    Just because some one said, VDLRAO predicts right, he has become a Psycic Guru here. Please stop this. Every one keeps saying , he predicts everything right. Did he predict, EB2 with PD2006 will be processed before EB2 with PD 2003. Come on Guys, Give me a break and stop this rubbish. What did he predict and on what basis. I dont have anything personal here, I appreciate him, taking efforts to come up with some number based on the calculation. But Please stop spreading this on every forum that He predicts right.

    I read in another forum that US consulate in Canada is actually asking to fill out some PIMS form available on their website. Also you need to fax your documents 1 week prior to your appointment.

    Can anyone confirm this? Man, I wish this could be the case in India also. :confused:

    in mumbai, also you need to enter the details of petition online (petition number, expiry date and petitioner name) while booking appointment.. and you need to submit all documents before 5 working days.. (in some cases they mention 3 working days)

    Allowing to file on July 02 or July 03 depends on visa numbers available which in turn depends usage the preceding month. If all the numbers are used up (meaning Immigration Officers have requested visas from DOS in the process of approving pending I-485) they cannot allow anyone to file on July 02 or July 03 and so on.
    I guess currently race is on from USCIS to consume Visa numbers (40,000 or so) from DOS at unprecedented pace. That's why bulletin hasn't changed as yet. USCIS on its part is possibly trying to avoid flood of application at all cost, even if it requires working extra hours (and approving as many cases as possible) if it can save them later. DOS will NOT move the date back until the numbers are used up or near used up. I guess race is on....we will know on Monday. One way to know how true this is will be watching I-485 approvals from now till Monday. We are caught in the tug of war between USCIS and DOS. CIRCus isn't over yesterday....it is back in town again !!!

    For the nth time.. numbers are reduced only after approval and not based on receipt of application. So if you can submit it on July 2nd you submit it on 3rd and so on.

    DOS has alloted most unused visa # into EB2 category this year, and EB3 was stuck due to no additional unused EB1 visas.

    Visa Bulletin mentioned they did this in according to the requirements of Section 202(a)(5) of the Immigration and Nationality Act. But actually this might be a misunderstanding of Section 202(a)(5) and Section 203(b) - There is NO words in the act on how to allot unused visa # to differnt categories. Even the country limit and category limit would not apply if there are unused visas #. The allotment Mr. Charles Oppenheimer did horizontal spillover caused longer and more backlogs of EB3.

    Congress has a concern on the backlogs and Bush's administration promised to reduce backlogs as much as they can. If Immigration and Nationality Act allows the government to spillover the unused visa # to EB2 & EB3, and a more humane and fair system should take care of early priority date first and do whatever the government has promised, should we ask Mr. Charles Oppenheimer to think about alloting some unused visas to EB3 so it can move forword a little bit?

    Guys this is a revision to the July Visa Bulletin. Meaning, even if the revision happens on July 29th to the July Visa Bulletin, it holds good for entire july.
    This is not August bulletin.

    Looks like people have misconception, that if their file goes to USCIS on July 2nd and visa bulletin is revised on July 3rd or later date, then they are safe. It is not so.
    If at all if there is a change to the August bulletin it holds good for August and not to July bulletin.

    Pls let me know if my understanding is wrong

    You are right but only if DOS revises the bulletin. The more likely scenario is that DOS will send a notification to the USCIS that all visa numbers have been exhausted and then it will be upto USCIS to decide what to do. I that case USCIS will most likely accept all applications received up to that point- Same thing happened last month for EB-3 Other workers!

    Godbless, I am sure you can get your post 6 years H-1B extension based on the Cornin and new Aytes memo of 12-5-2006. Can you ask your lawyer whether it is possible to file your H-1B extension after 01/26/2007 but BEFORE June 2007 or it must be filed before the expiry of your parolee I-94? Also, you said the Immigration Officer at the POE did not let you use your H visa but the AP. Is it because you showed him both of your H-1B visa and AP? If you did not show the AP, he would probably let you enter with the H-1B visa, right?

    My reasoning for less than 3k visas for EB3 I

    Assume EB3 I has 2800 available per year
    2800/12 = 233.33 per month.
    The spread sheet shows that there are 135 pending with PD of March 01 or less. Which is less than 233 the PD did not cross April because there are 452 applications in april. A PD of April makes sense. Using calculation the PD will be July 2001 in Dec.

    if you assume 8080 visas per year then there will be 673 visas availble per month and the PD should have crossed to May 2001 because the total pending 485s on May 1st are 587. If we go with your assumption then the PD in December will be at Jan 2002...I

    You brought a good point to churn on our heads but remember DOS decides the dates not the USCIS and DOS and USCIS do not have any interlinking to set Dates in a bulletin.

    How DOS decides the dates in each bulletin is also a mysterious and unknown area.

    I am july 2 filer with no activiy in the case. NO RN, NO CC, NO DATA in System.
    I would like to send fax or e-mail to congressman.
    Anyone know here how to find local congressman?
    Anyone has templeate of letter to fax or e-mail?

    I have sent an email to CISOmbudsman.Publicaffairs@dhs.gov and they responded with the following email content.



    Dear Sir/Madam:



    Thank you for contacting the Citizenship and Immigration Services Ombudsman (CISOMB) in the U.S. Department of Homeland Security (DHS).

    In order to review your case you must complete and sign the Form DHS 7001. The form can be found on our website at DHS | Citizenship and Immigration Services Ombudsman (http://www.dhs.gov/cisombudsman).

    We are attaching the form for your convenience. You may submit your form via-email as an attachment. In addition, please send a copy of I-140 approval notice. If you have an attorney please complete and sign Form G-28 as well.

    I have one more question too, Should I send G-28 form also.

    I did not send G-28 even though I have an attorney. I think that part is only if you want them to respond to your attorney rather than yourself.

    Here are the answers to line numbers 10, 11, etc...

    10 - Choose (b) and (iv) within (b)

    11 - Choose (b)

    13 - I chose (b) and (c) since I had done both of those things. You should choose accordingly.

    14 - I left this one blank because I did not want to involve the attorney

    15 and 16 - Just write your name and sign. Make all family members do this to avoid separate forms for each

    17 - Leave this one blank once again because it is only if you want them to respond to your attorney.

    IV has not done anything that could have a negative impact on your green card processing. IV is striving hard to change your lives.

    Shame on those who are scared or pessimistic. All you people do is to gaze at the sky and wait for the stars to fall.

    If you are so scared - how will u raise your children? What will u teach them? Cowardice? Will U teach them to run away from issues? Will u teach them how to not cooperate?

    First (and last) Fingerprint: Oct 26 2007

    last LUD before Approval: Feb 3 2009 (probably pre-adjudicated at this time)

    4th Aug 2010: Card Production Ordered
    9th Aug 2010: Received Welcome letter in smail mail.
    11th Aug 2010: Got I-485 Approval Email
    16th Aug 2010: Received physical cards for me and spouse (letter said they were dispatched on Aug 11).

    Any RFE: No
    Any SR opened: No
    Contacted USCIS/Infopass: No
    Contacted Congressman/senator/ombudsman: No
