My priority date is current since september 2010.
My H1B transfer application is with USCIS since Aug 27th, 2010. The date for transfer requested is Novemebr 1st, 2010.
My I 485 was filed in Aug 2008. I have been working with the current sponsoring employer since 2005, no breaks.
I am expecting an RFE for my I 485. Anyone who was in similar situation share what kind of RFE is likely to be issued? I already have a job letter from the new employer essentially stating same kind of work duties.

Although number of republicans so-sponsoring is lower, it's still 25% of the total so there is hope that more will support it when it comes to voting. ;)

I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. .

Many of us could be over-qualified for our current EB3 position (after so many years of wait) and is accepting the current position only to strictly adhere to "same/similar" job classification. In that case employer can file a GC for our real qualification i.e. Eb2.

Now if you go interfiling to USCIS in March 2009 then USCIS doubt as logically employer ca not establish the "natural skill progression" within 6 months.

Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.

I am an ex British Airways employee, and I spent one year in 1997 living in London city. Please understand that the level of customer service one gets in USA, is just a dream in UK. Mishandling customers, showing a complete arrogant behavior, and a total disregard for their basic customer rights are just a few business traits in UK. I witnessed couple of BA strikes at Heathrow, and beleive me after what I saw, I will never travel with any british airline in future. You are lucky that you just saw a tip of the iceberg and came to your conclusions. It starts from their embassy, and continues throught the airlines, security checks, baggage handling, staff etc.
I like your comments about Koh-i-noor. If it was any other country, they would have happily returned it to the country where it genuinly belong. Oh by the way, during my stay at UK, I had to remind their couple of citizens about what exactly the phrase "Be British" means.

Yes. No one has bothered to go after DOS for misinterpretting the AC21 rule in allocating immigrant visa. Many people (EB2-India) raised their concern between 2003 and 2006, as DOS is not correctly following the rule and allowed the spillover to go EB3, when EB2 was in high demand particulrly from India. Even IV core did not go after DOS. As you mentioned, lawyers has no incentives. EB3 has enjoed between 2000 to 2006 (from the mercy of DOS). For example in 2006, EB2 got about 25,000 visas abot 20,000 visas (from EB2)has gone to EB3-ROW.
IV from my interpretation is about ending retrogression and increasing total visa numbers and not about reallocation of visas and spending resources on a zero sum game. This issue should have been taken up by affected individuals. I'm sure they did it though because DOS has awakened to the fact that they were not following the law.

Also I have analyzed that people who have a date in 2008 somehow predict that the dates might move to 2008 and people who have a PD of July predict that dates will move to August . This is just an observation and nothing more , and if you go through the threads thats exactly what you will see.

I saw two LUDs on my 485, I found out one was after FP, the second one was after FP, BC clearance. I found mine was in name check
and USCIS officer told me, the name check is done for all. it takes 2 - 6 months time frame.. and for some it may be beyond

My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

As you may already know that this is a bi-partisan bill with wide bipartisan support in the house and will help improve American competitiveness & reduce the back logs associated with USCIS. This bill is non controversial measures that will help US to stay competitive with a highly educated and skilled work force and address family based backlogs also.

In a nutshell, this bill allows USCIS to manage their workflow more effectively, which provides better customer service, and will eventually lead to better turn-around times.

My new theory is the DOS was influenced by politicians who are attorneys (I beleive that there 50% of lawmakers) and it released a huge Visa Numbers. The politicians have strong connections to law firms. The USCIS doesn't want to do it, because it doesn't have 'resources', 'money', 'manpower. So, they are on a near strike mode, not attending routine works like sending receipts., etc in a timely fashion.

Many issues are being swept under the carpet. I had written a few times earlier. The backlog and GC issues are not truly a numbers game. It is the neo-con regime and the republican culture that had engulfed Washington, its consequences, that had made things miserable for us; we, the legal immigrants.
4/5ths of the illegal immigrants have been here by the time of Clinton's second term. It was a non-issue then. You should understand why is it an issue now? Why can't it the legal and illegal immigration be addressed and solved. In a democracy, things like this can be solved administratively, legislatively and judicially. Adminstratively, we we hit below the belt, in backlogs, in delays, in sudden rule changes (no concurrent filings of PD is not current). Legislatively, they are stalling and falling apart. What is left for the immigrants?

Why should you know? Why should you understand? It is in your own interests that you understand things wisely. Failure to know what is happening on the ground, what is happening around us is a sure shot for personal failure.

here is my theory.
DOS and USCIS played a tactical move by making all the visa numbers current in anticipation of the CIR bill so that the legals wont complain to the senators about retrogression.
Once the CIR went down the drain, they are panicking about the outcome of their tactical error and trying to undo that move.
Again, just my theory...:confused:

I called the Nogales (mexico) US embassy and they were able to look up the PIMS system using the petition number.
I hope the PIMS is a "centralized" system. So even the consulate in India would be using the same.

hmmm.. i had noticed that for couple of persons whose approval was done early got their passport immediately but in you case it is not true!! :confused: so I guess it is difficult to decide any pattern.. (i am not sure whether it is related to H1 approval of any specific center.. if we decide some template and ask everyone to post all such details that might help but i am not sure whether everyone will follow that template...) was there anything complex in your case which you think might have caused this problem?
my H1 approval was done in April 2007 and I have my appointment in Feb 1 st week. I will post my details as soon as my interview is done.. Good luck to you..

my H1 approval was done in April 2007 and I have my appointment in Feb 1 st week. I will post my details as soon as my interview is done.. Good luck to you..
