Since the forecast is EB2-I will be current in a few years. Does that mean that someone with a PD of 2009 (EB2) would get the GC faster than someone with a PD of 2004 (EB3)?

One question to all the smart people on this forum:
In the old system, if EB1, Eb2 and EB3 ROW are current then "all" unused visa from all the EB category be given to which category first:
a) EB1 Non Row
b) Eb2 Non Row
c) Eb3 Non Row
d) None of the above
Now second part of the question is :
If that category already has enough people in line, will the spillover to the next category will take place:
a) Yes
b) No

Thanks guys .... for coming behind me .. Shane Warne or Purple Haze won't satisfy you guys .. Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).
Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.

I think the fact that you had same A# helped you despite multiple filings. There are cases of people where even though they have declared their second application, USCIS assigned them a second A# number.
Pls. Stick around in IV and help others with your knowledge.
I have received two A#s since I submitted a second set of AOS (first set had a number of omissions and I did not want to miss the boat).
I think there is no reason to lose sleep over this issue (actually I was told so by a renowned lawyer with whom I just did a consultation), and there is not much we can do anyway. Except... if possible we should send a letter to USCIS telling them about these two sets of applications and then asking them to choose the one which is approvable (again, I was told so by the same lawyer).
BTW canadian_dream: heartiest conrgatulations on your green card approval, your posts on the multiple filings issue have been very helpful.

Finally, we got the approval emails for self & wife.
I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-
1: The review was complete
2: Visa numbers were requested 2 months ago and all security/prints are current
3: Files have been forwarded to officers for completion.
In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.

I dont understand why DOS/DHS/USCIS will not do anything RIGHT NOW and wait till July 2nd or 3rd??
They are probably wrangling right now...also it is possible that legality requires any amendments only to be published in July...not earlier..

The pain of waiting for 9-yrs is nothing compared to the wait now (after dates got current)...Refreshing my yahoo mail on iPhone atleast twice per hour, Clicking on Safari where the last visited page is that of case status online (Click the status btn frequently) --- Life is difficult :(

Tried calling USCIS they don't answer properly.
Lawyers saying can't do anything but wait and watch.

Here is a list of things you can do to protect and improve you cash cushion (and may be avoid foreclosure)
1. If you drive one of those luxury cars that cost upwards of 25K and have paid it off. Get rid of it now. These cars depreciate more in dollar terms compared to cheaper cars. Buy a less expensive, no frill used car for 9-10K, put the difference in bank. That might bring in 10K of much needed cash. Even if you have not paid it off look for deals to sell and reduce your monthly payments.
2. Open an account at quicken online (http://quicken.intuit.com/online-banking-finances.jsp) it is free. Connect your banks and monitor ALL your expenses carefully. Find out what portion of spending is discretionary and cut down on it.
3. Hunt coupons, shop at Costco/Walmart (even if you hate the shopping experience). Avoid brand names and stick to Kirkland/Great Value. This might save you in monthly expenses.
4. Also, you can add cash by working part-time. I am not talking about those hard to come software moonlighting jobs. Any job that pays 10-12 an hour will add 12 x 4hr x 5days x 4 Weeks = $960 per month.
5. If you live in a duplex with a bathroom/bedroom downstairs, you can rent it to someone from local college/university. Underbid by quoting super low rent on craigslist and you can get $400-500 per month.
6. Use online services like LegalZoom (or Prepaid legal from work) to prepare contracts for rentals etc.
7. Cut down on travel/eating out and anything that you can live without. A little cash could go a long way.
Also, when it is hard to stay put and make payments, always remember there is a silver lining in owning a house too. If there is a hyper inflation (which is very likely) rents will sky rocket and salary might go up to keep pace with it, but your home mortgage frozen in time for next 20-30 years will remain unchanged and you could potentially have lower monthly expenses compared to renters. That's a bright side of staying put.

I got the RFE at last. I invoked AC21. The RFE for me is asking for 2 evidences
01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that
02. Submit current dated EVL for your new employer. No issue. we can answer that

02. Provide her non-immigrant status between Feb 2003 to Jan 2004.
I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.

Absolutely.
Dobbs has made Spitzer an almost daily target over his recent plan to ease restrictions on illegal immigrants seeking New York state driver's licenses, mixing vitriol with sarcasm while endlessly lambasting the governor's decision.
The lifelong Republican has taken on politicians of every stripe, as when he blasted the Bush administration over port security. But his nightly diatribe against Spitzer is notable for its intensity, and for elevating a state proposal onto the national stage.
"What he's doing is an outrageous, arrogant abuse of power," Dobbs said in an interview before a recent show. "He's pandering to a constituency aligned directly against the interests of U.S. and New York state citizens."
Dobbs's ire boiled over Tuesday night when he ripped Spitzer as an idiot _ and then offered an on-air mea culpa.
"I'm the idiot," Dobbs said. "Governor, I apologize for calling you one. Your policies are idiotic. But I have to apologize for calling you an idiot."
Dobbs shouldn't hold his breath waiting for a bouquet of roses (the state flower) and a thank-you note from Spitzer.
"Mr. Dobbs has clearly demonstrated that he is not interested in a real debate on New York's driver's license policy change," said Jennifer Givner, a Spitzer spokeswoman. "He has repeatedly refused to offer balanced coverage of the issue."
Dobbs has turned the first-term governor into a verbal pinata over his September announcement that illegal immigrants with valid foreign passports could obtain a driver's license.
Spitzer has said the plan, set to go into effect this December, would make New York safer by bringing its 1 million illegal immigrants "out of the shadows."
On Saturday, Spitzer cut a deal with the Bush administration that would still allow the state to issue licenses to illegal immigrants _ although the agreement required that their licenses would be clearly marked to indicate they are not valid federal ID.
While advocates on either side of the flap said Spitzer had backed down, Homeland Security Secretary Michael Chertoff was still upset by the state's decision to license illegals.
The Spitzer decision reversed a 2002 order by former Gov. George Pataki issued after the 9/11 attacks, and placed Spitzer directly in Dobbs' cable crosshairs. But Dobbs, while perhaps the highest-profile critics of the plan, is not alone: a state poll showed 72 percent of New Yorkers opposed Spitzer on this issue, and New York Mayor Michael Bloomberg has also expressed skepticism.
Spitzer, in a speech last week, noted that "despite the hysteria this policy has created in some circles, it is simply a return to the policy we had for most of our state's history."
Dobbs is hardly swayed by the history lesson, complaining the relaxed license requirement could produce voter fraud and raise security issues. Spitzer has ignored repeated invitations to appear on the program, Dobbs said; the show has turned down guests supporting Spitzer, including former national counterterrorism adviser Richard A. Clarke, according to Givner.
Dobbs, who has made immigration one of his show's centerpiece issues, was criticized this week in a New York Times editorial for his Spitzer bashing.
"Mr. Dobbs has trained his biggest guns on Mr. Spitzer, branding him with puerile epithets like `spoiled rich-kid brat' and depicting his policy as some sort of sanctuary program for the 9/11 hijackers," the Times wrote. "Someday there may be a calm debate, in Albany and nationally, about immigrant drivers.
"With Mr. Dobbs at the megaphone, for now there is only histrionics and outrage."
Dobbs isn't expecting any apology from the Times. And he has few kind words for the newspaper.
"The New York Times is the house organ for Gov. Spitzer," Dobbs said. "They're wrong on this issue, as they are on many others."
Dobbs draws a nightly audience of roughly 800,000, making him second in CNN viewers to Larry King's nightly program. He has no intention of lightening up on Spitzer.
"Why should I?" Dobbs asked. "He's wrong. This issue is of vital importance to the state of New York and the nation. My job as an advocacy journalist is to confront directly abuses of power and wrongheaded politics."

Sec. 1571. Purposes

The purposes of this subchapter are to -
(1) provide the Immigration and Naturalization Service with the
mechanisms it needs to eliminate the current backlog in the
processing of immigration benefit applications within 1 year
after October 17, 2000, and to maintain the elimination of the
backlog in future years; and
(2) provide for regular congressional oversight of the

Hello,
I have heard of the TERM 'Interfiling' to port your priority date from EB3
to EB2. This i hear happens when your 485 is pending with USCIS and
you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.
Any one any thoughts or have you done this ?
