    i do not understand how overstaying and transit visas are related.
    the TV allows you to "walk from one gate to another" in the international transit area...that's all. you cannot walk OUT anyway without crossing immigration- and if you want to do that- you always need a visa. this new visa, confers (for 90 bucks per person) the right to walk to your plane- sometime the right to walk off and back on to your plane...what a joke!

    even the US now requires this so the UK only did a copycat deal, but the issue here (besides money grubbing behavior) is the way people are treated. sorry lost in space...but you do not seem to understand. if you do not step on UK soil you cannot overstay. the purported reason for this "walking visa" is security. and we all know that "security" can these days be a euphemism for treating people pretty badly. personally if i had the choice when transiting i would not go through london...ever. if nothing else the taxes are astronomical and they make the tickets more expensive most times and walking from one gate to another involves serious hassles with new security checks and long lines. and i do hope that enough people vote with their feet so the UK govt pays attention. london is too wonderful a city to lose out like this....

    Plz stop throwing mud at each other.

    US Mortogage Economy is much bigger pie in which our share sometimes minimum (people like me who did not by home) and people who bought are venting out the prices are come down.

    The fact of the matter is, anything is possible in US. Did not we hear Real Estate downs in New York and California in late 90s?
    By saying that you want to make money by selling house, you are taking risk.

    Now, if system provides a mechanism to walk away with a foreclosure, people will do it. It has been happening on Backruptcy and hence GOVT tightened it.

    The foreclosure process might also get changed in future.

    I do not know full details of ins and outs of Foreclosure so I will leave that to experts advice.
    But please stop blaming each other!!!
    This is not meant for blame game but for advice to an "co-immigrant".

    Good suggestion, I didn't ask about EAD, I will check next time. But I guess evantually EAD would be revoked after I485 is denied. I think H1 is a backup plan if MTR denied and till appeal is decided..

    I am sending letter CIS ombudsman shortly.

    I had a very bad experience with vonage. I applied for rebate with all the papers and sent my adaptor to India. For some technical reason it was not working and I was paying for vonage for long time. After eight months, my rebate was rejected without any reason. When I wanted to cancel my connection, I had to wait more than two hours in line and had to call more than couple of times. But still vonage charged my CC for cancellation fee. I had to file a dispute with CC. Thats the reason I never want to use their service and never recommend to anyone.

    I made a service req on sept 6 and they opened it on Sept 30 and assigned it to an officer. They enquired took detailsof my fedex , etc. and now they sent a letter. Just summary "wait wait wait still we need to key in " huh i think many of us will have same fate even after doing all this but i am not giving it up lets do something rather than nothing.

    100% agree with 'whitecollarslave'. The case is not about h1b worker, but an AOS pending status worker, I would think this status is very similar/same as asylees, and refugees.

    I think taking h1b out of equation would help 'OSC' see through.

    You really cannot determine the achievable factor of a goal on a scale of 1 to 100 so that ordering is moot. In fact, there is some merit in keeping our most ambitious goals upfront - with enough support from the community we might just achieve them.

    I checked some family based data and Date jumps 2-3 years once in a 2-3 year period and NVC gets enough files to work on for next 2-3 years , so dates moves slowly for next 2-3 years. USCIS learned lesson from July 2007 and may follow same approach what NVC do.

    They might go upto 2008 or 2009 in advance this year or next year so they have almost 20-30 k Eb2 cases on hand which can last for year or two. USCIS needs some new cases to work on. All pre adjudicated cases are ready for approval so chances are there they can advance date so that they can get enough cases for next year's spill over quota.

    Called the DOS. Told them I need to travel to my home country and asked them if they can verify if my information is in PIMS. She asked if the H1-B is an extension case which it is. She said the extension cases are taking a bit longer than the new ones. That is quite surprising. Finally she looked in the database or whatever and said they do not have my extension information yet. All they have is the information from the expired petition. No timelines just asked me to call back in a week.:rolleyes:

    I need to know if anyone had any luck if their lawyers pursued this matter with the DOS.

    I don't give a damn what your epics say or what you practice in India. All I pointed out was teh corruption in India pointed out by international agencies compared to western democracies.

    Oh there is no corruption in western democracies. :) LOL

    Iraq war had no corruption
    Halliburton deal had no corruption,
    AIG had no corruption, BOA , Citi had no corruption.
    Lobbying had no corruption
    The texas cops who took money were not corrupt.
    Abu Ghraib was very morally correct.
    Blackwater was a very level headed company.

    Any thoughts?

    No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.
    Don't come after me for saying this, its not my opinion. But general opinion that I have observed from people who are not well informed(read majority of people). Lets focus on the main stream media in US, outside coverage is not that significant anyway.

    Thanks for the excellent analysis. One question, your analysis assumes category excess visas goto next category on a per country basis, is this correct ?

    Example, EB-1 china number goto EB-2 China ? I thought all EB-1 China numbers are added to the excess pool and then given to most retrogressed EB2 category ?

    Thanks for anyone who clarifies this.

    No matter how the data is sliced and diced, being EB3-I certainly means a loo...ong wait time ... :)

    Well if you are EB3 you are scrwed. I think it's almost worthless waiting for a GC. :mad:

    I would like to point out the differences between H1B and L1
    1. There is a yearly limit for H1B (65k + 20K) but L1s are limitless.
    2. A minimum wage need clause is there for H1B but minimum wage is not required to be paid for L1s. There are people in L1A visas who are supposed to be Senior Managers are sometimes paid less than 60K per annum by these offshore companies. As although they are brough in L1A visa they are in fact developers.
    3. Almost 99% of the L1s are from offshore companies whose main intention is to send the project/job to offshore, most of the H1Bs do not have this intention.
    4. L1s cannot change their employer, so they are bound to follow what their offshore employer ask them to do i.e try to take the job offshore, H1Bs can change employers, they will not try to send the job to offshore as they will then eventually have tomove back to offshore.

    So if we clearify these points even to the antis, I hope they will understand who is the real culprint for the employment scarcity. Each of these companies are moving thousands of jobs out of this country making the problems for Citizens/Green Card holders/H1Bs.

    99.99% of all the L1s are not used as they were intended when the law was signed.

    All these may be true. No matter how you convince antis, they won't support any foriegn worker here. They want all of us out.

    Even if authorities bans all these L1s, outsourcing will not stop. On the contrary it will intensify.

    Before the 2001 recession, many companies were reluctant to outsource their work to India or other countries. When recession hit in 2001, many companies overcame this inhibition and started outsourcing jobs in large scale.

    If companies find more stumbling blocks to operate their business, they will find even more innovative ways to overcome those. Remember India is no longer a back office for a low end work now. Many companies have even moved their R&D to India.

    Should not be an issue. I spoke recently to one of the attorneys and they mentioned that H-1B transfer should not be an issue. As long as you have a job offer in similar classification it should be fine. Regarding the AC21 they suggested that if dates are current then a good approach is to wait for filing AC21 and see if you get the GC. If you don't and dates retrogress then file it later. But filing immediately also wouldn't hurt.




    My I-485 case is current right now. If I change my employer(whoever sponsored Green Card) to a new employer, what are the concequences? I want to do H1B transfer because I am not using EAD right now, should I file AC21 or not?
