got Interview Notice with PD March EB3 India
Can you explain how come your EB3 category is having a tag "RIR"? The reason I am asking is that at one end you claim your PD is March 2007. And in that case you must have been approved through new labor process PERM and PERM does not have RIR and NON RIR criteria. RIR/Regular (non - RIR) is used to be a junk language of old labor style filing.

They won't be any better off here.Instead of being kicked out fair and square, they will be made to decay on H1 visas for 15-20 years. Talk of choosing a rock over a hard place. Besides, the British MPs seem to at least understand what skilled immigration means - here they will have the pleasure of being grouped with meat-packers and grape-pickers who matter-of-factly walked across the border.
I think its also a lesson for those tired of the US immigration system and considering moving to other countries - lets face it, immigrants are not exactly welcome anywhere. Either stick it out, or return to home country.

This is my first contribution of $100 to IV as a new member. I urge my fellow members who have not yet contributed to do so and strengthen the efforts of the IV to get some relief for legal EB immigrants before congress adjourns. I hope IV will keep up their good work and more members will contribute. It could be any amount, please do so. This is our last chance to have something done. I also met several American citizens who were passing by and were curious about the rally. Me and JazzbytheBay explained and they listened patiently. One hour later I saw them marching with us holding flowers that some of our volunteers were distributing to passer bys. One gentleman was a school teacher.
IV needs grassroot support from half a million people stuck in various stages of green card process. You can be from any country. We welcome and invite members from all countries and communities to join our efforts.
Additionally, one of our best friends can be American citizen who understand the issue from economic, personal and other perspectives. If they become part of our voice we will become more effective.
Each one of us has to become "IV brand ambassador" and present our issue in right perspective to counter so much misinformation floated by some vested interests. Yes, you can do it. We can facilitate.

My and my employer talked to National Customer Service Center and they dont provide any information other than opening service requests. My employer asked her to connect him to an IO and she said she doesnt have authorization to do so. what the heck? Is there anyway to talk to an IO rather than the customer service rep. Please let me know if anyone has done that before and how they were able to get to them.

As far as I know, starting a PERM application in itself does not amount to an intent to immigrate - it is simply a labor market test for a future position.Remember, the employer can port the LC to a different employee at a later date. I-140, however is an application to immigrate permanently to the US; hence a violation of the F1 visa. You may have a difficult time getting your I-485 approved or have to go in for consular processing. It is best you consult a lawyer on this one; don't count on random opinions on the forum for such a serious issue.

1. Born in 70 but my birth was registered in 2005 when I wanted a birth certificate, BC issued in aug 2005 and says registered in 2005. Is it ok I use them or I need an affidavit also from my parents?
2. There is one letter written wrongly in my name.. can i send or get a new one??
I would greatly appreciate your advise on this

dpp: did you open a SR or contact USCIS that you think might have expedited your FP? Also, what was the timeline of your case Xfr from CSC back to NSC? Also, is your FP scheduled at an ASC in CA Bay area? Pleasr provide more information.
I have got FP appt notice 7 days back. I am July 2nd filer, filed at NSC, but transferred to CSC and then back to NSC. Also, got AP and EAD approved long time back from CSC.

I see an update on jan 24 on this bill to grant 55000 visas for advance degree holders from DV lottery. Does this mean progress? Rest of the immigration bills never make it to the sub committee.

The track of L-1A is very tricky, there is lot of scrutiny/audit before they get their GC. So grass may look greener by looking at the example of one person, but there may be many other guys whose application was denied, which you may have not highlighted...

Under Post decision activity it will mention a date :
"we approved this petition and sent it on date -->
This date is when they mailed your green card.
If you do not receive it in 7 days after that date (that is mentioned on "post decision activity" message, you need to check with your local post man/post office and then consider infopass to see what has happened.
The card comes in a "neutral looking envelope" with "return service requested"marked on it and upper left corner has address of Nebraska or Missouri (two places where they are produced). Nothing else on that envelope (it is slightly large than norma envelope): keep looking for it in your mail.

If someone has EB2 application, and EB2 is unavailable, but their EB2 PD is current with respect to EB3 visa bulletin date, will USCIS allow an EB2 to take an EB3 slot?

I would like to think that the number(110,786) mentioned is of those applicants who have filed their I-485 while their PD was current. After they submitted their applications, probably retrogression happened and as such they are probably still stuck waiting for the GC to become available.
