a green-card application the next month. The June bulletin announced that practically all skilled foreign workers who had been previously deemed eligible for an employer-sponsored visa could now take the final step of applying for a green card.

    By law, the U.S. can issue about 140,000 employment-based green cards each year. Last year, the government fell short by about 10,000, despite the long waiting list; leftover visas cannot be rolled over to the next year. The June announcement aimed to prevent the visa slot from going to waste, according to a State Department spokeswoman.

    The announcement was greeted with a mix of jubilation and panic by thousands of engineers, lab scientists and other high-skilled foreigners who had waited years for their place in line. Working ahead of a July 2 date for filing the application, intending immigrants rushed to gather documents, complete paperwork and obtain medical exams. Many of their dependents boarded planes for the U.S. to meet a requirement that all family members be present at the time of filing.

    "The bulletin created a land rush among legal immigrants desperate to finalize their green-card applications," said Steve Miller, a Seattle-based immigration attorney.

    By the way, how do you tell a soft LUD from a "hard" LUD?

    The admin would get an error report if there is a problem. the webfax is sent by a third party vendor who provides service to us. Last time, when we sent this webfax, we did get staff of senate office saying that "Those webfaxes kept on coming". That means that EVERYTHING we send, goes there. Numbers are important.

    If 1000 members send it, each office will get 1000 faxes(although not all of them will make it in one day), but a few hundred faxes will make it in next few hours.

    Please send this webfax and voice support for Sen. Brownback's Amendment.

    People travelling to India, especially from the West coast should fly via the Pacific. Asian airlines such as Thai, Cathay and Asiana all offer better fares, better service and faster transit times.Plus these countries are not trying to fleece people by requiring that they get a "Direct Airside Transit Visa". It happened with my family when they reached the airport to board their flight on Virgin , they were not allowed.I then bought tickets on Thai for the next day. To compound the pain, Virgin imposed a "No Show" fee on each ticket despite going to the airport. I think it would be best to avoid most European carriers, if for no other reason but they offer higher fares, terrible service, long transit times and last but not the least; the scam of the century(Airport Transit Visas). What do they think the passengers will try to do, jump off the walkway and make a run for it so they can settle illegally in U.K!I think the U.K govt is running out of ways to make money so they have found the most ridiculous way to make a few extra pounds from people foolish enough to travel on one of their carriers! DONT FLY VIA U.K. PERIOD!

    Pls see below for answers
    My H1b is going to expire on April 17th. I had found a new job and they had applied for my H transfer on March 27th. I would like to know

    1. How many days is required to get a H1b transfer receipt.
    -- upto 1 or 2 weeks if it's Premium
    -- Upto 2 or 4 weeks for regular. Looking at your case, your lawyer probably already has receipt Number.

    2. What happens if my H1B expires before i get a receipt.
    -- Nothing, you will get a receipt sometime , so long as you get a receipt that will have date of receipt as you originally sent it. If you are afraid your company didn't actually send it, then

    3. Should i go on EAD or continue on H1B. My wife is a green card holder for last 3 years 6 months.
    That decision has no relation to pending h1. You can choose to go to EAD anytime. Looking at your situation, you are probably better of on EAD. Your wife will eligible for citizenship in 18 months then she can apply for naturalization, I think even now you can probably apply as spousal category so really no reason for you to be on h1 ..(Not entire sure abot this.. check with family immigration lawyer)

    I already fought this for three good years! I don't know how they allow L1 to enjoy in-state tuituion and not H1B. I provided liks to USCIS to ASU to prove that L1 and H1 are similar non-immigrant visa. I gave up after they could not provide any reasonable response.

    Did you threaten them with a lawsuit. You would be surprised at what a threat like that can do.

    Hi Gurus,
    Here is my case:
    Employer A:
    I am working with employer A,
    Approved I140, EB3, PD Dec 2004, I485 filed on Jun 30, 2007, Got EAD and AP

    Employer B:
    Future employer,
    Approved I140, EB2, PD Aug 2004

    Note: A# is same on both approved I140 and pending I485.

    My question is, do I need to request for interchange of I140 from EB3 to EB2 or it will be automatically done since A# is same on both approved I140. I really appreciate your response. Thanks

    JOb title/Description is significantly similar. I will inform USCIS. I am really glad we have this option so we can make choices on what is the best place to work for us rather than get beat up by fate and long timelines and stick to someplace where one is not happy or progressing anywhere. My downside is I have to sell my house :(

    Adding more H1B is what every employer aspires. They don't want you to get GC soon enough so that you leave them for better prospects.
    No one is going to raise the GC backlog issue. Is there a way by which the we can also ensure that companies also stress on reducing the backlogs in EB categories and re-capturing past immigrants visa as a interim relief as they lobbied for increasing H1-B caps

    Does that mean I am screwed? My package got delivered this AM at Mesquite, TX as per the tracking receipt.

    the goal is to end retrogression for all. if this happens incremental steps then the movement will continue until the whole goal is achieved.

    That should be the only goal. I am hoping that IV does not need to exist in the future, that everyone legal is getting a fair treatment, but that looks far away right now. Until then people need to fight.

    I can understand and accept that US wants to promote certain groups of people for their skills, such as doctors and nurses since there is a shortage of them right now. US educated, since they have helped the US economy and school system and so on. But the core goal should still be fair treatment for all. No retrogression for legal professionals.

    Normally, an alien who has filed for Adjustment of Status in the US must apply for Advanced Parole and use the Advanced Parole to come back to the US in order to keep his / her Adjustment of Status application pending.

    H-1 and L-1 holders are the only exceptions to this rule.

    Aliens in H-1B status who have a pending Adjustment of Status application do not need to apply for Advance Parole to go abroad if they fulfill certain conditions. As long as the H-1 B visa holder maintains his/her H-1 B status before leaving the U.S., he/she may apply for an H-1B visa to re-enter the U.S. to work for his / her H-1B sponsoring employer after his/her travel abroad.

    When he/she comes back with a valid H-1B visa to continue to work for his/her H-1B sponsoring employer, he/she does not need to be paroled. Rather he/she can be admitted under H 1B status as long as they're still employed by the H-1B petitioner.

    If they choose to be paroled, then they are not H-1B anymore, and if they had dependents, those dependents cannot be H-4's anymore. It's your choice. Use the valid visa if you're still with the petitioner or use the parole. If you are paroled into the U.S., you will need an EAD to work.

    I need your help in this scenario. I went to India during Mar 06 and got a stamping on my passport till Jun 2010 (based on my I140 approval). But at the POE, the officer stamped my I-94 till Jun 07 as he could only stamp the date that was on my current I-797. He also told me that I can goto the local USCIS office and extend my I-94 till 2010. Is it true? and if so, how would I go about doing that??
