Hi-
My spouse recently started working on F1 OPT. She also got her H1 approved (port of entry was requested and not change of status). H1 was through lottery to start from oct upon stamping. Suddenly our PD moved forward and we will file 485 next month.
We are going to India in dec. By that time we should get our AP. My question is does my wife need to go for H1 stamp or can she enter using her AP and keep H1 status. Both of us have different employers. Her 485 will be filed as my dependant.
Secondly - I will also get a new EAD. Can I work second part time job using that ead while maintaining my permanent job using H1?

only talk to Immigration information officer. if none or available then it goes to regular Contractors workig for USCIS who will say we received the Application on date Blah Blah.

With new DOL policies and increasing immigration and labor standards enforcement, approval rates for labor transfers are down drastically. AILA reports even approval rates for PERM are down to 62% from the 80% approval rates seen earlier. Be careful, and have another parallel 'regular' filing so in case your sub labor gets rejected you don't loose additional Piority Date time.

In my employer company (NJ based, desi consulting company) about 50% of the EB-2 PERM applications are under audit.
I need to file my application for EB-2 and I called them. (I have a EB-3 approved labor, on which my employer has filed I-140)
The paralegal advised me that they have stopped filing PERM applications since this month March 2008, hoping that there would be change of PERM processing or application change.
Does any one have any info about PERM change process? Please advise. Thanks in advance.

Hi..
i am currently on my 8th year h1..and on the bench..hoping some projects will come thru in a week or so.
Currently i have been on LOP for almost 5 weeks now..
what do you think would be a good option for me:
a.) Start the process for H4..and find a new job..and transfer H1 and stay till H1 is valid till may 2010..
b.) Be on bench for few more weeks.. and hope someting will work out...(firm has said they wont cancel my h1/140).. they are just being helpful..but?
c.) R2I ASAP...and try for a consular processing....?
d.) go to H4...and R2I in May...then if the Eb2(Dec 2005) dates are current..try for a CP..its a long shot...

Now the PERM takes 2years... whats the difference for new guys? My friend stuck in labour for almost 15 months now. got RFE, replied to it and stood stand still..
But this helps for someone who filed during July'07 fiasco and waiting though. I got mine approved in late feb'09 (filed in July 07).
Something is better than nothing.... :-)

Some 63,000 flights had been canceled in Europe by the end of Sunday, in the four days since the air space of northern Europe was shut down by an enormous ash cloud from an erupting volcano beneath the Eyjafjallajokull glacier in Iceland.
Passengers are scrambling to find alternative travel routes. German tourists are being bussed home from Spain, while the Royal Navy is sending military ships to Spain to bring home stranded Brits. Thousand of Europeans are also stuck in the US with no option to leave at this time. Many visitors are worried about the implications of not being able to leave before their current status expires.
Foreign nationals stranded in the U.S. because of the airport closures in Europe due to the Icelandic volcano eruption and who are about to exceed their authorized stay in the U.S. have two avenues for relief. If at an airport and traveling under the Visa Waiver Program (VWP), they should contact the U.S. Customs and Border Protection office at the airport. They may also contact the local U.S. Citizenship and Immigration Services office. Both Department of Homeland Security agencies have provided their staff and offices with guidance on the applicable legal authorities under the VWP in circumstances such as this.
Persons traveling under a visa should contact the nearest USCIS office and follow the instructions below. While these instructions recommend initiating the process 45 days in advance, USCIS is providing reminder guidance on how to handle such cases until normal flights are scheduled between the U.S. and foreign countries affected by the Icelandic volcanic activity.

No you are not required to file a separate petition for your husband. When your sister files the I-130, she needs to put your husband's name on the same form.
When you file DS-230, Each family member that is eligible to travel to the United States with you under this visa classification is required to complete the DS-230 Part I. So separate DS-230 are required for you and your husband.
1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older;
D. Your married son or daughter of any age;
E. Your brother(s) or sister(s) (you must be age 21 or older);
F. Your mother or father (you must be age 21 or older).
