    If EAD received - SEP 1st (both EAD's)

    Canada is a great country, I am sure there are plenty of good trash cans all around the country, surely they can hold a small litte I94.

    Or how about getting your I 94 framed and selling it on ebay?

    Dude, You can use I-94 card as a toilet paper when you take the very first exit in Canada. You are leaving for good! Do not worry about it. Meanwhile, congratulations for taking this bold step and moving to Canada after 6 years of H1-B. I wish you well.

    It's ridiculous how people start to bad mouth everything related to US once they get a PR from another country, especially Canada. It�s like kicking off the same ladder that you used for climbing.

    1. You gained entry into US with the �toilet paper�.

    2. The �toilet paper� allowed you stay legally in this country.

    3. The legal stay enabled you to apply for Canadian PR from Canadian Consulate General in Buffalo where the processing time is less than 2 years.

    4. The legal stay enabled you to earn sufficient funds which you showed as proof of funds in your application papers.

    5. The legal stay enabled you to get police clearance certificates from FBI and also from your country�s consulate in US.

    Now let�s say you didn�t have this �toilet paper� and applied for Canadian PR for India.

    1) You would only be eligible to apply from Canadian Consulate General in NewDelhi where the processing time is more than 5 years.

    2) If you are from a middle class background, then you would have a hard time in providing the proof of funds for a family of 4, with your earnings from India.

    3) You would have to grease the palms of police to get police clearance certificates and they are gonna take their own sweet time to provide you these documents.

    Now be thankful that you got away from all these with the �toilet paper�. And remember that you are leaving to Canada not because of your love for the country, but because you didn�t get your US GC on time. Sour grapes, huh?

    I know that i will be getting red dots for this post from hypocrites and I don't give a damn about it. All I can say to them is "Instead of pressing your finger against the mouse, press it against your forehead and think about the benifits that you milked from this country".

    I now applied for EAD for my wife (not because she is going to work, just go get SSN). I do plan to get SSN for her and then file amended 2008 return. I wonder if I will get stimulas package then (the one which was given in 2008)?

    I amended my tax for 2007 (filed in early 2008), intially filed with my spouse's ITIN, to change my spouse's ITIN with new SSN. IRS did not send any check. They simply replied that people without ITIN are not eligbile, which I knew, and which was the reason of my amended tax filing. Looks like simply changing ITIN to SSN is not treated as a tax amendment.

    If changed situation (new SSN, children etc.) allow the check, this year's tax should take care of it as per instructions on IRS website.

    Try this company for a mortgage. When I bought my house in 2006, I used them. They had the best rates, closing costs are relatively cheaper too. They are a small company, but are very customer friendly. Once they loan you the money, eventually, they will sell that mortgage to one of the big banks -- Countrywide, Citi etc. At that point, you'll need to start dealing with the new company.

    EB2 .....on June 2001 recieved before 11.45 AM
    EB3....on May 2001 recieved before 10.30 AM

    But on a more serious note...Let us concentrate on the letter campaign .

    That's very correct. But I think AILA or concerned folks like us should ask USCIS to clarify their stand on it. I am sure they will do it soon.
    Also, an approved extsnsion with the new employer is by no means a approval of your valid status. Simply speaking, there are various H1B approvals granted "that were approvable at the time of application". This doesn't mean that status is valid for the entire duration, one has to maintain the status by keeping the job etc and meeting the other requirements of approved H1B petition. That's true for extensions too it MIGHT be valid/approvable at the time of filling when your I-140 was approved and not revoked. If revoked you could be potentially out of status if indeed that was the CONDITION of the approval.
    Unless we know that CONDITION of approval (it could be unconditional approval too but it must be stated) we are not sure. If the USCIS later clarifies that CONDITION it could be applied retroactively and that means one is out of status during the whole time after the I-140 was revoked.
    I am not saying this will happen but it is essential to find out the CONDITION of apporval whatever it may be.

    The USCIS has not taken any official position on whether they would allow the after I-140 3-year extension to be transferred to another employer.
    Using this loophole looks like many of us have actually sucessfully tranferred the H1B to a new employer after the 6 year limit..

    As long as USCIS does not release any regulations...We can do this ....
    If asked officialy some attorneys say that it cannot be done and some are fine with that...

    Immigration laws are kind of applied sporadically and can be pushed to a certain extent

    So I am in some real mess ....

    I married to a gal in 2007 during my visit to my home country but it did not work out b/w her and me due to some family reasons. (Not divorced just separated)

    I came back to US in 2008 and applied for 485. My green card got approved and now my wife is in my home country and I am in US.

    Now my wife and I have reconciled and I want to bring her to US.

    Can I apply for her Green card and bring back to US ASAP w/o waiting for 5 years as I married before approval of my GC. I can get papers from my home country showing that I got married way before my GC approval.

    I did not show at any stage in GC application that I was ever married. I thought the marriage is gone so why show it and now it could hurt me. I even dont remember if there was any question regarding marital status on 485 application.

    Please help me other wise I would just have to cancel my GC and go back to H1 to bring my wife here. I cant leave her any more with our stupid relatives who might again break our marriage.

    Please help , I am very desperate.

    Do not give up your green card. You must explore all options before doing that. Your best chance will be to get her here on a F-1 visa. If she is qualified, H1-B is appropriate but these days it's not easy to get H1-B. As far as i know, once your green card is approved you may not be able to add your spouse. Anyways, it would be best to consult an attorney like murthy and if possible use their services. They know the rules and most probably USCIS knows murthy too.

We alrerady know that the visa numbers aren't available for this year...and its also been mentioned by IV that the breaking news that everyonez expecting isnt about the visa bulletin....I am confused...could somebody throw light on this pls..why the wait?? :confused:

    I don't expect to get a 1D-II lower than the MAP price before 2004 year end.

    If Paul's hunch that we'll see the 1Ds' successor by September is correct, then we might see cheaper 1D-II bodies prior to that.

    As for the Kodak, it certainly has the resolution, but it doesn't seem as if it's generating much enthusiasm. The 1Ds (with less pixels) OTOH has. Removing the very expensive anti-aliasing filter was probably not Kodak's greatest moment.

    Can you we go on a cruise to Bahamas?

    Yes. Indian Citizens need a Bahamas visa to travel (Cruise) to Bahamas.
    A Person needs a Valid US Visa or AP to enter back into US.

    I went with a valid US Visa. I dropped my old I-94 while leaving US and received a new I-94 while entering US port (in Cruise).

    Enjoy your trip to Bahamas!

    I donot see any point in paying off the house, as you can deduct the interest to get some tax benefits. Why loose any benefit you can get.

    On the other hand, use the money you were thinking of paying off the home for investments. Investments may it be CDs or stocks ( though right will come in future).

    Although personally i have never bought a brand new car in US. Car depreciation is biggest loss one can take; we just bought a 5 th car...all cash paid and it is used.

    Keep your cash, play with 20-30% based on your risk apt, donot pay off your home...cash is king.

    On your comment of " being a novice in financial "...i have to say it Everyone is a novice in every matter, we all learn it here. Rather one who says he/she is a novice will make cautious decisions; i am wary of so called experts/gurus who mauled financial markets and still call themselves experts.

    Start reading finance articles, blogs and you will be able to understand.

    Thank you for your response raysaikat! I really appreciate your time and patience. One more question. Will it be "ok" in the eyes of USCIS if I don't go back home after my education process is over but apply for H1B visa instead?

    This scenario is pretty common and does not pose any problem.

    In our case, the primary applicant has received FP but the dependent has not yet received, has this happened to anyone?

    I called Customer Service and now they ask that we wait 180 days from the time the case is transferred to NSC before enquiring about it !

    My wife recieved AP which was approved on 30 Aug. They approved mine on Aug 31. I have not recieved AP yet. My attorney advised to wait for 30 days.

    That is NOT true. desi3933 and I quote directly from the INA or AC-21 or UCSIC Field Memos. Please read the Yates or Neufeld memo and you will get all the answers. Many lawyers themselves do not have all the info at their fingertips and will ultimately refer to the law. By definition, a law is created to not leave "anything" to interpretation, thus the cumbersome "lawyerspeak" in which it is written. In rarest of cases where there "might" be ambiguity, it is usually clarified by Memo releases or Judicial precedences.
