I am a H1 getting married to a citizen. We are planning on getting married in IL. Are there any rules on documents required on my part to even apply for a license? And then for the marriage ceremony (we plan to have a small civil ceremony). I am pretty confused by all the different advice.

I obtained an H1B visa through Company A (starting October 2008) and the H1B visa was valid until September 2011, unfortunately in March 2009 I was laid off. As a result to maintain my status I switched from an H1B visa to a B1/B2 visa. I actually went to my home country and got the visitors visa from the consulate in my home country. In July 2009 I returned to the USA and entered the USA as a visitor on a B1/B2 visa.
My question now is what happens if I obtain employment. What does my new employer have to do? Since my initial H1B approval is valid until September 2011, can by new employer just take over the H1B without me having to go through the lottery system again even though currently I am on a visitors visa and have been unemployed for more than 3 months?

You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...

You will have to open a service request (SR) with USCIS after 30 days have passed. Once you open a SR , usually service center will people will call and confirm about the current status and in about 45 days from SR open date they will try resolve the issue. If 45 days have passed, then you will have to take an infopass appointment figure out. Hope this helps!

Photoshop might have a filter that could do this, although I'm not sure off the top of my head. I'd go with the Flash version myself, it's quick, easy and you can cut and paste the result into another package without any hassle.

I had the same problem with my PERM. my last name had an extra letter in the end at one place but was fine at the other place. My perm was approved without any issues.
At I-140 stage my lawyer made a note of this to USCIS and now my I-140 was also approved without any issues.
I am pretty sure your audit is not related to that because they have no way to to know your real name! at the labor stage

My wife applied for her H4 visa this month and when she got to the embassy for the interview, the consul checked and commented on the font size of her address in our marriage certificate. She said it was smaller than my address (well, she got a longer address before we got married, maybe that is why the census made it smaller) and said to my wife that it needs verification. The embassy then took all documents (her passport, our original marriage cert, etc.) and said they will call her when she needs to return for interview again.
Has anyone of you experience this? If so, any ideas how long it takes for them to call? BTW I'm Filipino. Thank you guys and God bless

I'm in H1B visa and my visa was valid until 26th October , 2012. Recently, I went Bangladesh and US embassy stamped visa until October 23, 2011. When I returned US, Immigration office issued me I-94 validity until September 23, 2011. Now how long I can stay in US?? Do I need to apply for H1B visa extension or I will go to Canada or Mexico to apply for new visa or if I go to Canada or Mexico and return back, they will issue me a new I-94 until Sep/Oct 2012. Any one please suggest what should I do?
Your stay is legal until your I-94 specified date. You can get it resolved by INS or go out of US and reenter (which may turn out to be faster). And this time while entering make sure Immigration officer puts right date on your I-94.

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?

No..your status will not change. You can still maintain your H1. She can go on EAD and work for 3 months and she will be in AOS status if she does not find any job. She will not go out of status. She can work 40hrs, 20hrs or 0hrs..it will not affect her status.
