    I have asked same question to the lawyer and here is his reply:

    To be able to do EB-2, you will need to have, in addition to your 3-year bachelor's degree, at least another 3-year degree or a 2-year master's degree.

    If your post-graduate diploma is 3-year, you may be able to make the case for EB-2 if you can show equivalency to master's degree. One-year PGD would not be sufficient for EB-2.

    Guys,
    Not sure whether my suggestions help any one, but I do have some real time knowledge about this process.

    You can do EB2 with following options
    1. A bachelor's (4 year degree) + 5 years exp. This exp should be with prior companies.
    2. Master's with no minimum exp.
    I am assuming you guys already have knowledge about EB2 requirements and skills. Basically, there is nothing in IT, which needs Bachelors or Masters. Requirement is defined by HR on advice by Attorney. Any job requirement can be defined as some thing which needs a bachelors or masters.

    My company applied for me and another guy under EB2, since both of us have master's degrees over here. But, for another guy who had 7-8 years of prior exp, my attorney applied in EB3. This guys is a dev team lead and is one level above me.
    By April 2008, we had our I-140's approved, but this guy (in EB3) doesn't know he in EB3.
    Accidentally, I found out when I am cross checking with him regarding H4 extension for my wife, whether he did it on time for his wife.
    We forced him to talk to HR and Attorney and they agreed to do EB2 for him.
    Attorney simply filed I-140 under EB2 using his EB3 labor and it was approved in 4 months.
    We are confused about this whole process, but it worked for him. May be some of you, who falls in this category can try doing the same with out actually changing jobs.

    Another option for people who are using EAD. I am encouraging one of my colleague to get him to talk to HR, to apply for EB2. He doesn't have H1, but one doesn't need to have H1, when they have some thing like EAD. They can use EAD to change job and start the process again, but once their ported old PD with new I-140 was approved, they will be ready to file new I-485. This will reduce their waiting time a lot.

    Due diligence
    Send a Certified email with receipt /delivery acknowledgment to the employer with your request. Prepare a proper trail of documentation. If the employer does not relent, report the same to IRS after consultation with a tax consultant.

    I didn't send a certified mail but I have a reply to my email saying that they didn't received the statements from the Insurance Company and we can still report those missing wages without a W2 from the company.

    Can we use this as a proof of contacting employer requesting for a corrected W2?
    Or
    Do you still recommend us to send a certified mail? so, first thing Tuesday morning I can do that.

    This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?

    You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
    The credit card will be charged once, may be charged twice or a valid CC may get rejected.
    Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
    USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
    In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
    There would be an online survey after you buy it which would never get submitted 99% of the times.
    In case it did get submitted, somebody will read one out of 10,000.
    After reading it he will throw it in the trash can.
    If you get a defective TV (which is quite likely), you have a chance to file appeal by paying the same amount of money for the TV again so that your case can be re-opened.
    I wonder how many customers would USCIS have eventually ??? Any guesses ??? :-)

    Gurus,

    Here is my situation:
    I-140 approved - PD: May '06
    I-485 filed - July 30 '07 (India)
    EAD cards - Received
    APs - Received

    Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.

    I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!

    Exultant, be a little careful with what you are doing here, since the basis for the 485 relies on the fact that there is INTENT on both sides (employee and employer) to take the job available at the time of filing. A company expresses this intent by keeping the I-140 active and not withdrawing, but there could be a question as to your intent with what you are stating to do.

    I know you can counter argue this by saying that you are still on the original company's payroll in Jan 08, but when you file for AC21 in Feb 08 and show you new employer as the one in December, there is a question of intent.

    I am not trying to scare you or sway your decision, all I am saying is there COULD be a question on your petition in which case be ready with the facts incase there is an interview.

    I Renewed mine last month.I took only normal size photo.I went directly.if u can get into the counter before 12 then u can get same day delivery in the evening else u can ask them to send thr express mail.I was little late because of traffic got my chance only after lunch so ask them to mail and got within 2days.NY consulate says one yr i think

    I am planning to get my PP renewed at the NY consulate and had a couple of questions and I was hoping someone could shed some light on them.

    i) The DC website states that one can *only* apply 6 months before expiration date but the NY website does not? Mine is going to expire in ~8 months. Anyone know if it is 6 mo across all consulates?

    ii) They have it in big red font that the photograph should be 3.5 cm * 3.5 cm, the US standard PP size is 50 mm * 50 mm .. any ideas where I can get them done in the right dimension?

    iii) If applied in person do they issue the PP the same evening?

    I think EB2 India may be retrogressed only for the month of September as most of the visas will be used in August itself. The dates will rapidly advance once again with the new quota in October. I think it is very likely that EB2 will be compensated with the number of visas that were improperly given to EB3 last year. So I expect EB2 to receive those extra visas from EB3 quota next year as DOS will try to compensate retrogressed countries in EB2 for the mistake that they made last year. If this happens, EB2 may become current very soon.

    I strongly think DOS tried to compensate EB2 this year itself with the visas that were improperly given to EB3 last year after it received the directives from the US Congress. But unfortunately DOS could not compensate EB2 with the lost visas this year as there were no visas left in EB3 by the time they realized their mistake about 2 months ago as EB3 used most of their visas. This is exactly why DOS made EB3 unavailable so that they can compensate EB2 atleast to some extent. By law they are required to compensate a category that was artificially retrogressed because of their mistakes. It is highly unlikely we will see any significant movement in EB3 ROW or retrogressed countries until the entire EB2 category is current as EB2 will be compensated from EB3 quota. If EB2 is compensated with the visas from the new quota in October, then I expect EB2 including India and China to become current by the end of the year or early 2009(before March 2009) itself.

    Once EB2 becomes current, I think EB3 India will get equal spill over as EB3 ROW as both the categories will be retrogressed and will move equally(as per PD) with the spillover from EB2 and EB1

    yes. there is a possibility of some retrogression for EB2 India/China in the comming bulletins. But that is just for few months and it might be a mild retrogression as long as there is horizontal fall outs of spill over visas.

    Thanks. I finally got the receipt notice yesterday. They gave me a receipt date of May 11th and a Notice Date of June 11

    Now to wait for the EAD....

    Thanks gcpool for your reply. My question though is that is it pretty much guaranteed that the green card will come through after the 140 clears? I ask because just today the USCIS website updated to say that they sent out a RFE for our 140.

    The risk/reward matrix for my situation is as follows:

    Stay in USA/green card comes = most assurance of good job and pay.
    Go to Canada/green card denied= harder to find job and less pay, but at least not deported.
    Go to Canada/green card comes = I'll survive, but there's the possibility that I'll be kicking myself for a long time.
    Stay in USA/green card denied = I'll probably jump off a building. :D

    So you see it pretty much all depends on how much assurance there is of getting the green card after 140 clears.

    So, does that mean there's no need to invoke AC21 after you get you get EAD, if you want to change employer before 180 days of your filing?

    if you change your employer within 180 days of 485 RD, the employer can revoke your 140 which will invalidate your 485.

    After 180 days you can switch using your H-1 too. The EAD is not necessary.

    My experience was just great. My company had inhouse immigration deptt and their own attorney as employees.. She was just great and very transparent on every process. She sent all the documents and updated my at every step on where I stand.

    I really respect that lady, who was doing way beyond her job profile to keep us updated and well informed. never paid anything for the attorney service or GC filing except a one time fee of $500 when the company hired some attorneys on contract to get over the overwhelming request during July fiasco. The attorney also adviced me and guided me on how to leave the company and what is AC-21 and how to do that. So gave me a lot of pointers on how to choose a new attorney. Though I had a lot of conflict of interest with my company policy and management, one thing I always appreciated about it was that their healthcare and immigration was far better than any company in US. Now I heard its not great and employees have issues related to this. I paid on $15 for the delivery of the baby and that was the total amount I paid in 9 months .. thats it.

    The crux of the story is , when choosing a company , initially these things really dun matter but in the long run these are things that really matters, I would suggest everyone who is switching the companies, make sure the company has the right healthcare plan and immigration services. Do not hesitate to discuss this with the HR. I always do and make it clear, whenever I am questioned by HR , I just tell them , "The company has selected me but I haven't selected the company yet." The HR also has the pressure to close the position they will provide you with all the different options. Do not always run for the $$$ a few 1000 $$$ doesn't make the difference as at the end of the day those also shrink with tax and deductions, but the perks like these stay and pay more than $$$

    Not exactly. That person has more leverage, even if he/she does not worked 180 days after filing 485. How? If that first guy worked considerable period of time with that employer in H1B status, and if that guy was working with that employer when that (fradulant?) employer filed LC and 140, he has a strong intent to work for that employer. In no court employer can win. Even if that guy left with in 2 months after 485 filing date, he is so safe.

    Read the recent AC21 memo. It clarly says one can leave the sponsering employer before 6 months of 485 pending, if the intent is strong in both parties at the time of filing 485. The AC21 rule is that, a if 485 is not adjudicated in 180 days, it is a valid one for a new job which is similar to the orginal one. That does not mean that one has to wait atleast 6 months to change the job.

    Here is the part of memo

    Question 10. Should service centers or district offices deny portability cases on the sole basis that the alien has left his or her employment with the I-140 petitioner prior to the I-485 application pending for 180 days?

    Answer: No. The basis for adjustment is not actual (current) employment but prospective employment. Since there is no requirement that the alien have ever been employed by the petitioner while the I-140 and/or I-485 was pending, the fact that an alien left the I-140 petitioner before the I-485 has been pending 180 days will not necessarily render the alien ineligible to port. However, in all cases an offer of employment must have been bona fide. This means that, as of the time the I-140 was filed and at the time of filing the I-485 if not filed concurrently, the I-140 petitioner must have had the intent to employ the beneficiary, and the alien must have intended to undertake the employment, upon adjustment. Adjudicators should not presume absence of such intent and may take the I-140 and supporting documents themselves as prima facie evidence of such intent, but in appropriate cases additional evidence or investigation may be appropriate.

    I will not be good in english (en fact with the new bill i am in trouble....) but as european i can tell what is the real situation in europe is different of what Communique says. I have lived in French, for more than one year, and the problem was that the French has take the communique version on the immigration, means under class of citizen. That`s the real problem. It`s funny that nobody speaks about what happens in England, where they decided for a full integration or in Spain, or even in Nederland, no riots down there, how is possible?

    I guess when it comes to GC processing, NOTHING is really "wrong" is it? If you get a chance to work around and beat the long lines, I guess "It's all good". Some people are lucky that they get a chance to get Labor Sub, some ppl marry the GC and some ppl like the rest of us wait in line like "honest citizens".

    The REAL question is, just how many of us would have refused a good labour sub, given the present conditions, solely on the basis that "it is unfair to others"? I know i would have taken it. Reason? It's LEGAL (or used to be). Our "misfortune" (if i can use that word), is that we did not get a similar chance.

    For those wondering, what I am babbling about: "Let's not look down on this guy who got his GC approved by Labour Sub, or even continuously point out that he did."

    Got following email today on my daughters case today. NSC July Filer. EB2 I Mar 2006.

    All our cases show this status now.

    Any idea what happens next?

    Current Status: This case is now pending at the office to which it was transferred. The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register.

    Where in the email does it say that the case has been transferred to a "LOCAL" USCIS office? From your information it appears that you are a July 2007 filer. Please check your 485 receipt number, if it starts with anything other than LIN, it means that although you mailed your application to the NSC, they sent your packets to either CSC or TSC for data entry. Now that your PD is current, it is quite possible that this office is now sending your packet back to NSC (which has jurisdiction) and is now pending there.

    I say this, because, the same thing happened to me and many others whose 485 submissions were sent to difeerent offices for receipting and then those packets were sent back to NSC.

    I believe Lou was referring to conversing on the internet. It definitely isn't a turn on to an employer if you are a 1337 h4><()r. You have to be able to get your words across. That is not to say that you can't use a bit of slang.

    That is not true about TSC. I applied about 5 weeks ago and did E-Filing. I got the receipts within a week but so far no updates and no LUDs on the receipt number also.
