hi all
I plan to probably file under the EB2 category soon- I know EB1 and EB2 can be filed separately, however can a EB2 regular and a EB2 with NIW application both be filed separately as well?
Need to know this asap, so would appreciate a reply, Thank You!
You can file as as many as I-140 and I-485 as possible at a time provided priority dates are current.

What was your I-485 receipt date (Note: I am not asking for your PD)

I called Board Protection Dept they said follow the latest date. which is Dec 05, 2009. anyone confirm?

Can I send my daughter to India for an year without having reentry permit?(she has greencard) (or) what is the maximum period children can stay out of US after getting greencard?

Hi,
I was among those randomly selected for further processing in the Diversity Immigrant Visa (DV) program for the fiscal year 2010. Since I currently reside in the U.S., I filed Form I-485 ("Application to Register Permanent Residence or Adjust Status"). Upon having my biometrics taken, I had an interview with an Immigration Service Officer at a U.S. Citizenship and Immigration Services (USCIS) office. Because of a misunderstanding, I failed to bring to this interview an original Form I-134 ("Affidavit of Support") from a sponsor. Please note that my parents and sibling recently became U.S. citizens and are willing and able to be sponsors.
At the end of the interview, I asked the Immigration Service Officer if I can provide Form I-134 after the fact and he answered no. He made it sound as though a person gets only one chance at an interview with an Immigration Service Officer. He gave me a sheet of paper that had the following ticked off:
"Your case is being held for file review to prepare a decision. You will be advised by mail as to a decision on your application. No additional information is necessary from you at this time, however, if upon further review, additional information or evidence is required, you will receive notice in the mail. Please respond to any request in a timely manner. Failure to do so will result in denial of your application Please allow 60 days from today's date before making an inquiry on your case."
Questions:
1. Is there a way I can provide Form I-134 after the fact? If so, how?
2. If my application is denied, can I appeal the decision? If so, what are the chances of winning such an appeal and still finish adjusting my status before the DV program for fiscal year 2010 ends?

Hi Folks,
I am currently on EAD and am applying for extension using e-file. I had a question on what do we fill in for 'Current Immigration Status'. The closest I can think about (as per the options given) is : DA - Advance Parole (Dist Auth).
Any comments?
Has anyone using EAD currently done an e-file for extension?

You can convert GC process to Consular Processing. AFAIK, that is the most lgal way of working outside the country in your situation.

My attorney is about to file my I-1485 this week.
My details:
Previous company:
Perm PD: June 2006 EB2
I-140 EB2 approved in Nov/2006.
Current company:
PERM filed: Oct/24/2007
I-140 EB2 filed on Jan/31/2008
trying to recapture the old PD of June/2006.
Today, when I checked my I-140 status, it says "Request for Evidence sent" yesterday.
What are my options now? I do not know if I am eligible to go ahead and file my I-485 now ? What are the implications if I go ahead and file my I-485 now.? Please let me know your ideas.

You are not limited to change job within the same corporation. However you are limited to changing the job within same or similar occupation.
Old company can revoke I-140 since it is their application. They can not revoke I-485 since it is your application. You may get RFE to show that you are still employed in same/similar occupation but that's about it. You don't need to start all over or lose your place in the queue.
