If a bad person who is going to fail a name check is already in the country, then name checks are not going to deter him from doing his thing. Just because a name check is pending without a GC means nothing to a potential bad guy.
If a foreigner tries to become a governor or tries to join a govt agency he goes through a lot more special screening than just name checks. It should be up to the FBI to fail or pass a name check and all benefits should be revoked if the FBI fails a name check. This is going to be rare and there is no need to fight the battle for somebody who fails a name check (which is where your argument is so extremely stupid). It happens in other spheres too, sometimes people lose their jobs after many years if the company finds that you falsified information like degree etc.
I am not going to stretch this discussion beyond this as it seems to me spiraling out of limits of reason. My laywer ( a known one, but not the regulars here) also didn't include EVL. When i asked him about it, he said whether we include it now or not, they will issue an RFE at the time of adjudication. I was content with that, but after reading about it more here, i pressed him again about the issue and the new memo. He said he does not foresee a denial because of this, but if i'm worried we will send the EVL along with a cover letter and the RN. But filing another 485 is not advisable. I'm working on the EVL, and once he is less busy after Aug 17th i will ask him to send it. And i hope it will make it to the right file if we include the RN and A#, just like replying to an RFE.
btw, to answer #1, i did get RN so i would think the case may not be outright rejected for missing evidence. I did FP and my LUD was changed for 485 and 131. I filed 765 later and that also has an LUD after FP.
Thanks for your inputs on this issue. I agree, this is the minimum one should do (sending EVL with A# when it arrives.)

Got the CPO ordered email on 09/16/2010, updated to Post Decision Activity on 09/17/2010 for both primary and derivative.
Got FP appointment scheduled in the first week of Sep, but gave it earlier ( last week of august)

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. "Advance parole is an extraordinary measure used sparingly to bring an
otherwise inadmissible alien to the United States for a temporary
period of time due to a compelling emergency. Advance parole cannot be
used to circumvent the normal visa issuing procedures and is not a
means to bypass delays in visa issuance."
If I mention: "I plan to travel outside of USA for family reunion" in the I-131 cover letter, do you think I will got denied because this reason is not "compelling emergency" at all?

advance parole." ?

Most of the hype is being created by the immigration law firms and attorneys, rather than DOS or USCIS. They are after the dough!
The news might just bring relief to many people, but look at who is creating the most of the hype - it's attorneys.
The comments in this update kind of seem contradictory to me. It says that there might be possibility for greater advancement than earlier thought... and then they talk about moving it back.
Whatever it is..I don't know why they are creating so much publicity about this bulletin. Does it mean they are going to advance the dates by a couple of years??? If it was for a few months why would they create so much hype about this?

Recieved a standard reply letter stating, thank you for your inquiry and you can track your inquiry through our tracking system. It is dated Nov 06 2008 A.M 01 and is attached to the letter we sent along with the envelope. I don't know if anybody else has recieved the same reply. We will have to see what we receive from other centers if we receive one. Thanks

Yes you are correct.
I dont know about the Govt and bureaucrats and political aides - maybe they have big attention spans - but i know for a fact if someone in a corporate structure receives such a long letter as proposed originally- most would not have the patience to read it. Maybe, the handwritten and personalized part should be:
1. I am XYZ - educated at ABC and work in DEF sector. Been in US legally for XX years - no able to buy a house, progress in career, start my company etc for not having visa certainity.
2. While we wait anxiously for comprehensive reform - the following administrative fixes can speed up the processing backlog, specially for some countries like India, China etc

Highly skilled immigrants have been a key stakeholder in keeping America competitive and your leadership in providing relief to this segment through these fixes would ensure that the best and brightest from around the world continue to be attracted to America.
I am also enclosing a detailed write-up on this issue for your further reference and I look forward to your urgent attention in this matter.

Called the DOS. Told them I need to travel to my home country and asked them if they can verify if my information is in PIMS. She asked if the H1-B is an extension case which it is. She said the extension cases are taking a bit longer than the new ones. That is quite surprising. Finally she looked in the database or whatever and said they do not have my extension information yet. All they have is the information from the expired petition. No timelines just asked me to call back in a week.:rolleyes:

ok.. the letter is dated 4th august and did you get any information again that your case is assigned to a officer? if yes can you please tell how you contacted them? and after how many days?
I called the regular 1-800 number as soon as I got the response to the SR. Told the 1st Level that the statement in the response saying to wait till Visa is available seems to be wrong since the visas are currently available. The Level 1 agreed and transferred me to the Level 2. Level 2 confirmed that my case was assigned to IO on July 27. She said my case is probably delayed bcos of FP not being latest. Wonder if there is a way to trigger FP?

My Point is more long term - in the shorter term no major change can happen to economy even if Barack wins but eventually Economy would be stronger under Barack's leadership. He also stressed that he would stop "JOBS BEING SHIPPED OVERSEAS" which means companies like TATA or INFY or some Chinese company taking my Job ( or any American's Job ) away from US to INDIA or CHINA. If you are planning a future in US - you would not want your US job taken away by your brother at INDIA or CHINA and Barack will make sure that doesn't happen.
The Bottonline is he will create tons of Jobs at US , so unemployment will be very low , average peoples will be happy and however loud ANTI-IMMIGRANTS scream and shout no AMERICAN will pay attention. Our EB reforms will Pass much easily and we will be able to able to lead a much happier and content life with GREEN CARD.

Today I called USCIS and finally got my wife's and mine I-485 receipt numbers. My attorney has not received anything. I am looking forward to seeing some action for others pretty soon. Guys, I wish you very best luck!!
