That article is a joke and more like propaganda. It says around 58K H1Bs are issued and most of them are extension - but are they not aware the extensions are not counted towards the cap...?

I am in the same situation. They say once you start using AP, H4 becomes invalid....my wife IS working on EAD, she was in India for a while and came back on H4, again resumed job on EAD...then we renewed her EAD and put her current status as H4.........no issues whatsoever.
Use EAD, travel on H4......live life. I do not see any issue.

The only reason I want to still enter on H4 is that my H4 is stamped until 2010, hence why not use it and save money and hassle on AP entry. As you have said that working on EAD immediately invalidates the H4 status. This is OK for me, but at least I have avoided the AP procedure stuff. Plus the primary applicant is on H1 and hence we both can enter on H1 and H4 respectively rather than one entering on H1 and the other on AP. Let me know if this clears your doubt and if so, can you think this would work out. Also, if you can, please respond to my other questions

I wonder how it would stand the scrutiny of the conference. I am puzzled as to why they had to sneak-in legal immigration provisions in the last minute.... Is it that controversial ?
Manager's amend. are those amend. which are non-controversial and have been agreed to by majority bi-partisan senators. People who are calling the manager's provision as "sneaky," etc are against any immigration. This is another pretext to beat the dead horse.

Senate just didn't have time to discuss all the amendments and provision. This issue about who will have how many amendments was a problem issue from the start. After the motion for cloture was filed they had to end the never ending discussion and pass the bill. CIR bill was 641 page bill, addying 115 more pages is roughly 20% more. Also you need to look at the number of amendments not just the number of pages.

I would suggest not to risk renewing your passport in India just because you don't know if you would get stuck for some odd reason or another or not. As many have already posted on this thread - do it in the US if you have the time. I did my passport renewal from the SFO office a couple years ago and it was a simple straightforward process by mail (2-3 weeks).

No visa required with GC. But, since I only had my AP, they asked me to get a Mexican visa ($36). The above rule must be new (no visas needed with non-immigrant US visas).

I find Ron Gotcher's website very informative. It�s your choice not to read or to disagree with the speculative part, but he definitely is doing a fantastic job of educating the immigration community by answering the simplest of questions. I don�t care if this is a marketing tool for him, but I get a huge relief on the verge of getting laid off, when he quotes from the law-book to assure me that it�s ok to be unemployed after AOS. He takes the time to do that for me. There are not too many out there doing the same!

In the thread you should find the process of contacing your local USCIS office to have your I-94 updated.

He specifically told me that he cannot stamp the date of the future I-797's expiry date (Jun 2010) and asked me to contact my local office just before the current visa expires. My current one expires June 04 2007. The future 797 is valid from June 05 2007 till June 04 2010. But my visa stamping in the passport is till June 04 2010.

Without any changes to the current system, How many of us will be in a similar position in 3 yrs time?
I am only asking this question since we all know how many of us are in the queue with PDs in 2001-2004 range. If 2800 per country EB category get out of this queue then, absent relief, this could easily be us in 3 yrs.
