    I was exactly in the similar situation. My wife entered on H4, started work on EAD. Now we are traveling to India, both have AP as well as H visa (H1 for myself, H4 for wife). I talked to our corporate lawyers pretty much the exact same questions you are asking. Here is the response (that I have in writing from the lawyers):

    1. H4 status is invalidated the first day you report for work on EAD. While you are working, your status is AOS in the US. There is no consequence of this change (ie you do not have to report anything to the USCIS).

    2. When you reenter the US, you can use H4 for reentry. (Yes, even if you are still employed the employer with an EAD and went to India only for "vacation"). This is because at the point of entry, the definition for "working on EAD" is actually reporting to work. As long as the H1 is valid, you can enter on H4. Your status at the point of entry is H4 admission. However, if you report to work the next day, your H4 status again is invalidated and you are back on AOS.

    This is a pretty confusing scenario for many and multiple lawyers that I consulted have agreed with the above legal advise.

    So, even though we have AP, we would be using our H visas to enter.

    The ICE, USCIS and DOL are there and very much capable to take care these scams. So if you have any information about the fraud...contact those authorities. We don�t have anything to do with that. Otherwise please get lost.

    Indian companies like Satyam had been running these farce show of outsourcing for long time, and finally the reality is surfacing up. Not only did these companies run scam with their investors but also with their clients and employees.

    As a client I see them initially low balling the real cost to obtain business and when the in-house engineering capabilities have been eliminated, they will start jacking up the prices. L&T did this with us and thankfully this month we are finally kicking their a$$ out of our facility. And we will do real engineering here in USA!

    Couple of years ago, I ran into an indian at one of my visa renewals outside US consulate and he told me how, Satyam forged papers to have him slip into USA on L1 and than once here convert into H1 so he can finally apply and obtain GC. All these years he worked for remarkablly low wages.

    I will be calling today in the morning and have told several of my friends to do the same. whenever I get a chance at parties or get togethers I tell people about IV and I was surprised that 80% of people (who are stuck in this mess) have not heard about IV. so I would urge everyone to mention IV whenever they meet anyone who is in a similar mess ..especially inform batchmates and new friends and ask them to atleast register

    My experiences have been similar. Not many immigrants I meet at social / cultural venues know about IV. I would urge every member here to actively spread the word of IV and membership at every possible and appropriate occasion you get in a face to face manner at your regional / national cultural associations / festivals / functions / events / summer picnics etc.
    And more important is to call as per action items, so please take a few minutes from work to call.

    Get your degrees evaluated by the certified evluators and add your experience to be qualified or you can go for EB 3 but your priority date will remain the same. A friend of mine was in the same boat, but had 3 years commerce college and 2 years MBA from UK and was in his 9th year of H1, I 140 was denied. He appealed and REAPPLIED I 140 with all the evaluations, he got approval in less than a month but EB3 with the same old priority date.

    Thanks for your update Ramesh. My labor substituion is EB2. Prior to the filing I have 12 years of experience with 18 years of education. Now going for EB3 is filing a new labor under EB3 or file a new I-140 and say it is EB3 and not EB2. Could you please help me by providing more info on this?

    all that stuff comes in at I-140 stage. During PERM/LC they dont care about his qualifications, its the job that is being certified.

    See the audit questions again, all relate to justifications that the requirements are really needed for the job advertised. ie. when the job ad said MS+2 Years is needed, DOL wants to know why this job requires MS+2 Years of experience. His lawyer is right, a more conservative approach to job requirements (MS+0 or BS+5 for EB2 is much more easier to defend). As you increase the minimum job requirements, it reduces the pool of available candidates who can apply for the job. DOL wants to make sure the minimum requirements are really valid, and not set artificially high simply to reduce the pool of candidates.

    Basically your LC sponsor needs to be able to justify all requirements posted for the job (education, experience, specific skills) else you can be in trouble.

    Yes audit questions seem to be hinting screw up from employer side but then also it can not be judged exactly on the same line without going into detail of provided job classification, job requirement and furnished docs from employee.Now all of the areas you mentioned are crucial from employer side and in addition to that "employee's degree" evaluation is also done at labor stage,(PERM or OLD LC).     Now logically screw up can occur at one of the two or both segments. "Employee side related docs and process" and "Employer side docs and process". I was kind of trying to know whether poster might not have screwed up anything from his side. You covered the areas "from employer side" - whether it may be business necessity and/or recruitment results. Now if employee's docs have conflict with any of "business necessity" for an example evaluation cert depicts MS (Electrical Engineering) and "business necessity" is to hire "MS (Computer science) then also it could create the problem. In such case employer/lawyer if can establish that MS (Electrical) can also that job then matter is finished..

    Not really, broadly speaking lack of information can never be a benefit to consumer. (Read: hidden clauses in agreements). It might be that they have been doing that and we don't know. You will ONLY know if you apply for another H1B transfer or any other application say I-140/I-485 with new employer and then USCIS MIGHT tell you that your I-140 is revoked on MM/DD/YYYY and you are no longer in valid H1B status since then. That would be too late and it is not retroactive. Remember that onus is on you to maintain valid H1B status all the time during the period of H1B. Once again I am not saying what I mention above is the correct interpretation of law, but in the absence of any clarify it can be one of the implication.


    then it is to our benefit that they dont clarify it for as long as possible, bec normally any decisions are not retroactive but only for cases going forward.

    All I am saying is let's put practicality into matter. USCIS IOs are human who make mistakes. If you put the IOs into situation where they can potentially make mistakes, then they can potentially make an error, be it to your advantage or not.

    We've seen some cases where IOs are committing mistakes, haven't you? And aren't we learning from that or not?

    At the end of the day, it is your choice. I have chosen my path. You have chosen yours. We both follow the rules of the game. Let's see each other at the finish line.

    One approach I can think is to meet officials and explain them to automatically disable the employers from doing so...An approved 140 should not be allowed to cancel, once 485 is filed and 180 days passed. This will stop the wastage of resources and help to improve efficiency for CIS. Is there a chance we can convince this??? more on the side of administrative fix???

    How about making an official AC21 form (like we've AR11 for address change)? CIS can charge a small fees to file for AC21, it will guarantee candidates that their AC21 application has reached to CIS.

    Thoughts?
    Employer has to show that he can support all the employees that have an 140 pending. It cannot be attributed to being sadistic alone.
    However, having an official AC21 process would be good.

    While no doubt, getting PERM approved is difficult at this time, it's not impossible (I have a few close friends who got them approved recently in EB2 though they had to wait a long time for it) and giving it a shot is well worth it if things work out in OPs favor.


    I think ur friends PERM got approved becuase they filed before this economic depression. meaning, when the recruitments efforts were made for your friends case there is not much unemployment and might not have received any resumes. And I believe DOL check when the labor filed.. not current time.. while approving or denying it. So as some one mentioned now its not the case.

    Your BE degree will be considered equivalent to guys who have 12 + 4 from India. After all you have a fulltime 16 years education with same degree that 12+ 4 guys have. I think AMIE is getting the flak because its considered part time degree ( I know how difficult it is to manage job & AMIE studies) but that is how USCIS is interpreting it at the moment.

    I have applied for I -140 (EB2) but I am with 10+Diploma(3 years) +Bachelors of Electronics from Mumbai Univerisity(3 years).

    Is it considered 4 year degree and good for EB2 along with prior 5 years of experience?
