Saw it. However, if my experience with slashdot is anything to go by, we wont get any sympathy from fellow (US citizen/GC) techies there .. they have been brainwashed into believing that we actually stole their jobs ... in any case their opinion does not matter much. The only folks who count are the media and lawmakers.

I will be travelling outside US using AP by end of this month. I don not have valid stamped visa. Recently small part of my old company (A)got acquired by new company and my job was moved to new company (B)
Lawyer at company B applied for New H1 in May 2008 ( old is still valid till 2009)�but haven�t received approved 797 notice yet.
Can I travel outside US and comeback without haveing approved new 797 notice. I do have EAD and old 797.
Any issues ? I don�t want to abandon my H1 status.
Gurus please advise.

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...
I understand is a grey area but i was wondering if anybody here had some issues like that. Hopefuly, whatever he does is not going to be denying it...

My current situation is as below
I -797 and I-94 expiry date: 10 Jun 2011
Passport expiry : 28 Oct 2011
I am filing for H1 extension through my company immigration cell. However, they informed me that my passport had to be renewed before filing the extension !! else the attached I-94 in the extended I 797 will have the expiry date only till my passport expiry :confused:
In that case, if they had to wait for my renewed passport to arrive (which can take longer) to file the extension and my I-94 might expire before that.
Can someone please provide some advice if that's the case?

My PD is Jan04 in eb3 catogory and I am from India. Currently I am working under EAD . My wife recently got job offer and her company is ready to file her labor under EB2 category. My question is thats ? will that be a problem when she files for 485 based on her labor since she already filed 485 based on my labor . Any suggestion is appriciated .

Please help me to get out of this confusion.
My H4-H1 Adjustment of status is approved and i have Advance parole and EAD with me through my husbands i485 application.I need to travel to india in jan/feb 2008 for 2-3weeks.I may not be able to go for stamping at that time.My H4 visa stamp is valid till sep2008.My H1 approval notice is valid till sep2010.
My question is,can i travel to india and come back without H1 stamping using Advance parole?If i come in using Advance parole can i work again on H1 or do i need to use EAD?

I moved to a different place (same city), but my wife is out of country. I am trying to file AR-11 for change of address, but it is asking for Last Port of entry. Is AR11 needed only for people who are currently in the country.
She needs to fill-in new address in the I-94 form at the time of reentry into the US. She won't need to file AR-11, as her I-94 has most recent address.
Please verify this with your attorney.

Can someone explain how the lawyer files I-485(Does she e-file? or mail it to USCIS?) and how we know about it? How long does it take to know you have filed it? and how do we know about it?Lawyer mail the package to USCIS. Good lawyer tell their client tracking number and then send email with case numbers and copies of receipt notices.

You can change the job peacefully using AC21 since your 485 is pending for more than 6months. Your labor position/location etc doesnt mater. Your current employer cannot do anything but you need to get a copy of labor and I140 from him to use AC21. Also your next job should be same or similar to the one in the labor certification. Hope this helps.

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. does the employment letter have to be exactly in the same format as described in 'filing your 485 on your own thread' or can it be a simple letter stating the job title, salary, responsibilities etc?........is it ok to file 485 on my own eventhough the rest of the process was handled by attorney?.......for any immigration matters my company just forwards me to their lawyer.......and there is chance the lawyer might get pissed off if I file 485 on my own.......any ideas?
