I understand your frustration. I have heard similar things from employers about hiring people on H-1B.
Are you just assuming or have you actually tried to find out if there is indeed some law which allows employers to not consider a candidate solely based on the fact that he/she has an EAD as opposed to a green card? I can certainly understand that you don't want to get involved in a lawsuit and pay lawyer fees when you can easily find another job. But its not that difficult to contact OSC.
Having said that, I do understand that the employer can find a number of reasons to not hire somebody and all that would be legal. But here we have a case where you have 5 companies who have refused to consider you solely based on your immigration status. Somebody earlier has this in writing from Capital One.
I urge you and anybody else who has gone through this to find out more about this by calling the OSC's hotline. (http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.

I am also from India but the point I am discussing here is clearly a violation of law by Outsourcing vendors including IBM (not just Indian companies), TCS, Wipro etc. I work for a medium size consulting firm based in US and on H1 visa ...and I am impacted by these violations and I think I have the right to oppose this act.... to prove my identity shud I tell you my stories in Chennai consulate... or shud I tell u abt my days in b'lore or shud I tell you all abt my 24 years in India.. you can decide :-).

Does the letter need to have the same information as the LC. I can get a non I-485 related employment verification letter but here is the catch. The employer is dilly dallying on filing for I-485. The employer can give a letter with my job title which is "XYZ Developer" include salary, length of employment etc. But the "Final Determination" copy that I have says occupation: Computer Software Engineers, 15-1031. Does the letter have to state "Computer Software Engineer" or can it state "XYZ Developer" ? If it has to be the former that will only alert them that I am bypassing their stonewalling and the employer is only likely to refuse to include that as the job title. So which is which ? The job specific title ie "XYZ Developer" or the DOL title per the "Final Determination"

Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.
Guys,
This is one of the key reasons why we are not successful in our mission. All we can do is "lets kill H1/L1 so I can get GC", "lets not worry about EB3 as long as my EB2 is fine!". The only way we can make any progress is to stay united. Lets not try to find carrots that would really be sticks on people who are also part of this cause.

Today I and my wife had an infopass appointment and were told that our I485 case is in Adjudication review and should expect an interview soon. I asked the officer is there anything wrong and he replied back that everything is fine. I am not sure what adjudication review is and why there is an interview if everything is fine :confused:
We also opened SR on 9/1/2010 and I got the response today for the SR request and it has the following details
"Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter." Does this mean that we will not get the GC atleast in the next 60 days?
Did anyone had an interview before or anyone know what should we expect in the interview.

If the job required a EB2 or EB3 but EB3 was filed earlier. Is that possible?

My stamped visa expired 1 year back and I am currently with H1B approval notice. In the 2nd page of I-485 form, under Part 3. Processing Information, I am wondering what I need to fill for the following columns.

This is a dumb idea. You want the US to give you Citizenship while you have an approved I-140 and AOS status??????? You don't even have GC !!!!
Do you even know the reason for the law that states you have to wait for 5 years after getting GC to apply for US Citizenship?
And what is this nonsense about boosting the economy because you pay mortgage?
Please don't waste time on this - GC confers enough benefits for you (and family) to be able to live and work in the USA without ever applying for citizenship. The only benefit you don't have is to work for some US Govt. agencies, to vote and no visa-free world travel (mostly) or sponsoring some more family members to take away more of the social security fund.
If you read the plan, you are essentially asking to by-pass all security laws and telling the US to sell you GC and Citizenship.
Simple: stupid and bad idea. Drop it.

As I said, people here are highly motivated and do want to follow the rules and achieve bigger things in lives, creating value in the process. But not many are willing to wait for 5 more precious years, after your greencard takes 10 years. Or 15 years on GC and 5 years for Citizenship. Once you work very hard, then you tend to ask for the right fruit, not just take anything.And whatever the Citizenship requirements are.. they will be met while waiting for theis damn GC..
I am just hitting at the attitude.. not person.. sorry...
Assume your school makes your 4 year course extended to 6 years and in the process makes you do a lot more..What do you ask at the end of it. 4 year degree or a 4+2 year degree.. .something similar..

The House Judiciary Committee intends to markup HR 5924, the Emergency Nursing Supply Relief Act, on Wednesday, September 10. Several other measures will also be marked up, including HR 5882, Congresswoman Lofgren's recapture legislation, HR 6020 (military), and HR 5950 (medical care for immigration detainees).

I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
Will this affect my GC process. I have no plans of buying a house in coming years.
What might be an outcome of foreclosure, keeping in mind that i am wiating for my GC process.
If anyone had an experiecne like this or may know someone, please share ur thought..

Good talent is sought after. So if one is really good, multiple companies would want to get them to work for them. That would result in multiple labor petitions.
Good talent also needs to make up its mind as to which company to stick to. The "future job" labor petition is so full of holes that its misused lot more than its used.
Individuals who are scared (company not reputed; they had issues in the past; or any other reason) tend to approach multiple companies and have them file a labor for them as a "backup".
These "backups" are the ones clogging the system right now blocking genuine petitions from getting approved / denied quicker. Otherwise even at the rate at which the DOL works, I would think a decent time for petition approval/denial under PERM would be 8 weeks instead of 16+ weeks right now
Someone gets laid off from their initial sponsoring company finds another sponsor and files a subsequent labor.
This should be a pretty genuine case, which should survive any audit. No worries here.

If USCIS is providing spillover visas to EB2 in May, shouldn't the PDs of China and India (countries with most demand) have the same PDs in May VB? Doesn't this also mean that in the worst case the PD of EB2 India will be Jul 22 2006 (the current PD of China) in May VB?

So, what made you import yourself here? You could have stayed back in your own country..by the way, coming on a H4 was a choice..it wasn't forced upon you...didn't you know before coming here that you would have to stay home on a H4? H4->F1, H4->H1...all these options are always open to you..
Can we just stay away from these personal remarks?

I shopped around yesterday for lawyers coz I wanted to fire my lawyer (my company's lawyer) and get my own.
Turns out, they are all very very busy and some of them are refusing to take on new cases. The ones that do accept new cases are asking for something like $3,000 just to file 485/EAD/AP for primary appliant and spouse.
Although its hard to get confidence in doing this on your own, its also hard to shell out $3,000 just to fill out forms and have a pair of eyes look over it. And after $3000, there is no guarantee that the lawyer's work would be perfect either coz they too, make mistakes as the paperwork (which 90% of immigration work) is really done by paralegals who dont care as much as they should.
There are lot of people on portal who have filed 485 and EAD/AP on their own. I will link some threads here as I find them. And most people renew their EAD and AP on their own coz they would have left their sponsoring employer and they would be pretty much in charge of everything. So if people can file EAD./AP on their own, then the intial 485 is only one more form.
Very true. If people can file for EAD & AP, Why not 485? Its no rocket science. All that we need is a correct list of documents and letter(s) needed from our employer. Here is what I found so far reading 485 form
1) If we have an approved 140 petition, we do not need to provide a copy of the labor certificate.
2) We need to submit the labor cert if we have an I 140 pending.
3) We need an employment letter from our employer stating that the job is still available and the salary to be paid.
4) No need for G-28 for any form that is being filed by yourself. If some one else is representing you, then they will file a form G-28
Please add more info as you find.
