waiting from 2005 is not at all a big deal, some folks here are waiting for a decade to get a chance to apply for 485 (due to BEC black hole, having to restart GC process from scratch due to various reasons ..etc)

Would there be a problem as I sent an affidavit in lieu of birth cert with just my father's signature? Please let me know.

I sent my contribution amount for IV's April month washington campaign also ...
I understand 221g is an action to prevent fraud. But at the same time consular officer should give a chance to prove visa applicant's point at the time of interview. In my case I had most of the docs at the time of interview, Why don't they accept those docs and start processing immediately, then I would have saved some 3 weeks ...
Moreover, Not all ther employer will hold your position, If your case is taken long period for approval. They have to run their business ...
So I would expect DOS should change the way of handling 221g cases. Right now It's too lenghty and more confused ...
It is hard to say dont loose hope but really thats the best option possible anyways. Is your family also affected or are they back here in the US? Your son is in which grade? If he is back with you in India it might be best to inform his school about the delay. Hopefully you will hear great news soon so keep the faith. Best..

Someone told me that taking color photocopy of PR is illegal just like you cannot take color photocopy of currency. Maybe a B&W copy is an alternative.
Btw, why is this hatred towards someone that just walked out of the queue? Blame the system, not the poor individuals who have also waited like everybody else. Instead of venting out on innocent people, do something constructive to help yourself and others. As a donor, pls post responsibly. Guys, give me red if it is wrong to say that.

Sorry for not mentioning in my first post earlier... Just now I received a copy of the Letter which my company received from the USCIS. It is mentioned as "NOTICE OF INTENT TO DENY (NOID)".
Reasons:
- Section 203(b)(2)(A) of the Act states
- 8 C.F.R 204.5(I)(3)(ii)(C)
These are related to the Education for 3 yrs degree..
- What is the next step ?
- What is the chance of a positive result?

I was just thinking if it would help to gain more publicity if this site goes by a different name. On several instances while calling lawmakers or other people, the moment I mention immigrationvoice.org they think it is related to Illegal immigration / CIR etc. I need to stress that it is about legal immigration.
Even the flyers don't catch enough attention
Any name that does not have immigration in it (something like numbersusa), and reflects our main focus - green card retrogression and legal immigration would help - Just a thought...

Perhaps your old employer might have withdrawn/ revoked your I 140 and that might have triggered the RFE. Still all they will ask is new EVl with job responsiblities so easy to answer

But only thing is I am working for different employer and I have NOT yet applied AC21. If this RFE is about "employment verification", I am thinking of sending from new employer since my I 485 filed more than 6 months. I hope this is ok. Please correct me if I am wrong.

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 problems, GC backlog processing etc.
Any other thoughts from your side would help.
I am an ex NYFA student in digital film making. I would like to make the above two things by end of this year. Any of you are interested can participate. Again I don't need any money contributions. Just need your participation as actors, script writers and as other team members.

That's very correct. But I think AILA or concerned folks like us should ask USCIS to clarify their stand on it. I am sure they will do it soon.
The AC-21 became a law in 2001.... if they really wanted to clarify it, by now they would have....They have taken a position of strategic ambiguity....
Government lawyers like this kind of situation...If they donot like something you or me not doing they can use this weapon against us....to throw you/me out..
So the crux is if you/me donot get into any trouble like drunk driving or something...we can get away with some things...
