Folks, while reading the 485 instructions, I found that the check is to be paid to 'Department of Homeland Security'. Not to USCIS as mentioned in the very first post of this thread. Please comment.

The question is how would you identify which jobs are genuine and which are not. In addition, the question the porting comes at I-485 stage.
So in other words there could very well be job out there and you won't know till its I-140 is approved if it is for porting reasons.
Also, a good/established company may most likely will not file a new labor and I-140 for a person because it an unncessary expenditure for them.
So guess who are the people who are most benefitted by this...

If the objective of your exercise is to eliminate alleged non-genuine EB2 jobs, that really don't exist, but are simply advertised just for the sake of porting by unscrupulous companies who stand to gain money by this, then you certainly are making a valid point.
But I still do not understand how a lawsuit will help? Was the labor-sub elimination the result of a lawsuit? Also, I would be concerned about lots of other valid/genuine companies who really have jobs for BS + 5 years experience ...?

Just the other day I was dreaming that Obama will pass a rule that all those who are here in US legally for 10 years + will get citizenship....:):) Maybe I was dreaming too much...

While I agree in principle to what is being suggested here (I voted for this on Change.gov), I think it may be easier to win this battle with a smaller change:
The five year clock for obtaining US Citizenship (post Permanent Residency) must start at the time Adjustment of Status (I-485) has been filed.
For example: If you are approved for Permanent Residency after a long 5 year wait of filing your I-485, you should be eligible to apply for citizenship immediately without a further wait.
This takes away at least part of the suffering caused for the legal immigrant community. The effect of USCIS processing delays and visa retrogression can be mitigated at least when it comes to obtaining citizenship.

As such, you have to start looking for other jobs because you are not sure if they will accept EAD even after a week.
If they offer you the job, well and good, but if not, I think you can litigate for various reasons because what they did is not right.

My priority date is current this month (Sep. 2010). An InfoPass appointment inquiry on Sep. 3 and a congressional inquiry on Sep. 9 answered that my case is being actively worked on by an immigration officer since Sep. 1. SR on Sep. 10 responded that visa numbers are not available for my case. SR response was dated Sep. 10 � same date when it was initiated. On Sep. 15 my I-485 got approved. And here is the funniest part. I received the I-485 approval notice and the SR response that said �no visa numbers available� on Sep. 20 � both on the same day � by snail mail. What a contradiction? Such are the ways of USCIS. Why do we not want to question them? Would raising this issue with the Ombudsman be of any use? Can this be presented as a proof of a hideously mismanaged government entity?
Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Every 485 applicant needs to submit birth certificate. If in regional language then get it translated in english. I dont know any place/person for translation, but you would need to submit english version.
Do we need the Birth Certificate for secondary applicants(spouse).
None of the checklist(Employer based I-485) I have been thru say that I need the secondary applicants Birth certificate.
My spouses Birth certificate is in a regional language, and hence the question.

Hi Gurus,
Please advice on the following situation. If you file a 485 thru company B as future employment(used substitution labor) and if company A for which i am currently employed agrees to file labor and assuming the dates would be current and labor is approved. Can i cancel the 485 applied thru company B and apply thru company A for which i am currently workin?

our applications were supposedly approved today. IO called home around 7:30AM.
Dependent case is being worked on though..he said we should get approval notice in 3 days.

My immigration doctor told me that if i had chickenpox in childhood i do not need the varicella vaccine? Which i did at age 5. Please, let me know if anyone else was told the same , i will be going back to him on Wednesday for the physical exam. I don't want to get a RFE on that.
If you had chickenpox in childhood, you have to show a letter. you no need to take varicella Vaccine. But my situation I had chikenpox in childhood, when i went to immigraiton doctor , i dint tell that i had chickenpox in childhood. Doctor told me to take Varicella Vaccine. I took that one.

I just told the nurse who was taking down my vaccination info that I had Chicken Pox in my childhood. That was enough to preclude the varicella shot. She didn't ask for a titre to confirm it.

Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.
Just a thought
If it is for applications money, they might as well make it current.
There are not many applications between Jan2008 and jan2011

2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN

Apple approved Vonage iPhone App.
It allows to call India for 7 cents.
It would be good if they approve Google Voice app.
Chepcent approach is good if you have internet connection handy. Maybe vonage could have made the iPhone app to be one time fee and have it linked to World Calling Plan.

just for information i am mentioning here. for this only i registered newly.
one of our friend got GC approval today. both wife and husband got. priority date is 2003 august eb2. mine is 2005 ending eb3. we can consider that as 2006 starting eb3. but when we get dont know. really frustating thing this like many especially who are in eb3. praying for changing the rules to be good for all.
God is with all of us. we too will get soon that good news.

Go to USCIS and read the instructions; these 2 are also supposed to be self filed by the immigrant himself. So instructions are clear.
So, ask him why he needs these. Most likely, he will demur and say OK.
They don't know what they are doing, just packing the file for the money sucked ILs
