    L-1 visas are available to employees of an international company with offices in both a home country and the United States, or which intend to open a new office in the United States while maintaining their home country interests.     The reason for posting this is not to let every one know what L1 visa is or what it is meant for, we all know that, even L1 visa holders there employers know that. L1 visa is misused as another means to send people here to work on client side. Please research the means of reporting such violations and let every one be aware of that.

    If companies want to send there people to work here at client side, let them do it the legal way through H1b.

    Number of ways it will cause problems because of the misuse

    Will replace local employees (that�s including citizens, GC holders, AOS, H1b)
    Unlimited visa
    Provides immigration in EB1 cat where as the same cat for a H1b holder requires unusually high qualification and research experience with significant proof and documentation
    Provides spouses with work visa
    3 years is significantly high to work on implanting parent companies product(as it is supposed to be)
    Premium processing

    And many more.

    If the DOS has common sense they would be better off to retrogess for august, I am pretty sure they will be aware of the class action law suit thats gonna come upon them if they try to revise the july bulletin

    Other than Pappu I dont see the other two or any others actively participating. Who are they and where are they?

    You are seeing pappu on the forums because your involvement with IV is only on forums. All others in core team work on other tasks. Forum is just a part of what we do. You cannot achieve any legislative or admin fix just by creating a website and installing a forum software.There is a big advocacy and organizational work we have to do on regular basis. If everyone in the team tries to do everything, then nothing will ever be done. Do volunteer your time and get involved. You will get to communicate with many others and work with them closely.

    This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
    So life is not always easy. There are people waiting since 2002-03-04.
    Don't think that life is not a FIFO always.

    Why some of the guys became violent when I said, INDIA IS GREAT???
    Guys.. do you know why I always feel like this???

    As my parents,in laws and most of my relatives stay there. Not only mine, allmost all guys who are in the IV, they must have parents and relatives in India for sure. There is no other reason why I said India is great.

    Someone asked me to pack up... YES, I will if nothing happens;however, I will be waiting to see the progress for sure. This is July. Let's have a look over OCT bulletin after 2 months and for sure dates will move atleast 4-6 months for EB2 guys and 1 year for EB3 guys. So wait, be patient, instead of doing all this.
    Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".

    Mainly this is the message for 2005-2006-2007 PD guys. Please don't take it otherwise.


    Take it easy...PD means FIFO.

    So...long story short, don't worry, you will get your GC prior to the "2005/2006/2007 PD guys".

    I'm one of those guys, lol.

    My wife and I both have filed forms N400 in October of 2006 in Minnesota (Nebraska Processing Center). USCIS received our applications on October 10th, 2006. On October 18th both of us received the fingerprints requests, which have been processed on October 27th. My wife’s case has been approved in February of 2007. She had her citizenship interview on March 16th, 2007 and became the US citizen on April 11th, 2007 after taking the Auth of Allegiance.

    I have not heard anything about my case since the fingerprints appointment. I have tried calling the USCIS Customer Service Number but they did not have any updated information about my case. I have also spoken with the Immigration Officer in the local USCIS office (InfoPass appointment) on July 27th, 2007. I have learned during that interview that my case is pending due to the FBI Name Check. The estimate that has been given to me was as long as 3 to 5 years, maybe more.

    So as of now my application is pending together with 320,000 others. Well since it's been pending for almost a year now I'm a proud member of 152,000 who had been waiting for more than six months, slowly moving to join more than 61,000 lucky ones that had been waiting for more than two years. Hence my next question.

    4. Did anyone hear the Name Check clearing between one year and two? Based on all of the people I've talked to it either took just a few months or more then 2 years. Seems to me once they put your file in that special pile it will not take less than 2 years.

    As long as you are not committing crime, nothing wrong with making decisions which are good for you.


    is'nt this exactly what the investment bankers and speculators on wall street did? It was not illegal (since Paulson and Dubya have deregulated the market so much) but it has now led to the biggest economic downturn in decades, has decimated the retirement savings of millions, and led to millions losing their homes and jobs. Nothing illegal, good for the people who made those decisions (millions in bonuses) but absolutely disasterious for society as a whole.


    The core problem with system was cheap money because of lax lending standard and low interest rates ( blame Greenspan) and affordable housing (like ACORN from Dems). These decisions are made by people in power and so called smart people. Individuals do have their contribution to the problem but the macro decisions provided them means to have things which they can not afford. The bubble had to burst sooner or later ....


    this is a big irritant I have in this whole problem. People are blaming everyone but themselves. Those who bought houses to flip, or mortgages that they cant afford blame the lenders, the housing market, alan greenspan etc. The CEOs of the Detroit big-3 earlier this week blamed the economy, california emission standards, fuel prices etc.
    WHat has happened to taking responsibility for their own actions?? Of all the financial firms it is the one doing somewhat ok: Goldman Sachs, which has cancelled bonuses for their execs. All these other firms which came tincan in hand begging for taxpayer bailouts should all also, by default cancel all salaries and bonuses for the execs. But no, there is no taking of responsiblity any more. Any problem that anyone in America has, is someone else's fault. Disgusting.

    * Prohibit the blatantly discriminatory practice of "H-1B only" ads and prohibit employers from hiring additional H-1B and L-1 guest-workers if more than 50 percent of their employees are H-1B and L-1 visa holders.

    We should support, as it puts end to consulting companies abuse.

    I dont beleive this people are supporting this idea. This will put an end to H1B hiring by small tech startups.

    There are better ways to avoid fraud, eg. by depending on paystubs etc...

    NEED HELP!!! what are my options?

    I485 denied on Oct 24th 2008. I did not get the letter and realized only when I checked on the USCIS website. My attorney also did not get the letter of denial or even the NOID.

    I changed jobs in June 2006 by invoking AC21 (Priority Date - Oct 2002, I140 and I485 filed concurrently, I140 approved in Feb 2005).

    The fact is that on all forums there is talk about revocation by previous employer. However please note that approved I140 could either be revoked or substituted. While those AC21 memos talk about revoked I140, the law is not clear when previous employer substitutes the approved I140. I know the substitution process is no longer legal since June 2007, however, it has been abused in the past. My questions to forum members:

    1. Is any one in similar situation?
    2. I have H1B only until June 2009, Can I work until then assuming MTR is resolved in 2 months (per some optimistic posts on IV)
    3. if my employer were to file a PERM labor application--can I port my previous priority date?

    As per some opinions, H1 also gets invalidated when 485 is revoked past 6 years limit of H1B. Did you also get your EAD revoked?

    To answer your question#3, my lawyer said I should be able to retain PD from earlier approved 140 in such scenario. Check with yours.

    Your Case Status: Card/ Document Production

    On September 25, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.


    and for my husband it says

    Your Case Status: Decision

    On September 24, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

    I dont understand why his case is in decision when he is the primary .. Has anyone come across similar situation ?
    My PD is sep 05 and service center is TSC.

    Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. It is all because most people want free lunches. This needs to stop. The 200 people going to DC tomorrow are going to speak for you and me for yours and mine greencard. They are taking time off and spending own money for you and me. Nothing is free in this world. IV is also doing this for you and me and we are taking it for granted. Let people do some good deed today if they want to know good information

    I am not sure if u were born as an idiot or became an idiot after being turning a so called "donor".
    To be frank I stopped contributing as and when IV started having donor forums.

    There are thousands of websites and forums througout the internet to get info and what VKBris posted may not even come close to what Q and Teddy and so many others used to share as a group.

    Now coming on to freebies,What benefit does IV provide to past contributors.I have contributed in the past, have been active at the initial stages,have spent my own money and booked airtickets to meet senators.Been a leader in a state chapter.But later realised that it was not worth for this forum which has partitions among so called donors.

    Why the heck does any one want to see in a home page about posts on a donor forum.Just hide it and keep it among yourself and discuss .

    Now red may follow,and a possible ban.

    You nailed it man. As i said in my post yesterday what you described so well is exactly what happened and so my explanation of just 140 substitution was not accurate.

    Please note the response I got from the attorney of my previous employer (the one who revoked)

    This is exactly what I previously explained and what XX verified for you. The I-140 was revoked/withdrawn and the labor certification was substituted. If only the I-140 had been revoked/withdrawn then you would still be portable. However, as XX confirmed, the company used the case to substitute another employee.

    Clearly the ex-employer and USCIS are at fault. I have the approved I140 and to date on my uscis portfolio it states that my I140 was approved in Feb 2005. I changed jobs in June 2006.

    I am so &^^%$#@ tired, that if this does not work....I am going back. Enough is enough.


    Don't loose your heart. I know this is a serious situation but do not become emontional, just stay calm. This is clearly a confusing situation and a bad move by your employer. Have you got a good attorney? Just consult a good attorney and go with what s/he says. This is not your fault and before thinking of going back, fight for yourself and your family. Remember, tough time never lasts, tough people do. Our best wishes and prayers are with you.

    Yes it is a concern that I have to address. However I see 2 ways to work around it.

    1. Travel out of country get H4 stamping done based on my current H1B status

    or

    2. I apply for I-485 and add my wife later to the application when we have received her H4. In this case, once I have applied, I can add my wife to the application even if the dates are not current at that time.


    If I were you and my priority dates were current, I would go for 1 above [get H-4 stamped ASAP and enter in US and apply for I-485].

    Is anybody questioning as to what these weekly updates (on USCIS claims that receipts cleared for dates in August) mean when we are still waiting receipts for July 2 filings ?
