    Thats a good suggestion. I will contact the congressman and senator and ombudsman as well.

    How can they reopen a case thats already approved. They approved and reopened the case on the same day.

    We took infopass and they told us that the visa's retrogressed so they had to pull back their decision. I showed the officier visa bulletin and told him that am current as today is oct 1st and the new qouta should have started already.

    The response he gave is he cann't access the files as the files are frozen and it will take them about 2weeks to access the files.

    My files are at local office as i had an interview on Aug 24th

    All,

    I will once again be writing and sending posters to all the reps. This is one of our chances where we can get closest. If we miss this then there will be lots of uncertainity. Imagine we already missed it. See how desperate all can get.

    We have some time, Lets all spend considerable time this weekend, get bigger charts, use lots of good eye catching color, make our voices heard. Spend considderable time this weekend on this, please. Together we all can make a difference. Please do your best and spread this across your friends also who are waiting or have got their greencards. This one thing sucked up so much energy from so many here. Please support EB2 and EB3. How does one get these greens. I never got any.. :(.

    I have two I-485 pending. Both filed by me.

    One is based on National Interest Waiver for physician I-140 (self petition). The second one based on PERM I-140.

    Both I-140 are approved. Both I-485 pending one since 11/04 and second 7/07. Fingerprints done for both and medicals done for both.

    First I-485 needs total 5 yrs of service in physician shortage area (which will be completed in about 6 weeks)

    Does anybody have similar situation. What to expect now. I have PD of 9/04 on both the cases. Dates will become current from August 1st.

    Can you please further explain how the visa flow will work if instead of horizontal flow it is made vertical flow... or you have some other interpretation?

    Quite simply put EB3-ROW << EB2-I,C. So there is a faster chance of EB3-ROW going forward and being current before EB2-I becomes current. Therefore, with all other categories satisfied, it boils down to EB2-I/C and EB3-I/C. Thenceforth, as USCIS has indicated, the longest waiting PDs will be given the roll-over numbers, which is EB3-I.

    So what will be the flow? I guess the following

    EB1-> EB3-ROW (until current)
    EB2-ROW -> EB2-I/C

    Once Eb3-ROW becomes current

    EB2-ROW -> EB2-I/C
    EB3-ROW -> EB3-I/C
    EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)


    Please note, this is not going to be a quick fix for EB3-I. We are lowest on the totem pole, and barring legislative action, the only relief we can have is "earlier access" to numbers. Without a reversion of the complete horizontal spill over, older priority dates will continue to languish because EB2-I is going to remain sufficiently subscribed going forward.

    I would say, any fraud, whether H1/L1/F1, employee related, employer related should be reported? Why should law abiding immigrants/workers pay for those who are committing fraud?

    we all are law abiding individuals who pay taxes like any other citizens.
    We are only trying to highlight our plight as they say
    "Only a squeaky wheel gets a grease."
    No can deport or arrest you by taking out a rally.

    Wake up guys. Lets get together and be unified as only then can we be heard.
    We all are well educated peaople and we don't need to be treated like slaves.

    I only caught part of a report on Lou Dobbs regarding Beckham's visa. He received an O-visa. The Department of State (http://travel.state.gov/visa/temp/types/types_1271.html) does not give the number of these visas issued every year. However, the reporter on Lou Dobbs (http://transcripts.cnn.com/TRANSCRIPTS/0707/13/ldt.01.html) claimed there were over 12,000 of those given out last year . Where did they get that number?

    I have a couple of very urgent questions that I want to check with you folks:

    I am currently in the US on L1 Individual visa - my current visa is expiring on the 10th of March. My employer filed for a fresh L1 Blanket Visa instead of doing an extension because I have to be in India for a few days in March anyway. My visa interview is on the 11th of March.

    My first question is: Is this alright? Am I going to have any problems because I did not extend my visa and applied for a fresh one instead? I have just been in the US for 5 months in my current visa.

    Second question is related to PIMS:
    I have had 3 L1 visas till date - first one was stamped in 2003. Second in 2005 and my current one in 2006. I have never overstayed and I was out of the US for 13 months before I came on my current visa in Oct 2007.
    Will I face any delays due to PIMS when I go for stamping on Mar 11? I plan to be back and rejoin work on the 18th of March.

    Is PIMS delaying folks only in case of L1/H1 extensions? Looking forward to your help and guidance. Thanks a lot.

    My receipt date is June 20 and my PD is Oct 2002. If the July visa bulletin does retrogress, will I still be affected with regards to I-765?

    No you will still get AP and EAD since you have receipt date. You may not get GC approved until the dates become current. Experts correct me if i am wrong

    (1) - (2) - (3) gives the spill over from EB2 ROW to EB2 (I&C), which is 1,426Which means EB2 ROW to EB2 I&C spill over is mere 1,426 ???? Hope we are wrong... this looks scary...


    53,872 ( EB2 Total allocation in 2010 ) = Some X (EB2 ROW usage is say X) + 19,961 ( Total India received in 2010) + 6,505( Total China's received in 2010)

    ==>> X =[B] 53,872 -19,961-6,505 ==> X= 27406


    ==>> So Total EB2 ROW usage in 2010 is = 27,406



    -----------------

    1)EB2 I & C Usage = 19,961+ 6,505 = 26466.

    2)Visas due to Spill Over for EB2 I & C = 26466 - 5,604 (EB2 (I&C) Regular quota {2*(40,040*7%)} ) = 20,862


    3) Visas due to spill over for EB2 India only in 2010 = 26,466 (EB2 I & C Usage ) - 2,802(EB2-I Regular quota {40,040*7%} ) - 6,505 (EB2 China Total Usage) = 17,159.

    1) In 2011 according the USCIS statement we are getting 12,000 spill over visas in MAY.

    Out of that about 10,000 will be allocated to India.

    Reason: India PD based on April bulletin = 08 May 2006,
    China PD Based on April bulletin = 22 Jul 2006

    India has to get cleared 3 months (May Jun and Jul) before the spill over allocated to China.

    The average demand for EB2 India is about 1.5k/Month.

    which takes 3*1.5 = 4.5 K visas.

    The remaining Visas = 7.5 K

    The average demand for EB2 China is about 700/ Monnth.

    The Total demand for EB2 India & China together from Aug 2006 will be about 2.2k/Month.

    So 7.5K will clear about 3.5 months of EB2 I&C from Aug 2006.

    So The May bulletin takes the EB2 I & C to November 2006 Or December 2006 as we also get the regular monthly quota of 2*(40,040*7%)

    Based on your calculations , Experts, please let us know what to expect, if 12000 GC are released for EB2. Where will the cutoff come and stop..
    Can you please post that link that shows how many are waiting year-wise.

    12000 GCs for EB2 India and China means, with out any doubt it fetches 5 months forward movement.

    But at present scenario EB2 China is at 22JUL06 and Eb2 India is at 08 May 2006.

    On an average EB2 India has a demand of 1.5k per month.

    EB2 China has a demand of 700 per month.

    So the EB2 India moves 7 months ahead where as China moves 4 months ahead.

    So both EB2 India and China will have the same Cut Off dates and it would/might be: May + 7 Months = December 2006 .


    This is my assumtion.

    After so many countries who receive major immigrant influx like UK, Australia, Canada and New Zealand have implemented a points based system why on earth lawmakers here don't wake-up. In a post-crisis world if US does not regain the old economic supremacy we'll see expatriate population redirecting itself.

    It's already happening with Canada's AINP program. If some of the anti-immigrant comments are to be believed Canadians must be darn fools :D

    All we need is just 233,816(page 2) visas(forget about country limit, EB category etc). In that case in 2 years we will have 280,000(140,000 * 2) visas. So should we all get GC in two years with that logic.

    If only USCIS can think along those lines. :confused:

    July VB Fiasco I-485 Receipting Delays

    The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.

    We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

    we are giving USCIS options on how to deal with the campaign.
    If they really do forward the flowers they need to think about seperating notes from flowers.

    What will happen is - they will pluck the notes from the baskets and then forward the flower baskets as a batch to the vets. I am sure someone at USCIS is going to read the notes.
