yes enter till 2010 , if u can see on the left of yr 797 the i94 number might be same as yr white card ( provided u have not gone out of country ) .... that will mean that yr white card validity have been increased till 2010

Hello, I can understand your pain as I was in a similar situation as you are. I would recommend to wait for atleast 2 weeks. I interviewed on 28th Dec and finally got the email on 9th Jan and the pp stamped on 10th Jan and took the flight on 12th Jan.
If you have an upcoming travel which is in next week, please try to reschedule it as it is not certain on how much time does it take in such cases.
I do not think getting the employer involved into this will help. VFS office will have no clue on this and they will answer only Questions on the process. Writing to the US consulate will also give you a general answer. It is sad that there is no accountability in cases like these. Please keep the faith.

I know the chances of including such a question are really slim, specially with the sponsors they have. However, if a lot of us ask similar questions, maybe they might bring it up.
Also, one might argue that even if they pose the question its not like all the backlogs are going to be eliminated. Thats not the expectation here. The idea behind this is to create an awareness and start people/media talking about problems of legal immigration.

yup - i got duplicate CPO emails as well - one on sep 1 and another on sep 2. The LUD date also changed from sep 1 to sep 2 after the 2 updates. Today i got the 485 approved email.
Dont have the GC in hand yet - looks like none of the folks who got current in Sep have received their GCs yet. Speaking to some folks who got current last month, it seems like most folks had GCs in hand within 10-15 days of the first status update regarding CPO.

I don't think it will do much good sueing uscis on this issue. The point is, they have the legal authority to be the one interporating the law. So, if there is "gray area" in the law, the law says it is their understanding that matters, not ours or any one else's. So, unless the law very specifically says it must be done in another way, you can not argue uscis did the wrong thing.
Now that we see the immigration law does not very specifically regulate how the flow should be like, so uscis have the authority to "understand the intention of the law" and act accordingly. You can't say you think the law means otherwise and thus sue uscis, because that argument makes no sense to the court. The court will only accept the argument when the government is apparently acting against the law.
Absolutely, I have seen misleading comments especially from EB2 guys. EB3 have to do something otherwise there is no future for us here. Now EB2 line will never end bcoz all new applications will come as EB2. Hoping for spillover after EB2-I becomes current is just a dream now that never comes true.

I think if number of employees are less than 50 then 50% rule will not be applicable(according to 2007 proposed bill). It may be similar to that.
But are n't they proposing 50 % rule.. how can a small desi company afford 50 % US citizen staff ? That is why may be people think consulting companies will not work.
but what I think is it will make them less profitable. Very small body shoppers will go out of business. Med to large indian owner based consulting companies will be less profitable.

According to the report of AILA, State Department had exhausted FY 2010 immigrant visa numbers as of 09/16/2010 for the following preference categories and the State Department would not allocate any immigrant visa numbers to the visa posts and the USCIS for these categories during the period. The affected preference categories include all family-based preference categories, employment-based preference categories of EB-2, EB-3, EB-EW, EB-4 and eertain Religious Worker categories. The State Department will keep taking immigrant visa number requests from the visa posts and the USCIS even during the gap period but the State Department will not be able to allocate the numbers until October 1, 2010 or thereafter when the new FY 2011 immigrant visa numbers will become available for these preference categories. There may be some cases for which the USCIS has requested and the State Department has already allocated the visa numbers before 09/16/2010 and these I-485 cases will receive approvals even during the cap-gap period. However, in general, I-485 applicants will witness either a slow-down or vacuum in receiving I-485 approval notices and news until October 1 or thereafter because of the gap. The gap will last only for about two weeks and I-485 applicants should keep patience during the period.

I got only one set of A# for both the applications. When I filed my second application I didn't have my A#. But we have mentioned clearly that there is another application that is filed on behalf of same applicant on MM/DD/YYYY.
I am seeing people getting multiple #A numbers and delays.

Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

I doubt things would have materialized if i just kept waiting and here is why.
July 12th: I opened a SR to check on my I485. Purpose was to see if Namecheck was cleared. I wish USCIS gave me that info easily on the website.
July 29th: I get a response by email that they cannot find my I140. I was told to call back with I140 receipt number. This is a bizarre response as i don't know how they accepted my I485 in August 2007 when they can't find my I140.
So i call back and i was told to wait 30 days from July 29th to give the I140 receipt number since its not been 30 days since first receipt. They were counting 30 days from response they sent on july 29th. Now what do i do?
Aug 3rd i went to Infopass and showed them my I140 and I485. They told me i can see your I140 but i cannot say whether this is the I140 linked to I485 because case is at NSC.
So i went to my cognresswoman and based on her enquiry, the PD linked to my I1485 on USCIS system was Feb 16th 2007 instead of Feb 16th 2006. Her office faxed the I140 approval notice and made USCIS correct this error.
I tried checking with USCIS through NCSC and Infopass to see if the PD and category linked to my I485 is correct about 5-6 times and never got a correct response.
If congresswoman's office had not helped correct the PD with USCIS i doubt my case would have even been picked up for adjudication.
Only good thing i got at Infopass was that during my last visit, IO was indian. She told me to write to NSC with a copy of I485 and approved I140 letting them know that PD is current for the past 35 days. She told me that she is not sure why its not been picked up for adjudication as Namecheck and fingerprints were valid and i was pre adjudicated. She was not able to find out if the PD and category linked to my I485 was correct.
When there is no clear transparency, i don't see anything wrong in contacting the necessary people to check on your case.
