One of my colleagues got audit for two consecutive years and he received his green card last month.
My worry is what if we pay panalty after IRS final decission on audit ?
Did your friend have to pay the penalty any any of those audits.

Newsflash: USA is a country (with a boundary). USA has a national anthem. They like to sing it, everywhere. If it makes them happy when I sing it, I will sing it too. It is like visiting someone's home and you are asked to take off your shoes at the entrance. Maybe you don't agree with it, but out of respect to the host it is a nice thing to do.
Relax and be more generous! I think you have more boundaries in you than this country has.
(If USA goes to war with my home country, I think they will trust me less if I come here and live and refuse to sing the national anthem...)

You never know what will happen to our GCs!! So lets remmember where we are from & what state we are now, that will help us to be more pragmatic.
And about the war thing, my conscience may not permit me to support another nation at this point in time!!

I still have a hope that one day a daring and honest person would hold the PM office and clean up the mess.

I too received EVL RFE...however, my lawyer created the letter w/o any reference to AC21...except saying that my duties remains more than X ( > 50 or more)% same as compared to one filed in I-140 application and salary remains above required level.
I had discuss this with HR before joining new position...they had no problem with it.

I filed my EAD recently and here is what you should do,
Send the supporting documents to the address mentioned at the bottom of your receipt.
Documents I have sent,
1. Cover Letter
2. Receipt Notice for online EAD filing
3. your earlier EAD paper in which your EAD arrived ( if this is renewal)
4. Your 485 Receipt Notice
This should suffice.
P.S I have already done finger printing.

U have 4 yrs degree.Ability to pay not an issue.No exp needed.This 3 are major RFE.So nothing fit for u.So maybe some minor issue.So relax.one of my friend got RFE 2weeks back but still didnt receive Actual RFE.his RD is nov15th
or Can the RFE juz verify with my employer whether the position is still available to me or not ??

I work for a reputed American consulting firm with 30000 emp globally. I am EB3 India and missed the July 2007 boat. After trying from last 2 years, I finally convinced my employer to file my EB2. I have a 4 years Engg degree and had 5 years work exp in IT before joining this company. I already worked 6 years in this company. Our Lawyers do not want to use any of my preious experiance, rather they want to use "Bachelor's degree and 5 years of progressively responsible experience" in my current employer as I received promotions in the past to became a Manager. I have doubt in it. but they are one of the most reputed law firm in US and I do not think I can question them in regards to immigration rules.

As per the current guidelines adjudicating officer makes the determination based on Department of Labor SOC/O*net code in the Labror Certification Application (ETA 9098) form. ( It's very critical to have a copy of LC application, before considering AC21. If you don't have it through employer, you can get a copy from DOL through FOIA request )
DOLs SOC/O*Net gives the job description for the Job code as well as "same or similar" jobs (if you search on your SOC/O*net code)

I also wonder what would happen to the GC application if one was to get another promotion and become a manager with even a higher salary (some job responsibilities stay the same and some new managerial responsibilites get added).

WHat happens when they return the visa number to DOS? Can they request them again later or these numbers are just wasted for this year?

Since the year is not over yet (until SEP30) , DOS can adjust the dates in next (interim ?) bulletin accordingly. That does not mean they become current like original Jul bulletin did , but at least some people will be able to file.
