Hi all:
I entered the country on Advance Parole and so now I am on EAD status because of that.
I am on my 8th year of extension. My H1B was valid till 2009 but now it is not because of my EAD. Its been more than a year since I applied for 485 and My I-140 has been approved.
Q.1 Can I join another employer based on a new H1B so as to reinstate my H1B status? I plan to file for AC21 if I change employers.
Q.2 Can I apply for a new H1B with my CURRENT employer based on my current job?
I would really appreciate your input.

No, you can not work on 1099 for any other company.
Yes, the only option is work on cash.

if 1099 is not feasible.. the only option is to get paid in cash..which i dont want to do..

I lost my job about a month ago with fortune company where I had my H1 and then I filed to transfer my H1 to the GC filing company. It got approved last week. They even seem to have sent the I 94 with the H1 approval.
I have a visa from the earlier company(fortune company) till dec 2009 in my passport. Do I now need to get a fresh visa again with the new (GC) company that has sponsored my H1. Or is the visa validity in my passport is good enough to work even for the new employer?

I got EAD cards at my new address, but no FP notice yet. Have I missed that or USCIS might not have sent it yet?

Call USCIS and find out. As per my knowledge, USCIS does not update it online once they send out the FP notice.

Hi ,
I'm on H1B. Recently I joined new employer and the transfer is still in
pending status.
Among the documents required to sponsor for B2 visa, I'm supposed to
send copies of I-797 and I-94. I have old employers H1B approval notice
and I-94, but not of the new employers. I have the H1B receipt notice
related to the new employer.
Is it fine to sponsor for a B2 visa and for the visitors to attend the visa
interview in the US consulate with all the other essential documents
including new employers H1B receipt notice without the new employer H1B
approval notice.
Any of your valuable suggestions are welcome.

You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...
Cheer up...

I am also having EAD till 2011 June.
I have been with my employer all along.... and prefer to stay with same employer till GC.
I DONT want to apply for my H1 extension since they are asking lot of questions like Contract details etc with RFE's.
My Q is - Can i use EAD with my EXISTING employer or EAD should be used for only NEW employer based on AC21?
If i use EAD with my current employer, should i have to inform uscis(any process involved)?

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. My friend has I-140 Approved Petition under EB3/Dec 2002.
Another employer offered him an approved Labor (EB2/July 2006) which enables him file I-140 immediately and upon I-140 Approval, he would file I-485 using his existing Priority Date (Dec 2002) along with H1B extension (Attorney advised him not to file concurrently as it may confuse authorities).
He is in the 8th year of H1B.
How risky is this business if skills on approved Labor are not fully matching with the resume?
Also, the new company offered him to join only after I-140 approval. Not sure what are the things scrutinized at I-140 and I-485 stages.

I am planning to use AC-21 provisions to change jobs. My new employer is going to use ICE MILLER in Indianapolis to process my H1-B transfer.
I was wondering if anyone could share his/her experience with their staff and general suggestions. I would like to use them for any RFEs or filing any AC-21related documents.

If you are maintaining H-1B status, you can file for status extension and will get new I-94.
If you are using EAD and have I-485 pending "status" then I-94 extension is not necessary.

How long is the typical wait?
See visa bulletin. Your case is Family Based (FB) 2A. Currently, it is at 01APR06 (i.e., the applications that USCIS received before 04/01/2006 are eligible to be approved). You need to study how quickly the dates move by going through VISA bulletins in the last 3-4 years, but my guess would be about 5 years.

while applying, is it true that my wife can't enter the US?
AFAIK, not on the basis of her GC application, but if she gets another (dual-intent) VISA, say H1B, then she can enter US.
