Thank you for your information.I hope you know the situation right now in USA.In jan 2010 H1 people came to Newark Airport were asked to form in a separate queue as soon as they get down from the flight for two levels of interview.Some of them are sent back.Now you can't find employer to transfer your H1 immediately.Before two years it was possible to transfer H1 with out having recent pay stubs and they never asked client letter.Now if you don't have a job you can't transfer your H1 to anybody.
Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

RFE for I-140
I had applied for I-140 Dec last year(2006) EB3 and was checking for update and found that an RFE has been sent on Dec 12. To whom is RFE sent....My company had done all the paperwork...is it to our company lawyer or me....Please advise

Did anybody fly recently in Lufthansa to India? I wanted to know whether you need transit visa.

My travel agent says you dont need transit visa if you have AP.

I was just quoting that there may be legitimate reasons but this is not a good reason...
Fully aware this is not the right time to correct eachother, but their is something in me that forces me to dis-approve your comment on " ... legitimate cause for sucide". I hope you will take it in friendly spirit.
We all are fighting our battles on all levels in all the different ways ...be it financial, social, family or professional. And in some of these we will win and inothers we shall lose, if not have. And it might be that mental illness drove this young man into such desperate direction, but little did he realize the consequences of his near-sightedness. No matter how depressing and gloomy it may appear, we should not forget that tommorow can be better. Life is a cherished previliage given to us and we should put to it's best intended use as per God's will.
So let's be brave and encourage eachother so that no-one else show up on news in manner the departed souls. My deep sympathys to those affected by this tradegy and apologizes for any un-wonted offence.

Filed I-485 on July 31,2007. Checks cashed on Sep 10th and received Receipt Notices for me and my wife through the attorney yesterday. I am in the EB-2 category with PD: Oct 2005.
However, on both of our I-485 receipt notices, the Category shows up as "Unknown" ...Has anyone else faced any such thing...

Are you planning to get it stamped when you are outside US?
I just talked to my attorney and he says that the US Embassy will club both the 797 dates and give you a combined visa. I still would like to confirm it with other sources as it sounds too good to be true.
I-94 on current I797 expires 4/30/2007
Am expecting H1B approval 4/30/2007-4/30/2010 soon.
Plan to travel in February 2007.
One thing I noticed is my previous visa stamps only had a end date but no start date. So I am guessing/hoping the start date is effectively dictated by I797 (which I will have 2 of).

This is USCIS memo, Read Que 5 on page 3.
Memo clearly says following things not be considered in deciding same/similar job:
- Wage difference
- Geographical location
- new employer's ability to pay (that's why it is absolutely fine if you work for your own/wife's company that started yesterday)
About a year ago, I changed job on EAD with 75% higher salary. at that time i had talked to a Sr attorney at Murthy.com and he had adviced me it is not a problem. (my 485 is still pending)
Only in the case where the new wage is simply unbelievable, it would be a problem (e.g. $20k or $450k for a s/w engg, beause there's noone who gets paid that much for that job)
So it's not the difference that would matter, it would be the absolute salary that could matter.

We applied for H1B transfer on Jan/02/09 (California Service Center - Premimum) and attached pay stub and employement offer letter. First time we did not attach any contract details.
We got an RFE on Jan/09/09, Basically they wanted to know whether i am working on project currently. They are asking to submit contract agreements, client details (client letter - not sure it is must or not).
There are 2 layers between client and my employer and could not get client letter. However, I can provide the following docs,
1. Contract Agreement Between Employer and First Layer
2. Contract Agreement Between First and Primary Vendor
3. Letter from Primary Vendor (stating that i am working their client project).
4. Primary Vendor Invoices to Client
5. Time Sheet (Client approval)
6. Access Card
7. Work site Photo
8. Copy of Client WO (end date is 11/21/2008) - client with PO amount and end date is doest not matter... (i am not sure how is uscis will take it).
I could not able to client letter due to their policy. What do you guys think on this case approval. Any reply is highly appriciated..
