    I just called USCIS using POJ method. Nice IO . She took time listening BUT same darn response.
    I had opened a service request on 9/8 . I recieved a letter stating to wait for 6 months.
    IO told me ,all the name check, FP are cleared. No RFE.
    Since SR is open, wait for 6 months.
    well, thats my story.

    we have a total of 48,000 eb-2 and 68,000 EB-3 i would think this number includes the Spouses,children etc. so all it needs is 120,000 visa numbers am i right? SO based on that what are the hopes for EB3-I in the next year or so

    A# is the alien number that is given to the applicant during the GC process. It is either given at 140 approval or at 485. If you have a A# in your 140 approval then you can use that # in all your 485 forms.
    To answer pranju's question, yes its only for primary applicant. You can leave that field as blank for your spouse.

    worst case? yes.. it's mine..

    My H1 revalidation appointment was on the 12-Dec. Visa was approved immediatly but haven't received the passport yet. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..

    I had a H1 transfer to a new employer and 3 year extension happen at the same time. I am not sure what the problem is and what I can do. I am totally stressed out and really depressed ..

    If someone has done something thats helped their case move along.. please PM me or reply to this post.. Thanks !

    Dont be depressed buddy! I know its an aweful long time but hopefully soon things will turn good for you. You mentioned that it was a renewal case. When was your H1B issued initially?

    This is a real problem. I got a letter from a prospective employer, who wanted proof that I was legally eligible to work in the US (alongwith transcripts, previous employment letters etc.) prior to scheduling an interview.:cool:

    I believe employers are seeing a lot of candidates on EAD, and for whatever reasons they dont think EAD is good enough and would like to weed those candidates out beforehand.

    We need to fight back against this discrimination.:mad:

    wait for atleast 4 (6 is better still) months to figure out if it is in the "stuck in NC" status !


    but it is pending with FBI since Aug 1st. Looks like they also check for fragmented names.

    Ganguteli, why do you keep on questioning everybody's intentions all the time. the other day, I had posted about L1 exploiting the loop to file GC in EB1 and your answer was plainly stupid and irritating - "I would have done the same thing if I had a chance"....

    There is nothing wrong in exposing any kind of visa fraud...I came here on F1 10 years back and still in line for GC after getting masters from a decent school and working with major employers. What is wrong in making sure that it is FIFO....

    It is not just Gantuteli doing this. Almost every other poster on this board seems to be doing the same. Any opinion expressed against the visa fraud perpetrated by these outsourcing cos is met with derision, ridicule and contempt. Of course, the poster is immediately labelled as an anti immigrant or a tunnel rat.

    Why do the posters have to resort to ad hominem arguments ? Why dont posters consider the merits/demerits of an argument and then provide civil responses ? In my opinion even if anti immigration activitists, barring the racists, post arguments or views, those views need to be considered on due merits. Many people across a borad spectrum, including current H1B holders, GC and naturalized citizens, believe that these outsourcing cos are abusing the L1 visa and are contributing to the unemployment of high skilled labor. Is it anti immigration to raise our voices against such corrupt practices that impact our standard of living ?

    Punjabi, foreclosure is legal in the US. If necessary, you've gotto go for it. Others on this thread have given good advice. Especially, figure out what the downsides of foreclosure is. Just figure out if it will be difficult to rent in the future if you declare foreclosure. Rest, do what is financially good for you. Hope things work out for you.

    Milind123, I can certainly understand your frustration but kudos to you for making your post humorous at several points amidst your painful experience. I especially liked your closing remark about Koh-i-Noor - I'm with you. :D

    Come to think of it, even the country where we are right now (i.e., the US) isn't much different not only in terms of lengthy forms and queues (outside of consulates) but also on making our lives a little more than hard by denying driver's licenses, delaying permanent residence perpetually etc. On top of these issues, apparent hate crimes against Indians at LSU and then at Duke would certainly make a lot of parents a little nervous before sending their kids for higher education here.

    I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).

    I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).

    Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).

    It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.

    I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.

    I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

    Thank you for the initiative IV core, now it is upto this community to take up the suggested action items and make it a HUGE success!

    I am excited about these suggested administrative fixes:
    1. Filing for AOS without PD being current... the inability to do so is the bane of our life!
    2. EAD's effective for three years
    3. Same job description=> Similar job description... this will allow us to take promotions and transfers easily... something to highlight to our employers

    Hi,

    Maybe this qn. was answered before. Tried to look for answers. But was not lucky to find the exact answer. Also, my qn seems a bit out of context w.r.t this thread (I dont even know how to start a thread).

    Anyways, my qn is:

    If one starts actually using his/her EAD via (eVerify or signing I-9 form), then how will the USCIS know that he/she is on EAD and not on H1B anymore? As per the link below, the I-9 form stays with the employer and shouldn't be submitted to the USCIS.

    So, how does USCIS know that u are on EAD? Is it via payroll? Also, can ADP still run payroll even if one's H1B has expired? I'm just trying to find how does the H1B get invalidated as soon as EAD is used. Where is the link between the two?

    My situation is...my H1B is expiring on April 24th. I've asked my employer to do an h1b extension (as its safer). But he's kinda unwilling to do that. So, as a worst case scenario if he asks me to use EAD only, then I'd be forced to use it. So, how will the USCIS know about that? Lets say, I use it on April 15th. Then will my H1B inactivated starting April 15th? Where and how is it recorded? Just curious.

    USCIS would not come to know and does not care to know. USCIS knows that it has issued an EAD to you, Now whether you use for a job , do not use or open the locked door with it, it does not care. Yes, while processing 485 if it generates RFE then depending upon the nature of RFE if your new employer is contacted for employment proof, perhaps USCIS may know that you are really using it.

    Concentrate on action items and work harder than ever, which can bring a great relief to entire EB community. It does not matter how many times we failed or succeeded, every attempt we are an inch closer to our ultimate (IV) goal.

    If I am correct, your PDs are current, right? Do you guys know if your case was pre-adjudicated and/or assigned to an IO? I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

    Its current. and my case was pre-adjudicated on feb 20th, 2009, assigned to IO on sept 17th 2009.

    Sept 4th, infopass 1 - all clear, pre-adjudicated on feb 2009.
    Sept 7th to 15th - 4 SR's - No Response on any of them. all CSR's told samething, everything is clear except FP, opening Request to send them to you.
    Sept 15th - Lawyer's email - Not sure if this helped, But, exactly after this, it is assigned to IO.
    Visa Numbers are out for Fiscal Year 2009.
    Sept 22nd - infopass 2 - both apps with same officer, please wait
    Sept 25th - FP notices arrived on 25th, with appointments for oct 21st,
    Sept 29th - did a walk-in for FP at local ASC and got it done early. So, it clears the way for october.
    Sept 30th - there was a hard LUD, may be coming out of FP uploading.

    Got this reply from Senator on 29th.

    These I-485’s are based on the principle’s approved I-140, SRC0XXXXXXXXXX as a 2nd preference from India with a priority date of 11/19/04 and there is a current visa available.

    TSC is currently processing I-485 visas based on filing date order. There are a large amount of cases that are being worked and these cases will be worked in receipt date order. With the limited amount of visas that are currently available between now and September 30, 2009, there is no guarantee that these cases can be completed before the end of FY2009. It is estimated, that in general, these cases will be completed between 45-90 days.

    Since, apps are with IO now, i am restraining from doing any more inquiries. The only hurdle we knew, FP is now complete.

    my case is TSC - EAC - TSC transfer case. original receipt date at TSC was august 3rd 2007. transfer from EAC to TSC receipt date is oct 11th 2007. ND Oct 16th 2007.

    The Rep Tom Tancredo a vociferous anti-immigrant both legal and illegal. The very fact that Lou Dobbs allowed his show as a mouthpiece to propagate incorrect information "about H1-Bs being illegal" is worthy of a lawsuit.

    How about a petition to the CEO of Time Warner asking Lou to apologize ?
    I was Just watching CNN and was reporting a part of Lou Dobbs episode,
    Tom Tancredo saying people overstay on H-1B after its "5 year" Expiration.
    I think he do not even have a clue about H-1 B programme.
